ARTICLE 2 Authorization of use of public roads for holding or viewing of entertainments (1) The Committee may, on the application of any persons, by Order declare that any public road may be used for the purpose of the holding of an entertainment, the viewing of an entertainment held elsewhere, or the making of arrangements preparatory to the holding of an entertainment, or the viewing of an entertainment to be held elsewhere, as the case may be, during the whole or part of any days specified in the Order: Provided that no such Order shall be made except after consultation with the Connétable of the Parish in which the road is situated and with any other authority having the administration of the road: Provided further that, in relation to any particular road, the number of such days shall not exceed six in any year. (2) Any Order made under this Article may authorise the placing and maintenance on a road to which the Order relates of material required for the purposes of, or in connexion with, the entertainment during such period as may be specified in the Order: Provided that, in relation to the carriageway of a road, such authority shall extend only to the placing and maintenance of decorative features during a period beginning not more than fourteen days before, and ending not more than fourteen days after, the holding of the entertainment. (3) An Order made under this Article shall contain all such provisions as the Committee considers necessary, including provisions for the temporary prohibition, restriction, or regulation of traffic, for the safety of the public and for all purposes incidental to the proper conduct of the entertainment. (4) The Subordinate Legislation (Jersey) Law, 1960, as amended, 3 shall apply to Orders made under this Law. ARTICLE 3 Expenses of Committee The expenses incurred by the Committee in carrying into effect any Order under this Law shall be defrayed by the applicants and the Committee may, before making the Order, require the applicants to make such deposit as may, in the opinion of the Committee, be necessary to defray such expenses. ARTICLE 4 Offences If, during any period specified in an Order made under this Law, any person – (a) wilfully and unlawfully obstructs or interferes with the conduct of the entertainment authorized by the Order; or (b) without due authority enters or remains within the limits specified in the Order; he shall be liable to a fine not exceeding five hundred pounds, and he and any animal or vehicle under his charge may be removed by any police officer or by any person duly authorized under the Order to assist in conducting the entertainment. ARTICLE 5 Saving Nothing in this Law shall be deemed to derogate from the powers of the Bailiff in matters of public entertainment and, save as otherwise expressly provided by or under this Law, nothing in this Law shall be deemed to affect any other law, whether customary or enacted. ARTICLE 6 Repeal The Entertainments on Public Roads (Jersey) Law, 1954 4 is repealed. ARTICLE 7 Short title This Law may be cited as the Entertainments on Public Roads (Jersey) Law, 1985. E.J.M.
