Jersey Law 2/1996 EUROPEAN COMMUNITIES LEGISLATION (IMPLEMENTATION) (JERSEY) LAW 1996 ____________ A LAW to enable the States to give effect by Regulations to legislation of the European Communities, and to amend further the European Communities (Jersey) Law 1973, sanctioned by Order of Her Majesty in Council of the 13th day of DECEMBER 1995 ____________ (Registered on the 26th day of January 1996) ____________ STATES OF JERSEY ____________ The 24th day of October 1995 ____________ T HE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law – ARTICLE 1 Interpretation In this Law, unless the context otherwise requires – “Community instrument” and “the Community Treaties” have the meanings assigned to them by Article 1 of the 1973 Law; “Community provision” means any provision contained in or arising under the Community Treaties or any Community instrument whether or not that provision is directly applicable in or binding upon the Bailiwick; “the 1973 Law” means the European Communities (Jersey) Law 1973, 1 as amended. 2 ARTICLE 2 Implementation of Community provisions (1) Subject to the provisions of this Article, the States may by Regulations make such provision as appears to them to be necessary or expedient for the purposes of – (a) giving effect, either wholly or partly, to any Community provision; (b) dealing with matters arising out of or related to any such provision. (2) The provision that may be made under paragraph (1) of this Article includes any such provision (of any such extent) as might be made by a Law passed by the States, and any enactment passed or to be passed, other than one contained in Articles 1 to 3 of the 1973 Law, shall be construed and have effect subject to the foregoing provisions of this Article. (3) Without prejudice to the foregoing provisions of this Article, Regulations under this Article may – (a) make provision by reference to and may incorporate (by reference, annexation or otherwise) any Community provision to such extent and subject to such exceptions, adaptations and modifications as may be specified in the Regulations; (b) contain such other incidental, supplemental or transitional provisions or savings as the States consider expedient. ARTICLE 3 Amendment of 1973 Law In paragraph (1) of Article 1 of the 1973 Law 3 for the definition of “the Committee” there shall be substituted the following definition – “ ‘the Committee’, in relation to Articles 4 and 5 of this Law, means the Finance and Economics Committee;”. ARTICLE 4 Short title and commencement This Law may be cited as the European Communities Legislation (Implementation) (Jersey) Law 1996 and shall come into force on such day as the States may by Act appoint.
