Jersey Law 3/1976 DISEASES OF ANIMALS (RABIES) (JERSEY) LAW, 1976. ____________ A LAW to make further provision for the prevention and control of rabies and for connected purposes, sanctioned by Order of Her Majesty in Council of the 19th day of JANUARY, 1976. ____________ ( Registered on the 5 th day of March , 1976). ____________ STATES OF JERSEY. ____________ The 21st day of October, 1975. ____________ T HE STATES , subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law: - ARTICLE 1 INFECTED AREAS–DESTRUCTION OF WILD ANIMALS (1) An order under Article 5 of the Diseases of Animals (Jersey) Laws, 1956 to 1962 1 (hereinafter referred to as “the Laws”) making provision for areas to be declared to be infected with rabies may include provision for the destruction in such an area, by persons authorised in accordance with the order, of such wild animals (not being animals held in captivity) as may be prescribed by the order. (2) An order made under paragraph (1) of this Article may provide for – ( a ) authorising any person to enter any land (other than a dwelling-house) for the purpose of carrying out, or of deciding whether to carry out, the destruction there of animals in accordance with the order; ( b ) authorising the erection of fences or other obstacles to restrict the movement of animals into and out of an area where destruction is carried out; ( c ) regulating the ownership and disposal of the carcases of animals destroyed in accordance with the order; ( d ) prohibiting any person from obstructing the destruction of animals in accordance with the order and from interfering with the carcases of animals destroyed; ( e ) authorising the use of methods of destruction which would otherwise be unlawful. (3) An order made under paragraph (1) of this Article shall include provision for the steps to be taken to inform the occupier of any land where it is proposed that animals should be destroyed, and other persons who may be there, of the proposal and of the methods of destruction to be used. ARTICLE 2 INFECTED AREAS–ADDITIONAL POWERS An order under Article 5 of the Laws 2 making provision for areas to be declared to be infected with rabies may include provision for – ( a ) requiring notice to be given, in such circumstances as may be prescribed by the order, of the death in such an area of such domestic or wild animals as may be prescribed; ( b ) regulating the ownership and disposal of the carcases of animals whose deaths are required to be notified by virtue of sub-paragraph ( a ) of this Article; ( c ) requiring and regulating the vaccination, confinement and control in such an area of such domestic animals and animals held in captivity as may be prescribed by the order; ( d ) authorising the seizure and detention and the disposal or destruction of any animal in respect of which any provision made by virtue of sub-paragraph ( c ) of this Article is not complied with; ( e ) authorising any person to enter any land for the purpose of seizing or destroying any animal in pursuance of the order. ARTICLE 3 POWERS AS TO QUARANTINE AND CONTROL OF RABIES VIRUS The provision which may be made by order under Article 2 of the Laws 3 shall include provision – ( a ) for requiring animals which may be carriers of rabies to be kept in quarantine in such cases, for such periods and under such conditions as may be prescribed by the order; ( b ) for prohibiting or regulating the keeping or importation, or both, of rabies virus in any form and the deliberate introduction of the virus into animals. ARTICLE 4 NOTICE OF ANIMALS AFFECTED WITH RABIES Any person who knows or suspects that an animal (whether in captivity or not) is affected with rabies shall immediately give notice of that fact to the Committee and, if the animal is in his possession or under his charge, shall as far as practicable keep the animal separate from other animals. ARTICLE 5 RESTRICTION OF CARRIAGE OF ANIMALS BY SEA An order under Article 10 of the Laws 4 which is expressed to be made for the purpose of preventing the introduction of rabies into the Bailiwick may include provision for prohibiting, for such time as the Committee may consider expedient, the conveyance of such animals as may be prescribed by vessels of a prescribed class or description, or by all vessels, to or from any place in the Bailiwick. ARTICLE 6 DESTRUCTION OF IMPORTED ANIMALS An order under Article 12 of the Laws 5 prohibiting the importation of animals which is expressed to be made for the purpose of preventing the introduction of rabies into the Bailiwick may empower the Committee to arrange for the destruction of animals in respect of which the order or any licence granted under it is contravened. ARTICLE 7 INCREASE OF PENALTIES FOR OFFENCES CONNECTED WITH IMPORTATION Notwithstanding Article 37 of the Laws, 6 an order under Article 12 of the Laws 7 which is expressed to be made for the purpose of preventing the introduction of rabies into the Bailiwick may provide that a person who is guilty of an offence which consists of: - ( a ) contravening, or failing to comply with, any provision of that order; or ( b ) failing to observe any conditions to which a licence issued in accordance with the order is subject; shall be liable to imprisonment for a term not exceeding twelve months, or a fine, or both.
