Jersey Law 4/1975 PUBLIC FINANCES (ADMINISTRATION) (AMENDMENT) (JERSEY) LAW, 1975. ____________ A LAW to amend the Public Finances (Administration) (Jersey) Law, 1967, sanctioned by Order of Her Majesty in Council of the 26th day of FEBRUARY, 1975. ____________ ( Registered on the 4 th day of April, 1975). ____________ STATES OF JERSEY. ____________ The 24th day of September, 1974. ____________ T HE STATES , subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law: - ARTICLE 1 In Article 1 of the Public Finances (Administration) (Jersey) Law, 1967 1 (hereinafter referred to as “the principal Law”) for the definition of “States Auditor” there shall be substituted the definition “ ‘States Auditor’ means any person or firm appointed under Article 11 of this Law”. ARTICLE 2 (1) For paragraphs (1) to (6) of Article 11 of the principal Law 2 there shall be substituted the following paragraphs – “(1) The States shall, on the recommendation of the Finance and Economics Committee, appoint on such terms and conditions as the States may specify, a person or firm of accountants to exercise the powers conferred and to perform the duties imposed on the States Auditor by this Law: Provided that no person shall be appointed to the said office who is not a member, and no firm shall be appointed whose partners are not members of one of the following professional associations – The Institute of Chartered Accountants in England and Wales. The Institute of Chartered Accountants in Scotland. The Institute of Chartered Accountants in Ireland. The Association of Certified Accountants. (2) The States Auditor may be removed from office by the States. (3) The remuneration of the States Auditor shall be a charge against the income of the States and shall be inserted in the Budget for the purposes of reference only and shall not be subject to discussion by the States. (4) The States Auditor may resign from office at any time by giving to the States notice in writing of his intention to do so, and such notice shall contain a statement either that, in his opinion, there are no circumstances connected with his resignation that should be brought to the attention of the States, or, where such circumstances do exist, of the reasons for his resignation. (5) Any discussion regarding the appointment, resignation, suspension or dismissal of the States Auditor shall take place in camera”. (2) In sub-paragraph ( a ) of paragraph (9) of the said Article 11 after the word “books”, there shall be inserted the words “Minute Books, accounting records”, and after the said sub-paragraph ( a ) there shall be inserted the following proviso – “Provided that access to a Minute Book shall be obtainable only at the States’ Greffe and, in any case where the States Auditor is a firm of accountants, only by a member of that firm previously approved for that purpose by the Greffier of the States.” (3) In sub-paragraph ( a ) of paragraph (11) of the said Article 11, after the words “books of account” there shall be inserted the words “and, in respect of the accounts of a Committee designated by the Finance and Economics Committee as a trading Committee, whether the balance sheet gives a true and fair view of the state of affairs of that Committee, and whether the profit and loss account gives a true and fair view of the profit or loss of that Committee for the financial year”.
