(c) after paragraph (1) there shall be added the following paragraphs – “(2) Notwithstanding paragraph (1), in any hearing before the start of a trial, the Court may, after hearing representations from the parties and without requiring the consent of the accused, direct that the accused shall be treated as being present in the Court if, during that hearing, either by way of a live television link or otherwise, the accused is able to see and hear the Court and to be seen and heard by the Court.
