Citation 1. These Regulations may be cited as the Airport Regulations (1995 Revision). 2. Definitions 2. In these Regulations, unless the context otherwise requires — “airport” includes Owen Roberts Airport, George Town, Grand Cayman and the Gerrard-Smith Airport, Cayman Brac; “authorised officer”, in relation to any of the powers of an authorised officer under these Regulations, means a person authorised in writing by the Governor in Council to exercise such power; and “traffic sign” includes any speed limit, sign, mark on the surface of the roadway, signal (whether an automatic electric signal or otherwise), warning sign post, direction post and sign or other device for the guidance or direction of person using the roadways in an airport, which the Governor in Council causes or permits to be placed on or near any such roadway. 3. Prohibited acts 3. Within an airport the following acts are prohibited — (a) obstructing or interfering with the proper use of the airport; c Revised as at 28th day of March, 1995 Page 5 Regulation 3 Airport Regulations (b) obstructing any person acting in the execution of his duty in relation to the airport; (c) remaining on the airport after having been required by a constable or an authorised officer to leave it; (d) allowing any vehicle or animal to be on the airport after being required by an authorised officer to remove it or after its presence on the airport has been forbidden by an authorised officer or on his directions; (e) boarding or attempting to board any aircraft without the authority of the person in charge of it; (f) tampering or interfering with any aircraft or anything used in connection with an aircraft; (g) smoking in or otherwise bringing or lighting any naked light into or in — (i) any place where any such act is prohibited by notice; or (ii) any place within fifty feet of an aircraft or a store of liquid fuel or explosives; (h) any act causing or tending to cause an outbreak of fire; (i) throwing, leaving or dropping anything capable of causing injury to any person or property; (j) climbing any wall, fence, barrier, railing or post; (k) wilfully giving a false fire or ambulance alarm; (l) failure to place an aircraft in the place and position appointed by an airport official for that purpose; (m) failure to moor or otherwise secure any stationary aircraft which is not in a hangar; (n) failure to comply with the rules contained in the First Schedule; (o) driving or placing a vehicle carelessly or dangerously or without consideration for persons using the airport; (p) failure by the driver of a vehicle to stop when required by a constable or authorised officer to do so; (q) failure by the driver of a vehicle which is involved in an accident to give his name and address and the name and address of the owner of the vehicle to any person having reasonable ground for requiring them; (r) failure by the driver of a vehicle forthwith to report to a constable or to the person in charge of the airport any accident in which the vehicle is involved; (s) failure by the driver of a vehicle to comply with any direction for the regulation of traffic given by a constable, an authorised officer or a traffic sign; Page 6 Revised as at 28th day of March, 1995 c Airport Regulations Regulation 4 (t) parking a vehicle in a manner other than the manner required by an authorised officer; (u) failure by the person in charge of a vehicle to remove it from any parking place when required by a constable or an authorised officer to do so; (v) loading or unloading from a vehicle, passengers or goods elsewhere than in a place provided for that purpose; (w) driving a motor vehicle on any roadway in an airport at a speed greater than thirty miles per hour or such other speed as may be prescribed by a traffic sign; (x) removing, picking or otherwise damaging any tree, shrub or plant or walking on any flower bed; (y) failure to keep any animal under control; (z) using any obscene or indecent language; (aa) indecent or disorderly behaviour; (bb) dropping or leaving litter except in a receptacle provided for that purpose; (cc) failure to comply with directions given by the Director in relation to refuelling of aircraft; (dd) disposing of garbage, sewage, waste oil, refuse or other material from aircraft or other sources except in the place and the receptacles provided for that purpose; or (ee) selling or distributing any literature calculated to excite racial or political unrest or hatred. 