Jersey Law 19/1960 DISEASES OF ANIMALS (AMENDMENT) (JERSEY) LAW, 1960. ____________ A LAW to amend the Diseases of Animals (Jersey) Law, 1956, sanctioned by Order of Her Majesty in Council of the 12th day of SEPTEMBER, 1960. ____________ ( Registered on the 1 st day of October , 1960). ____________ STATES OF JERSEY. ____________ The 22nd day of March, 1960. ____________ T HE STATES , subject to the sanction of Her Most Excellent Majesty in Council have adopted the following Law : - ARTICLE 1 In this Law, “the Law of 1933” means the “ Loi (1933) sur l’Introduction de Bétail Étranger , sur la Viande de Boucherie et sur l’Abatage”. 1 ARTICLE 2 (1) In paragraph (5) of Article 1 of the Diseases of Animals (Jersey) Law, 1956, 2 (hereinafter referred to as “the principal Law”), for the definition of “Veterinary Officer” there shall be substituted the following definition – “ ‘Veterinary Officer’ has the meaning assigned thereto by Article 1A of this Law ;”. (2) In Part II of the principal Law, immediately before Article 2 thereof, 3 there shall be inserted the following Article – “ARTICLE 1A APPOINTMENT OF VETERINARY OFFICER (1) Subject to the provisions of paragraph (2) of this Article, the Committee shall appoint a veterinary surgeon to the post of Veterinary Officer (in this Law referred to as “the Veterinary Officer”) to exercise such powers as are conferred and to perform such duties as are imposed, on the Veterinary Officer by or under this Law or any other enactment and to perform such other duties relating to veterinary matters as the Committee may from time to time impose on him. (2) The appointment of the Veterinary Officer shall be subject to the approval of the States, who shall first deliberate thereon in camera, and shall then vote in public assembly by ballot, the votes of an absolute majority of the members present being necessary for such approval. (3) Where the occasion requires, the Committee may make temporary arrangements for the exercise by any person of all or any of the functions of the Veterinary Officer, and any person appointed by virtue of any such arrangements to exercise those functions or any of them shall, subject to the terms of his appointment, have the same powers and be subject to the same duties as the Veterinary Officer. (4) The requirement of this Article that the Veterinary Officer shall be a veterinary surgeon shall be deemed to be complied with if, at the time of his appointment, he is the holder of qualifications which entitle him to be registered as a veterinary surgeon under the Laws or Regulations for the time being regulating the exercise of that profession in the Island and if he is so registered before he enters into the execution of the office.” ARTICLE 3 In the construction, and for the purposes, of any enactment, certificate or other document passed or made before the coming into force of this Law, anything which is, or is to be construed as, a reference to the “ Vétérinaire ” appointed in pursuance of Article 2 of the Law of 1933, 4 shall be construed as a reference to the Veterinary Officer appointed in pursuance of the principal Law as amended by this Law. ARTICLE 4 If, at the time of the coming into force of this Law, there is in office a person appointed to the post of “ Vétérinaire ” in pursuance of Article 2 of the Law of 1933, 4 that person shall be deemed to have been appointed to the post of Veterinary Officer in pursuance of the principal Law as amended by this Law. ARTICLE 5 The following enactments, in so far as they elate to the post of “ Vétérinaire ”, are hereby repealed, namely – ( a ) Article 2 of the Law of 1933 4 ; and ( b ) the “ Règlement Permanent (1937) au sujet du remplacement temporaire de l’Inspecteur et du Vétérinaire nommé aux fins de la Loi (1933) sur l’Introduction de Bétail Étranger , etc. 5 ARTICLE 6 This Law may be cited as the Diseases of Animals (Amendment) (Jersey) Law, 1960.
