Jersey Law 6/1974 HOUSING (AMENDMENT No. 4) (JERSEY) LAW, 1974. ____________ A LAW to amend further the Housing (Jersey) Law, 1949, sanctioned by Order of Her Majesty in Council of the 26th day of March, 1974. ____________ (Registered on the 17 th day of May, 1974). ____________ STATES OF JERSEY. ____________ The 12th day of June, 1973. ____________ T HE STATES , subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law: - ARTICLE 1 (1) In paragraph (2) of Article 6 of the Housing (Jersey) Law, 1949, 1 as amended, (hereinafter referred to as “the principal Law”) – ( a ) in sub-paragraph ( c ) for the words “, the public or a parish” there shall be substituted the words “or the public”; ( b ) clause ( i ) of sub-paragraph ( d ) and sub-paragraph ( e ) shall be deleted. (2) After the said paragraph there shall be inserted the following paragraph – “(3) Regulations made under this Part of this Law may exempt, either unconditionally or subject to such conditions as may be prescribed in such regulations, any class of transaction from the provisions of this Part of this Law.” ARTICLE 2 In Article 10 of the principal Law 2 – ( a ) in paragraph (1) for the words “sale or transfer of any land or any registered contract of lease” there shall be substituted the words “sale, transfer or lease of any land” and for the words “sale or transfer or registered contract” there shall be substituted the words “sale or transfer or lease”; ( b ) for paragraph (2) there shall be substituted the following paragraph – “(2) Without prejudice to the generality of the foregoing provisions of this Article, every consent granted by the Committee to the sale, transfer or lease, whether by a registered contract or not, of any land to a body corporate shall be subject to the following condition – ‘Any unit of dwelling accommodation on the land at the time of the grant of this consent, or created on the land thereafter, shall not without the consent of the Committee be occupied other than by a person who falls within any class specified by the States by regulations made under Part III of the Housing (Jersey) Law, 1949, as amended, being a class to which this condition is specifically stated to refer by those regulations.’ and any consent granted by the Committee to the sale, transfer or lease of any land to a body corporate before the sixth day of February 1973 shall be deemed, notwithstanding any other provision of the consent, to have attached to it a condition in the terms aforesaid: Provided that the condition so attached shall not apply to a person occupying before the said date a unit of dwelling accommodation on the land in respect of which the consent was granted.” ( c ) in paragraph (3) the words “whether by a registered contract or not,” shall be deleted. ARTICLE 3 In paragraph (1) of Article 14 of the principal Law 3 – ( i ) for the words “five hundred pounds” in both places where they appear there shall be substituted the words “five thousand pounds”; (ii) after the word “greater” there shall be inserted the following words – “, and, in the case of a continuing offence, to a further fine not exceeding fifty pounds for each day on which the offence so continues”. ARTICLE 4 (1) This Law may be cited as the Housing (Amendment No. 4) (Jersey) Law, 1974 and this Law, the Housing (Extension of Powers) (Jersey) Law, 1969 4 and the Housing (Jersey) Laws, 1949 to 1966 5 may be cited together as the Housing (Jersey) Laws, 1949 to 1974. (2) This Law shall come into force on the Monday next following the date of promulgation, with the exception of sub-paragraph ( b ) of Article 2 which shall be deemed to have come into force on the sixth day of February, 1973.