4. Acts prohibited without permission 4. Within an airport the following acts are prohibited unless the permission of an authorised officer has been obtained — (a) entering or leaving the airport otherwise than through a gate or entrance for the time being provided for that purpose; (b) entering any part of the airport to which members of the public are not for the time being admitted; (c) removing, displacing, damaging, defacing or altering any building, structure or other property, whether movable or immovable (including any notice), forming part of, provided for or in connection with the airport; (d) digging soil or cutting or removing turf; (e) grazing animals; (f) selling or distributing anything, offering anything for sale or hire or making any offer of services including specifically the offering of taxi- c Revised as at 28th day of March, 1995 Page 7 Regulation 5 Airport Regulations cab services or operating any hackney carriage or other vehicle carrying passengers for hire or reward; (g) exhibiting any notice or advertisement except on premises which the person exhibiting it is authorised to occupy and in accordance with the terms of his occupation; (h) leaving a vehicle at an airport during the hours when the airport is closed and all passengers have departed; but in any event not longer than twenty four hours; (i) driving a vehicle elsewhere than in a place provided for the passage or accommodation of such vehicle; (j) taking a motor vehicle into a hangar used for the maintenance or storage of aircraft; (k) running an aircraft engine in a hangar; (l) filing or discharging from any container (including any part of a vehicle) liquid fuel elsewhere than in a place approved for that purpose by the person in charge of the airport; (m) lighting a fire elsewhere than in a place constructed for that purpose and approved by an authorised officer; (n) conducting flight or ground demonstrations; (o) taking still, motion or sound pictures for commercial purposes; or (p) delivering or doing anything whatsoever in order to make available to any person the use of a rent-a-car as defined in the Traffic Law (Revised). 5. Parking fees 5. (1) No person shall — (a) park a vehicle at an airport elsewhere than in a place provided for that purpose; or (b) depart from such parking area without payment of the prescribed parking fee to the Director or a person authorised by him. (2) The following fees are prescribed for the parking of a vehicle at an airport — not exceeding one hour $1.00 overnight $5.00 per week $25.00 per month $75.00 Page 8 Revised as at 28th day of March, 1995 c Airport Regulations Regulation 6 (3) The Director may, in his discretion, waive the prescribed parking fee in whole or in part, whether prospectively or retrospectively, in respect of any person or class of person. 6. Ticket offences 6. When an offence appears to him to have been committed contrary to paragraph (n), (o), (p), (q),(r),(s), (t), (u), (v) or (w) of regulation 3 or paragraph (h) of regulation 4, an authorised officer or a constable in uniform may serve upon the alleged offender a ticket in the form prescribed in the Second Schedule and, if the offender desires to plead guilty to the offence alleged, he may produce such ticket to the Clerk of the Court at the place, and, on or before the date and time therein prescribed (not being more than fourteen days from the service thereof), pay the prescribed fine into court; but if the alleged offender desires to plead not guilty to the offence alleged or to request the court to mitigate the prescribed fine, the ticket shall operate as a summons to him to appear before the court at the date and time therein prescribed so that, in default of payment of the prescribed fine or so making appearance before the court, he shall be liable to be arrested and brought before the court and there charged with the offence alleged. 7. Taking and towing of vehicles 7. (1) Where it appears to a constable or an authorised officer that a vehicle — (a) has been abandoned, involved in an accident or parked in an unlawful or unsafe manner; or (b) has been parked at an airport without there being a current parking fee in respect thereof, he may take charge of such vehicle and drive or tow it or cause it to be driven or towed to a place under police supervision authorised by the Commissioner of Police to be used as a vehicle pound or to any other place considered by the Commissioner to be appropriate, or such constable or authorised officer may cause such vehicle to be immobilised by means of a mechanical wheel locking device. (2) The Director shall, as soon as practicable, give notice to the owner or person last having control of a vehicle driven, towed away or immobilised under sub- regulation (1) that it has been so driven, towed away or immobilised and require him, if appropriate, to remove such vehicle. (3) The