Jersey Law 11/1993 POLICE FORCE (AMENDMENT No. 5) (JERSEY) LAW 1993 ____________ A LAW to amend further the Police Force (Jersey) Law 1974, sanctioned by Order of Her Majesty in Council of the 31st day of MARCH 1993 ____________ (Registered on the 14th day of May 1993) ____________ STATES OF JERSEY ____________ The 29th day of September 1992 ____________ T HE STATES , subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law – ARTICLE 1 In paragraph (5) of Article 3 of the Police Force (Jersey) Law 1974, 1 as amended (hereinafter referred to as “the principal Law”), for the words “the United Kingdom” there shall be substituted the words “any other part of the British Islands”. ARTICLE 2 After paragraph (3) of Article 8 of the principal Law 2 there shall be inserted the following paragraphs – “(4) Subject to paragraphs (5), (6) and (7) of this Article, an Order under sub-paragraph (d) of paragraph (3) of this Article may provide procedures for – (a) the informal resolution by the Chief Officer, or by a member of the Force appointed by him, of complaints of such descriptions as may be prescribed, and for giving the member of the public who made the complaint a record of the outcome of any such procedure if he applies for one within such period as may be prescribed; (b) giving a member of the Force against whom a complaint has been made which falls to be resolved informally an opportunity of commenting orally or in writing on the complaint. (5) A complaint does not fall to be resolved informally unless – (a) the member of the public concerned gives his consent; and (b) the Chief Officer is satisfied that the conduct complained of, even if proved, would not justify a criminal or disciplinary charge. (6) Subject to paragraph (7) of this Article, no statement made by any person for the purpose of the informal resolution of a complaint shall be admissible in any subsequent criminal, civil or disciplinary proceedings. (7) A statement is not rendered inadmissible by paragraph (6) of this Article if it consists of or includes an admission relating to a matter which does not fall to be resolved informally.”.
