Jersey Law 5/1996 CHILDREN (AMENDMENT No. 5) (JERSEY) LAW 1996 ____________ A LAW to amend further the Children (Jersey) Law 1969, sanctioned by Order of Her Majesty in Council of the 13th day of MARCH 1996 ____________ (Registered on the 12th day of April 1996) ____________ STATES OF JERSEY ____________ The 26th day of September 1995 ____________ T HE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law – ARTICLE 1 In Article 4 of the Children (Jersey) Law 1969 1 (hereinafter referred to as “the principal Law”) – (a) in paragraph (1) for the words “fifty pounds or, in the case of a second or subsequent offence, to a fine not exceeding one hundred pounds” there shall be substituted the words “level 3 on the standard scale 2 ”; (b) in paragraph (3) for the words “twenty pounds” there shall be substituted the words “level 2 on the standard scale”. ARTICLE 2 In Article 7 of the principal Law 3 – (a) in paragraph (1) for the words “one hundred pounds or in the case of a second or subsequent offence to a fine not exceeding two hundred pounds” there shall be substituted the words “level 3 on the standard scale”; (b) in paragraph (2), for the words “fifty pounds or in the case of a second or subsequent offence to a fine not exceeding one hundred pounds” there shall be substituted the words “level 3 on the standard scale”. ARTICLE 3 In Article 9 of the principal Law 4 – (a) in paragraph (1) for the words “not exceeding five hundred pounds or to imprisonment for a term not exceeding five years” there shall be substituted the words “or to imprisonment for a term not exceeding ten years”; (b) paragraph (4) shall be deleted. ARTICLE 4 In paragraph (6) of Article 53 of the principal Law 5 for the words “ten pounds” there shall be substituted the words “level 2 on the standard scale”. ARTICLE 5 In Article 64 of the principal Law 6 for the words “five hundred pounds” there shall be substituted the words “level 3 on the standard scale”. ARTICLE 6 In Article 67 of the principal Law 7 for all the words after “he shall be liable to a fine not exceeding” to the end of the Article there shall be substituted the words “level 2 on the standard scale, or to imprisonment for a term not exceeding six months, or to both such fine and such imprisonment.”. ARTICLE 7 In paragraph (6) of Article 71 of the principal Law 8 for all the words after “shall be liable to a fine not exceeding” to the end of the paragraph there shall be substituted the words “level 3 on the standard scale, or to imprisonment for a term not exceeding three months, or to both such fine and such imprisonment.”. ARTICLE 8 In paragraph (5) of Article 78 of the principal Law 9 – (a) for the words “one hundred pounds” there shall be substituted the words “level 4 on the standard scale”; (b) for the words “five pounds” there shall be substituted the words “level 1 on the standard scale”. ARTICLE 9 In paragraph (3) of Article 80 of the principal Law 10 for the words “fifty pounds” there shall be substituted the words “level 2 on the standard scale”. ARTICLE 10 In both paragraphs (8) and (9) of Article 84 of the principal Law 11 for the words “fifty pounds” there shall be substituted the words “level 3 on the standard scale”. ARTICLE 11 In paragraph (2) of Article 87 of the principal Law 12 for the words “ten pounds” there shall be substituted the words “level 2 on the standard scale”. ARTICLE 12 In paragraph (6) of Article 94 of the principal Law 13 for the words “ten pounds” there shall be substituted the words “level 2 on the standard scale”. ARTICLE 13 In paragraph (2) of Article 95 of the principal Law 14 for the words “five pounds” there shall be substituted the words “level 2 on the standard scale”. ARTICLE 14 In Article 98 of the principal Law 15 for the words “one hundred pounds” there shall be substituted the words “level 4 on the standard scale”. ARTICLE 15 In paragraph (3) of Article 100 of the principal Law 16 for the words “fifty pounds” there shall be substituted the words “level 3 on the standard scale”. ARTICLE 16 In Article 100A of the principal Law 17 – (a) in both paragraphs (1) and (2) for the words “seventeen years” wherever they occur there shall be substituted the words “eighteen years”; (b) in paragraph (4) for the words “five hundred pounds” there shall be substituted the words “level 4 on the standard scale”. ARTICLE 17 In Article 100B of the principal Law – (a) in the heading for the word “SEVENTEEN” there shall be substituted the word “EIGHTEEN”; (b) in the Article for the words “seventeen years” there shall be substituted the words “eighteen years”. ARTICLE 18 In Article 100C of the principal Law – (a) in the heading for the word “SEVENTEEN” there shall be substituted the word “EIGHTEEN”; (b) in paragraph (1) of the Article for the words “seventeen years” there shall be substituted the words “eighteen years”. ARTICLE 19 In Article 103 of the principal Law 18 for all the words after “he shall be liable” to the end of the Article there shall be substituted the words “to a fine not exceeding level 3 on the standard scale”. ARTICLE 20 This Law may be cited as the Children (Amendment No. 5) (Jersey) Law 1996 and shall come into force on such day as the States may by Act appoint.
