Jersey Law 11/1995 MOTOR VEHICLE REGISTRATION (AMENDMENT) (JERSEY) LAW 1995 ____________ A LAW to amend the Motor Vehicle Registration (Jersey) Law 1993, sanctioned by Order of Her Majesty in Council of the 8th day of FEBRUARY 1995 ____________ ( Registered on the 21st day of April 1995 ) ____________ STATES OF JERSEY ____________ The 6th day of September 1994 ____________ T HE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law – ARTICLE 1 In Article 1 of the Motor Vehicle Registration (Jersey) Law 1993 1 (hereinafter referred to as “the principal Law”), in paragraph (1), there shall be inserted after the definition of “the Inspector” the following definition – “ ‘insurance write off’ means a determination by an insurer that the cost of repairing damage to a motor vehicle caused by a peril insured against would exceed the value of the vehicle when repaired;”. ARTICLE 2 In Article 5 of the principal Law – (a) after paragraph (2), there shall be inserted the following paragraph – “(2A) Where a registered motor vehicle is the subject of an insurance write off the insurer shall, within the prescribed period and in the prescribed manner, notify the Inspector of that fact.”; (b) in sub-paragraphs (a) and (b) of paragraph (3), for the words “or (2)” there shall be substituted the words “, (2) or (2A)”; (c) in paragraph (4), after sub-paragraph (c), there shall be inserted the following sub-paragraph – “(d) an insurance write off of a registered motor vehicle, and he has not at that time received notification of the breaking up or destruction of the vehicle, he shall issue to the owner a registration document in respect of the vehicle recording the insurance write off.”. ARTICLE 3 In Article 7 of the principal Law, after clause (iv) of sub-paragraph (f), there shall be inserted the following clause – “(v) an insurance write off of a registered motor vehicle;”. ARTICLE 4 In Article 11 of the principal Law, in sub-paragraph (b) of paragraph (1) and in paragraph (2), after the word “destruction” there shall be inserted the words “, insurance write off”. ARTICLE 5 This Law may be cited as the Motor Vehicle Registration (Amendment) (Jersey) Law 1995 and shall come into force on such day as the States may by Act appoint. C.M.
