Jersey Law 3/1951 CENSUS (JERSEY) LAW, 1951. ____________ A LAW to make provision for the taking from time to time of a census of the population of the Island, sanctioned by Order of His Majesty in Council of the 29th day of JANUARY, 1951. ____________ (Registered on the 17th day of February, 1951 ). ____________ STATES OF JERSEY. ____________ The 16th day of January, 1951. ____________ T HE STATES, subject to the sanction of His Most Excellent Majesty in Council, have adopted the following Law: - ARTICLE 1 DEFINITIONS In this Law – “the Committee” means the Committee appointed in pursuance of Article 68 of the “ Loi (1842) sur l’Etat Civil”; 1 “regulations” means regulations made under this Law. ARTICLE 2 POWER TO MAKE REGULATIONS DIRECTING THE TAKING OF A CENSUS AND PRESCRIBING PROCEDURE IN RELATION THERETO. (1) Subject as hereinafter provided, the States may make regulations – (a) directing that a census shall be taken for the Island; (b) prescribing the date on which the census is to be taken; (c) prescribing the persons by whom and with respect to whom the returns for the purpose of the census are to be made; (d) prescribing the particulars to be stated in the returns; (e) providing for the division of the Island into districts for the purpose of the census and the appointment of persons to act in those districts; (f) requiring persons appointed under the regulations to perform such duties in connexion with the taking of the census as may be prescribed by the regulations; (g) requiring persons appointed under the regulations to make an affidavit with respect to the performance of their duties; (h) requiring the chief officers of public or charitable institutions, or of any other institutions prescribed by the regulations, to make returns with respect to the inmates thereof; (j) requiring information to be given to the persons liable to make returns by the persons with respect to whom the returns are to be made; (k) with respect to the forms to be used in the taking of a census; and (l) making provision with respect to any other matters in relation to which it is necessary to make provision for the purpose of carrying the regulations into effect. (2) Any such regulations may be repealed, amended or varied by subsequent regulations. ARTICLE 3 DUTIES OF COMMITTEE IN CONNEXION WITH CENSUS (1) It shall be the duty of the Committee to make such arrangements and do all such things as are necessary for the taking of a census in accordance with the provisions of this Law and of any regulations, and for that purpose to make arrangements for the preparation and issue of the necessary forms and instructions and for the collection and reception of the forms when filled up. (2) As soon as may be after the taking of a census, the Committee shall – (a) prepare a report on the census returns and present the same to the States; and (b) cause a copy of the report to be transmitted to His Majesty’s Government in the United Kingdom. ARTICLE 4 PENALTIES (1) If any person – (a) refuses or neglects to comply with or acts in contravention of any of the provisions of this Law or of any regulations; To be printed, published and posted. BOIS, Greffier of the States. required by any regulations to make an affidavit with respect to the performance of his duties, makes a false declaration; or (c) being a person required by any regulations to make, sign, or deliver any document, makes, signs, or delivers, or causes to be made, signed, or delivered, a false document; or (d) being a person required in pursuance of any regulations to answer any question, refuses to answer or gives a false answer to that question; he shall for each offence be liable to a fine not exceeding [one hundred pounds] 2 (2) If any person – (a) being a person employed in taking a census, without the authority of the Committee, publishes or communicates to any person otherwise than in the ordinary course of such employment any information acquired by him in the course of his employment; or (b) having possession of any information which to his knowledge has been disclosed in contravention of this Law, publishes or communicates that information to any other person; he shall be liable to imprisonment for a term not exceeding two years or a fine * * * * * * * 3 or to both such imprisonment and such fine. ARTICLE 5 EXPENSES Any expenses incurred by the Committee in the exercise of its functions under this Law shall be defrayed out of the General Revenues of the States.
