Jersey Law 19/1965 MOTOR VEHICLE DUTY (AMENDMENT No. 4) (JERSEY) LAW, 1965. ____________ A LAW to amend the Motor Vehicle Duty (Jersey) Law, 1957, sanctioned by Order of Her Majesty in Council of the 18th day of SEPTEMBER, 1965. ____________ ( Registered on the 5 th day of November , 1965). ____________ STATES OF JERSEY. ____________ The 1st day of April, 1965. ____________ T HE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law: - ARTICLE 1 In Article 1 of the Motor Vehicle Duty (Jersey) Law, 1957, 1 as amended (hereinafter referred to as “the principal Law”), the definitions of “farm vehicle”, “motor bicycle” and “motor tricycle” are hereby repealed. ARTICLE 2 (1) For paragraph (1) of Article 2 of the principal Law 2 there shall be substituted the following paragraph – “(1) Subject to the provisions of this Law – (a) there shall be charged in respect of mechanically propelled vehicles used on public roads in the Island such duties as the States shall by Regulations provide; and (b) the duty so chargeable in respect of any mechanically propelled vehicle shall be paid in each calendar year on a licence to be taken out by the owner of the vehicle.” (2) In paragraph (2) of the said Article 2 for the words “under this Law” there shall be substituted the words “by virtue of this Law”. (3) In paragraph (3) of the said Article 2 for the words “under this Law” there shall be substituted the words “chargeable by virtue of this Law”. (4) Paragraphs (5), (6), (7) and (8) of the said Article 2 are hereby repealed. ARTICLE 3 In Article 3 of the principal Law 3 for the words “under this Law” there shall be substituted the words “by virtue of this Law”. ARTICLE 4 In paragraph (1) of Article 6 of the principal Law 4 for all the words after “on payment of duty” to the end of that paragraph there shall be substituted the words “at such rate or rates as the States shall by Regulations provide:”. ARTICLE 5 In paragraph (1) of Article 8 of the principal Law 5 the words “under this Law” on each occasion where those words occur are hereby repealed. ARTICLE 6 In sub-paragraph (a) of Article 14 of the principal Law 6 for the words “under this Law” there shall be substituted the words “by virtue of this Law”. ARTICLE 7 In sub-paragraph (b) of Article 16 of the principal Law 7 for the words “or cylinder capacity” there shall be substituted the words “,cylinder capacity or dimensions”. ARTICLE 8 (1) After Article 17 of the principal Law 7 there shall be inserted the following Article – “ARTICLE 17A REGULATIONS Regulations made under this Law may provide for – (a) different rates of duty to be charged in respect of mechanically propelled vehicles of different types and when used for different purposes; (b) the methods to be used for ascertaining the dimensions, unladen weight, or the unit of horsepower or cylinder capacity for the purpose of any rate of duty of any mechanically propelled vehicle.” (2) Article 19 of the principal Law 8 is hereby repealed. ARTICLE 9 (1) In paragraph (3) of Article 20 of the principal Law 9 for the words “duty under this Law” there shall be substituted the words “duty chargeable by virtue of this Law”. (2) Paragraphs (2) and (4) of the said Article 20 are hereby repealed. ARTICLE 10 (1) This Law may be cited as the Motor Vehicle Duty (Amendment No. 4) (Jersey) Law, 1965. (2) This Law shall come into force of the first day of January next following the day on which the first Regulations under the principal Law, as amended by this Law, are made. A.D.
