Page 3 CAYMAN ISLANDS OFFICIAL GAZETTE LAW (1997 Revision) 1. Short title 1. This Law may be cited as the Official Gazette Law (1997 Revision). 2. Definition 2. In this Law — “Governor” means the Governor in Council. 3. Establishment of the Gazette 3. There is established a publication called the Cayman Gazette, hereinafter called “the Gazette’’. 4. Application to other laws 4. Every reference in any law to the Gazette, the Official Gazette, the Cayman Gazette or similar title is a reference to the Gazette established under section 3. 5. Publication 5. The Gazette shall be printed and circulated by order of and, insofar as specific directions are not provided by this Law, under the direction of the Governor. 6. Form of the Gazette 6. The Gazette shall be published fortnightly on alternate Mondays, and upon such other occasions as may be ordered by the Governor, and shall contain inter alia — Section 7 Official Gazette Law (a) the title and the date of publication; (b) a list of official Gazette supplements published concurrently therewith under section 7; (c) such official advertisements and notices as are required or authorised by any law to be published in the Gazette or as Government or Public Notices; (d) such advertisements and notices by private members of the public as may be authorised generally or specifically or by the Governor by regulation or otherwise; and (e) any other matter directed by the Governor to be published in the Gazette. 7. Supplements 7. There shall be published contemporaneously with each Gazette in supplementary form — (a) all Bills to be presented to the Legislature; (b) all enactments of the Legislature; (c) all Statutory Rules and Orders; and (d) such regulations, rules and other supplementary matters as may be required or authorised by the Governor to be published. 8. Effect of publication 8. A printed copy of a Gazette or of a Gazette supplement purporting to be issued under the authority of this Law shall be received as prima facie evidence of its contents and of its authenticity both with judicature and thereout. 9. Circulation 9. The Gazette shall be offered for sale to the public at such price per copy and at such places and times as the Governor may, by regulation, direct. 10. Protection of the word “Gazette” 10. Whoever uses the word “Gazette” in association with the word “Cayman” in any publication otherwise than by way of bona fide reference to the Gazette established by section 3 is guilty of an offence. 11. Offences 11. Whoever — (a) procures or attempt to procure the publication of any unauthorised matter in the Gazette; (b) wilfully causes to be published in the Gazette any false or inaccurate matter; or (c) contravenes any rule, order or regulation made under this Law, Page 6 Revised as at 9th day of September, 1997. c Official Gazette Law Section 12 is guilty of an offence. 12. Regulations 12. The Governor may make rules, regulations and orders prescribing — (a) for the printing, production and circulation of the Gazette; (b) scales of fees to be charged for publication of items in the Gazette; and (c) anything permitted or required to be prescribed by this Law. 13. General penalty 13. Any person who contravenes this Law or any rule, regulation or order made thereunder is guilty of an offence and liable on summary conviction to a fine of five hundred dollars and to imprisonment for six months. 14. Savings 14. Every publication made prior to the 1st January, 1975 purporting to be a publication of matter which would have been required or authorised to be published in the Gazette if this Law had been enacted before the date of such publication shall, for the purposes of this Law, be deemed to be a publication in the Gazette.
