Jersey Law 6/1950 PUBLIC HEALTH (VESSELS AND AIRCRAFT) (JERSEY) LAW, 1950. ____________ A LAW to make provision for preventing danger to public health in connexion with the arrival and departure of vessels and aircraft, sanctioned by Order of His Majesty in Council of the 25th day of APRIL, 1950. ____________ (Registered on the 13th day of May, 1950). ____________ STATES OF JERSEY. ____________ The 14th day of February, 1950. ____________ T HE STATES, subject to the sanction of His Most Excellent Majesty in Council, have adopted the following Law: - ARTICLE 1 DEFINITIONS In this Law – “coastal waters” means waters within a distance of three nautical miles from any point on the coast measured from low-water mark of ordinary spring tides; “the Committee” means the Public Health Committee; “vessel” includes any ship or boat, or any other description of vessel used in navigation. ARTICLE 2 POWER OF COMMITTEE TO MAKE ORDERS (1) Subject to the provisions of this Law, the Committee may, as respects the whole or any part of the Island, including the coastal waters thereof, make provision by order – (a) for preventing danger to public health from vessels or aircraft arriving in the Island; and (b) for preventing the spread of infection by means of any vessel or aircraft leaving the Island, so far as may be necessary or expedient for the purpose of carrying out any treaty, convention, arrangement or engagement with any other country; and, without prejudice to the generality of the foregoing, may by any such order apply, with or without modifications, to any disease to which the order relates, any enactment relating to the notification of disease or to notifiable diseases: Provided that, before making any order under this paragraph, the Committee shall consult with the Harbours and Airport Committee. (2) Any order made under this Article may provide for – (a) the signals to be displayed by vessels or aircraft having on board any case of epidemic, endemic or infectious disease; (b) the questions to be answered by masters, pilots and other persons on board any vessel or aircraft as to cases of such disease on board during the voyage or on arrival; (c) the duties to be performed in cases of such diseases by masters, pilots and other persons on board vessels or aircraft; (d) the recovery of monetary penalties in respect of any contravention of or failure to comply with any provisions of the order, so, however, that such penalties shall not exceed those specified in Article 4 of this Law; (e) the detention of vessels or aircraft or of persons on board them; and may authorise the making of charges and provide for the recovery of such charges and of any expenses incurred in disinfection . (3) Every order made under this Article – (a) shall come into force on the date prescribed thereby; (b) may be amended or revoked by a subsequent order; (c) shall remain in force until revoked; and (d) shall be laid before the States as soon as may be after it is made, and if the States, within the period of twenty-one days beginning with the day on which any such order is laid before them, resolve that it be annulled, it shall cease to have effect, but without prejudice to anything previously done thereunder or to the making of any new order. (4) The Greffier of the States shall cause every order made under this Article to be printed and shall cause to be published in two newspapers circulating in the Island, one being a publication in French and the other a publication in English, 1 a notice stating that the order has been made, the date of the coming into force thereof and the place at which printed copies thereof may be purchased. ARTICLE 3 POWER OF ENTRY The Medical Officer of Health, and any person generally or specially authorized in writing in that behalf by the Committee, subject to the production by him if so required of evidence of his authority, shall have power to enter any premises, vessel or aircraft for the purpose of executing, or superintending the execution of, any orders made under this Law. ARTICLE 4 OFFENCES Any person who wilfully neglects or refuses to obey or carry out, or obstructs the execution of, the provisions of any order made under this Law shall, in a case where no provision is made by the order for his punishment, be liable to a fine not exceeding one hundred pounds sterling and, in the case of a continuing offence, to a further fine not exceeding fifty pounds sterling for every day on which the offence continues after conviction therefor: Provided that the court may, in lieu of or in addition to imposing a monetary penalty, impose a sentence of imprisonment for a term not exceeding three months. ARTICLE 5 FEES AND EXPENSES (1) All charges and other monies received in pursuance of this Law shall be credited to the General Revenues of the States. (2) All expenses incurred in the administration of this Law shall be defrayed out of the General Revenues of the States. ARTICLE 6 REPEAL The following Laws are hereby repealed – (a) the “ Loi rendant applicables à cette Ile certaines provisions de l’Acte de Parlement dit ‘Public Health Act, 1896’ (59 & 60 Vict . ch . 19), et des Règlements émanant du ‘Local Government Board’ en vertu dudit Acte ”, confirmed by Order of Her Majesty in Council of the 18th day of May, 1897; 2 and (b) the “ Loi rendant applicables à cette Ile certaines prescriptions des Règlements , émanant du ‘Local Government Board’ en vertu des ‘Public Health Acts’ au sujet de la Visite des Navires ”, confirmed by Order of His Majesty in Council of the 31st day of May, 1910. 3 ARTICLE 7 CITATION AND COMMENCEMENT (1) This Law may be cited as the Public Health (Vessels and Aircraft) (Jersey) Law, 1950. (2) This Law shall come into force forthwith upon promulgation: Provided that Article 6 of this Law shall not come into force until the date of commencement of the first order made in relation to vessels under sub-paragraph (a) of paragraph (1) of Article 2 of this Law.
