Jersey Law 4/1966 WESTAWAY TRUST (AMENDMENT No. 2) (JERSEY) LAW, 1966. ____________ A LAW to annul the condition on which the Westaway Crèche was transferred to the public of the Island, sanctioned by Order of Her Majesty in Council of the 31st day of JANUARY, 1966. ____________ ( Registered on the 18 th day of March , 1966). ____________ STATES OF JERSEY. ____________ The 9th day of February, 1965. ____________ W HEREAS by a Law passed by the States on the eleventh day of March, 1930 and confirmed by Order of His Majesty in Council of the fifteenth day of May, 1930, 1 authority was granted to the sole surviving Trustee of the Will of Miss Julia Westaway, deceased, to transfer in perpetuity to the States of the Island of Jersey, for and in the name of the public of the Island, the whole of the real property of which he was seised, in his capacity of sole surviving Trustee, by virtue of certain hereditary contracts passed on the eleventh day of January, 1908 and the seventh day of June, 1919, subject to the condition set out in the First Schedule to this Law; WHEREAS the real property aforesaid was transferred to the public of the Island, subject to the said condition, by an hereditary contract passed on the twelfth day of June, 1930; WHEREAS it is considered more favourable to the welfare of poor or abandoned children that they should be accommodated in the children’s home now established in the Island and, as a consequence, the real property aforesaid is no longer of service to such children; AND WHEREAS it is possible to make use of the real property aforesaid for public purposes other than those specified in the said condition, but that, in order to do so, it is necessary that the said condition should be annulled; T HE STATES , subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law: - PART I ANNULMENT OF RESTRICTIVE COVENANT ARTICLE 1 The condition in the terms set out in the First Schedule to this Law contained in an hereditary contract passed on the twelfth day of June, 1930, between Peter Falla, sole surviving Trustee of the Will of Miss Julia Westaway, deceased, of the one part, and Charles Edward Malet de Carteret, His Majesty’s Attorney General, Alexander Moncrieff Coutanche, His Majesty’s Solicitor General and Ernest Le Sueur, Greffier of the Royal Court and of the States, for and in the name of the public of the Island, of the other part, whereby the said sole surviving Trustee transferred to the public of the Island the whole of the real property of which he was seised in his said capacity of sole surviving Trustee, is hereby annulled. ARTICLE 2 This Part of this Law shall be registered in the Public Registry of Contracts. PART II CITATION AND SHORT TITLE ARTICLE 3 The enactments mentioned in the first column of the Second Schedule to this Law may, without prejudice to any other mode of citation, be cited by the short title mentioned opposite thereto in the second column of the said Schedule. ARTICLE 4 This Law may be cited as the Westaway Trust (Amendment No. 2) (Jersey) Law, 1966, and this Law, the Westaway Trust (Jersey) Law, 1930 and the Westaway Trust (Amendment) (Jersey) Law, 1933 may be cited together as the Westaway Trust (Jersey) Laws, 1930 to 1966.
