About this statute

These Regulations may be cited as the Data Protection (Complaints Handling Procedure and Enforcement) Regulations. Defines terms used in these Regulations such as "Act", "complainant", "Data Commissioner", "Office", "enforcement notice", "penalty", "penalty notice", "respondent", and "summons". Facilitate a fair, impartial, just, expeditious, proportionate and affordable determination of complaints lodged with the Data Commissioner in accordance with the Act and these Regulations, without undue regard to technicalities of procedure. Proceedings before the Office are to be in Kiswahili, English, or Kenyan Sign Language; the Office may provide an interpreter for a party who cannot speak, hear or understand the language of proceedings. Respondents must make representations, provide supporting material, review complaints to try to resolve them, or provide required responses; if they do not act, the Data Commissioner must determine the complaint; the notice must specify resolution options including ADR.