owner or person referred to in sub-regulation (2) shall, in respect of a vehicle detained or immobilised under sub-regulation (1), pay to the Director a fee of ten dollars in respect of every day or part thereof that such vehicle remains so detained or immobilised. c Revised as at 28th day of March, 1995 Page 9 Regulation 8 Airport Regulations (4) The owner or person last having control of a vehicle driven or towed away under sub-regulation (1) shall pay to the Director a fee of forty dollars in respect of such driving or towing away. (5) No action shall lie against the Government, the Director or any constable or authorised officer for damages in any civil court in respect of damage to any vehicle or any loss or damage to any property from or in such vehicle caused as a result of any act bona fide done pursuant to this regulation involving that vehicle. 8. Offences 8. Any person who — (a) does any act prohibited by regulation 3; (b) without the permission of an authorised officer, does any act prohibited by regulation 4; or (c) fails to pay a fee prescribed by regulation 5 or 6, is guilty of an offence and liable on summary conviction to a fine of fifty dollars or to imprisonment for three months. Page 10 Revised as at 28th day of March, 1995 c Airport Regulations FIRST SCHEDULE FIRST SCHEDULE Regulation 3(n) Motor Vehicle Rules 1. (1) The drivers of motor vehicles shall observe the following rules — Motor vehicles — (a) meeting or being overtaken by other traffic shall be kept to the near side of the road, and overtaking other traffic shall be kept on the right or offside of such other traffic: Provided that an animal being led or driven may be passed or overtaken on whichever side is the safer; (b) being overtaken by other traffic shall be driven so as to allow such other traffic to pass; (c) shall not be driven alongside of, or overlapping or so as to overtake other traffic proceeding in the same direction if by so doing it obstructs any traffic proceeding in the opposite direction; (d) shall not be driven so as to cross, commence to cross or to be turned in a road if by so doing it obstructs any traffic; (e) proceeding from one road to another shall not be driven so as to obstruct any traffic on the road; (f) proceeding from a place which is not a road into a road or from a road into a place which is not a road, shall not be driven so as to obstruct any traffic on the road; (g) shall not be driven so as to overtake other traffic unless the driver has a clear and unobstructed view of the road ahead; and (h) shall not be permitted to travel backwards further than may be necessary for turning or other reasonable purposes. (2) Notwithstanding anything contained in this Schedule, it is the duty of drivers of motor vehicles to take such action as may be necessary to avoid an accident, and the breach by a driver of any motor vehicle of any of the provisions of this Schedule shall not exonerate the driver of any other motor vehicle from the duty imposed on him by this paragraph. (3) In this Schedule — (a) a motor vehicle obstructs other traffic if it causes risk or accident thereto; (b) “traffic” includes bicycles, vehicles of every description, processions, bodies of troops and all animals being ridden, driven or led; and c Revised as at 28th day of March, 1995 Page 11 FIRST SCHEDULE Airport Regulations (c) “overtaking” includes passing or intending to pass any other vehicle proceeding in the same direction. 2. (1) The driver of a motor vehicle constructed to be steered on the right or off-side thereof, shall, before commencing to turn or change direction towards the right, extend his right arm and hand horizontally straight out from the right or offside of the motor vehicle, with the palm turned to the front so as to be visible to drivers of all vehicles concerned. (2) The driver of such a motor vehicle may also, if he thinks fit — (a) in order to signal an overtaking car not to attempt to pass extend his right arm and hand horizontally straight out from the right or off-side of the motor vehicle, with the palm turned downwards and move the arm up and down; (b) in order to signal an overtaking car to pass, extend his right arm and hand below the line of the shoulder from the right or off-side of the motor vehicle, with the palm turned to the front and move the arm backwards and forwards. (3) When approaching a constable on duty at a road junction, the driver of a motor vehicle shall extend his arm in the direction in which he wishes to proceed so as to be visible to the constable. (4) Any signal prescribed or permitted by this Schedule may be given by any mechanical or illuminated device of an approved type.
