Jersey Law 9/1996 ISLAND PLANNING (AMENDMENT NO. 6) (JERSEY) LAW 1996 ____________ A LAW to amend further the Island Planning (Jersey) Law 1964, sanctioned by Order of Her Majesty in Council of the 13th day of MARCH 1996 ____________ (Registered on the 12th day of April 1996) ____________ STATES OF JERSEY ____________ The 21st day of November 1995 ____________ T HE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law – ARTICLE 1 In paragraph (1) of Article 1 of the Island Planning (Jersey) Law 1964, 1 as amended (hereinafter referred to as “the principal Law”), for the definition of “the Committee” there shall be substituted the following definition – “ ‘the Committee’ means the Planning and Environment Committee;”. ARTICLE 2 In Article 6 of the principal Law 2 – (a) at the end of paragraph (1) there shall be inserted the following words – “and shall be accompanied by the prescribed fee”; (b) in paragraph (1A) for the words “one thousand pounds” there shall be substituted the words “level 4 on the standard scale 3 ”; and (c) after paragraph (12) there shall be inserted the following paragraph – “(12A) In paragraph (1) of this Article ‘prescribed’ means prescribed by order of the Committee.”. ARTICLE 3 After Article 6 of the principal Law there shall be inserted the following Article – “ARTICLE 6A FEES IN CONNEXION WITH APPLICATIONS FOR PERMISSION TO DEVELOP LAND (1) The Committee may by order prescribe the fees payable under paragraph (1) of Article 6 of this Law. (2) An order under this Article may provide for all or any of the following matters – (a) specific fees; (b) maximum or minimum fees; (c) maximum and minimum fees; (d) the payment of fees either generally or under specified conditions or in specified circumstances; and (e) the reduction, waiver or refund, in whole or in part of such fees. (3) Where an order under this Article provides for any reduction, waiver or refund, in whole or in part of any fee, such reduction, waiver or refund may be expressed to apply or be applicable either generally or specifically – (a) in respect of certain matters or classes of matter; (b) in respect of certain documents or classes of document; (c) in respect of certain persons or classes of person; or (e) in respect of any combination of such matters, documents, events or persons, and may be expressed to apply or to be applicable subject to such conditions as may be specified in the order or in the discretion of the Committee.”. ARTICLE 4 In Article 8 of the principal Law 4 – (a) in paragraph (1) the words “not exceeding five thousand pounds” shall be deleted; and (b) in paragraph (3) – (i) for the words “five hundred pounds” there shall be substituted the words “level 3 on the standard scale”; and (ii) for the words “one hundred pounds” there shall be substituted the words “level 2 on the standard scale”. ARTICLE 5 In Article 9A of the principal Law 5 – (a) in paragraph (2) the words “not exceeding five thousand pounds” shall be deleted; and (b) in paragraph (5) for the words “five hundred pounds” there shall be substituted the words “level 3 on the standard scale”. ARTICLE 6 In paragraph (2) of Article 11 of the principal Law 6 – (a) for the words “two hundred and fifty pounds” there shall be substituted the words “level 3 on the standard scale”; and (b) for the words “ten pounds” there shall be substituted the words “level 1 on the standard scale”. ARTICLE 7 In Article 14 of the principal Law 7 – (a) for the words “five hundred pounds” there shall be substituted the words “level 3 on the standard scale”; and (b) for the words “one hundred pounds” there shall be substituted the words “level 2 on the standard scale”. ARTICLE 8 In paragraph (4) of Article 16 of the principal Law 8 – (a) for the words “two hundred and fifty pounds” there shall be substituted the words “level 3 on the standard scale”; and (b) for the words “twenty pounds” there shall be substituted the words “level 1 on the standard scale”. ARTICLE 9 In Article 17 of the principal Law 9 for the words “two hundred and fifty pounds” there shall be substituted the words “level 3 on the standard scale”. ARTICLE 10 In Article 18 of the principal Law 9 for the words “five hundred pounds” there shall be substituted the words “level 3 on the standard scale”. ARTICLE 11 In paragraph (4) of Article 19 of the principal Law 9 – (a) for the words “two hundred and fifty pounds” there shall be substituted the words “level 3 on the standard scale”; and (b) for the words “twenty-five pounds” there shall be substituted the words “level 1 on the standard scale”. ARTICLE 12 In paragraph (4) of Article 20 of the principal Law 9 – (a) for the words “two hundred and fifty pounds” there shall be substituted the words “level 3 on the standard scale”; and (b) for the words “ten pounds” there shall be substituted the words “level 1 on the standard scale”. ARTICLE 13 In paragraph (2) of Article 23 of the principal Law for the words “two hundred and fifty pounds” there shall be substituted the words “level 3 on the standard scale”. ARTICLE 14 This Law may be cited as the Island Planning (Amendment No. 6) (Jersey) Law 1996 and shall come into force on such day as the States may by Act appoint. G.H.C.
