Jersey Law 3/1967 INSULAR INSURANCE (AMENDMENT No. 13) (JERSEY) LAW, 1967. ____________ A LAW to amend the Insular Insurance (Jersey) Law, 1950, sanctioned by Order of Her Majesty in Council of the 23rd day of MARCH, 1967. ____________ ( Registered on the 21 st day of April , 1967). ____________ STATES OF JERSEY. ____________ The 15th day of November, 1966. ____________ T HE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law : - ARTICLE 1 (1) In the long title of the Insular Insurance (Jersey) Law, 1950, 1 as amended (hereinafter referred to as “the principal Law”) for the words “retirement pension” there shall be substituted the words “old age pension”. (2) In Articles 12, 20, 24, 25, 26, 27, 30 and 64 of, and the Second and Third Schedules to, the principal Law 2 and in Article 15 of the Insular Insurance (Amendment No. 7) (Jersey) Law, 1961, 3 for the words “retirement pension” or “a retirement pension”, as the case may be, wherever those words occur, there shall be substituted the words “old age pension” or “an old age pension” as the case may be. (3) In Article 60 of the principal Law, 4 for the word “retirement” there shall be substituted the words “old age”. ARTICLE 2 (1) Paragraphs (3) and (3A) of Article 20 of the principal Law 5 shall be deleted. (2) For the heading above Article 23 of the principal Law, 6 there shall be substituted the heading “Old age pensions.” (3) For Article 23 of the principal Law 7 there shall be substituted the following Article – “ARTICLE 23 OLD AGE PENSIONS (1) Subject to the provisions of this Law, a person shall be entitled to an old age pension if – ( a ) he is over pensionable age ; and ( b ) he satisfies the relevant contribution conditions. (2) Subject to the provisions of this Law, an old age pension shall be payable from the date on which a person attains pensionable age for life.” (4) In Article 24 of the principal Law 8 – ( a ) in sub-paragraph ( i ) of paragraph (1), the words “and both have retired from regular employment” shall be deleted ; ( b ) paragraphs (3), (3A), (3B), (3C), (3D) and (3E) shall be deleted. (5) Paragraph (3) of Article 5 of the Insular Insurance (Amendment No. 9) (Jersey) Law, 1963, 9 shall be deleted. (6) In paragraph (2) of Article 25 of the principal Law 10 – ( a ) sub-paragraph ( a ) shall be deleted ; ( b ) in sub-paragraph ( c ), for the word “retirement” there shall be substituted the words “attaining pensionable age”. (7) In Article 26 of the principal Law, 11 for the proviso to paragraph (2) there shall be substituted the following proviso – “Provided that this paragraph shall not apply where the beneficiary is a married man and his wife is over pensionable age.” (8) In Article 27 of the principal Law, 12 for the proviso to paragraph (2) there shall be substituted the following proviso – “Provided that the amount of any increase in respect of a child shall be the same as if the relevant contribution conditions had been fully satisfied.” (9) Article 28 of the principal Law 13 shall be deleted. (10) Paragraph (2) of Article 64 of the principal Law 14 shall be deleted. (11) In Parts I and III of the First Schedule to the principal Law 15 – ( a ) for the first description in the first column of each of those Parts, there shall be substituted the following description – “Men between the ages of 18 and 65” ; ( b ) for the second description in the first column of each of those Parts, there shall be substituted the following description – “Women between the ages of 18 and 60”. (12) The Sixth Schedule to the principal Law 16 shall be deleted. ARTICLE 3 In head (iii) of sub-paragraph ( a ) of paragraph (1) of Article 8 of the principal Law, 17 for the words “two hundred and eight pounds” there shall be substituted the words “two hundred and sixty pounds”. ARTICLE 4 (1) This Law may be cited as the Insular Insurance (Amendment No. 13) (Jersey) Law, 1967, and this Law and the Insular Insurance (Jersey) Laws 1950 to 1965, may be cited together as the Insular Insurance (Jersey) Laws, 1950 to 1967. (2) This Law shall come into force on the fourth Monday next following the day on which it is promulgated. E.J.M.
