Citation 1. These regulations may be cited as the Health Services (Fees and Charges) Regulations (2008 Revision). 2. Fees 2. (1) Except as otherwise provided by the Law or by these regulations, the fees specified in the Schedule shall be payable by patients of health care facilities. (2) Where a patient is provided with a service specified in Part 2 or 3 of the Schedule he will be charged the inclusive fee specified in that Part, but will otherwise be charged the individual itemised fee or fees specified in Part 1 of the Schedule. (3) Where a patient — (a) is not authorised to carry on a gainful occupation in the Islands by a work permit issued under the Immigration Law (2007 Revision); (b) is not a member of one of the classes of persons specified in section 40(1) of the Immigration Law (2007 Revision); (c) is not a Caymanian under the Immigration Law (2007 Revision); c Revised as at 13th day of May, 2008 Page 5 Regulation 3 Health Services (Fees and Charges) Regulations (d) does not have a right of permanent residence under the Immigration Law (2007 Revision); or (e) is the spouse or a child of a person specified in paragraph (a), (b), (c) or (d), the fees payable for his treatment, except the fees specified in the items in the Schedule that are marked by an asterisk, shall be one hundred and seventy per cent of the rates specified in the Schedule. 3. Waiver of fees 3. (1) The assessment required under section 8 shall be conducted by a person with such professional qualifications as shall satisfy the Director of Health Services that the person is competent to assess the financial standing of patients. (2) The assessment shall be of the total disposable income and of the total value of the capital assets of the patient and the patient’s spouse, and of the total value of any capital assets disposed of by the patient or the patient’s spouse in the period of twelve months immediately preceding the treatment in respect of which fees are payable by the patient. (3) If the assessment indicates that — (a) the total disposable income of the patient and the patient’s spouse; or (b) the total value of the capital assets of the patient and the patient’s spouse, including any capital assets disposed of by the patient or the patient’s spouse in the period of twelve months immediately preceding the treatment in respect of which the patient owes fees, is less than the levels prescribed from time to time by the Director of Health Services after having consulted the Director of Social Services, the Director of Health Services may exercise his power of waiver under section 8. (4) The person conducting the assessment shall have been shown, by or on behalf of the patient, the originals, or copies certified by an attorney-at-law or a justice of the peace to be true copies, of any documents in respect of which the patient is claiming a deduction from his disposable income under assessment together with the birth certificates of any children in respect of which an allowance is claimed, before any such deduction or allowance may be made. (5) If the assessment of the value of the capital assets of the patient or the patient’s spouse, whether or not held jointly with any other person, reveals either real or personal property capable of being charged, and the effect of such charge would be the realisation of a sum of at least ten thousand dollars that would be available for the payment of the fees owed by the patient, the Director of Health Services shall not waive the patient’s fees under section 8 until the patient or his spouse, together with any other joint owner of the property — Page 6 Revised as at 13th day of May, 2008 c Health Services (Fees and Charges) Regulations Regulation 4 (a) has executed a charge in favour of the Government in a form to be approved by the Attorney-General; and (b) in the case of real property, has caused the charge to be registered in favour of the chargee and filed in accordance with section 64(3) of the Registered Land Law (2004 Revision); or (c) in the case of personal property, has delivered the charge to the chargee. (6) In this regulation — “disposable income” means total income, whether regular or irregular, and includes, but is not limited to, wages, salary, profits from trade or business, interest from loans made, rents from real or personal property and dividends from shares or other securities, after making deductions in respect of — (a) payments due under a written and duly stamped agreement, contract or other document, whether or not under seal; (b) payments made under an order of any court, whether within or outside the Islands; or (c) allowances in accordance with a scale prescribed from time to time jointly by the Director of Health Services and the Director of Social Service in respect of — (i) the maintenance of the patient’s children; and (ii) the patient’s only or main dwelling. 4. Failed appointments 4. (1) A patient who fails to keep an appointment for treatment or consultation at a health care facility without giving at least twenty-four hours’ notice of his inability to attend at the time and place for which the appointment has been made, whether or not he is entitled under the Law to an exemption from, or a reduction in, the fees payable under the Law or these regulations, shall pay an administrative charge of thirty-eight dollars.
