Refusal to register......................................................................................................................6 c SL 74 of 2016 Page 3 Nursing Regulations, 2016 Regulation 1 CAYMAN ISLANDS Health Practice Law NURSING REGULATIONS, 2016 (SL 74 of 2016) In exercise of the powers conferred by sections 28, 33 and 42 of the Health Practice Law (2013 Revision) the Cabinet, after consultation with the Nursing and Midwifery Council, makes the following Regulations — 1. Citation 1. These Regulations may be cited as the Nursing Regulations, 2016. 2. Definitions 2. In these Regulations — “approved nursing programme” means a programme designated by the Council under regulation 3(3); “Council” means the Nursing and Midwifery Council established under section 21 of the Law; “nurse” means a person whose name appears in that part of the register allocated for persons qualified to practice one or more of the professions of nursing listed in Schedule 5 of the Law; and “register” means the register of nurses and midwives kept by the Council. 3. Qualifications for registration as a nurse 3. (1) A person is qualified for registration as a nurse if the person — (a) obtains a degree in nursing on completion of an approved nursing programme; and c SL 74 of 2016 Page 5 Regulation 4 Nursing Regulations, 2016 (b) passes an examination for registration as a nurse, approved by the Council. (2) A person other than a person referred to in paragraph (1) is qualified for registration as a nurse if that person meets the eligibility requirements for full registration, institutional registration or provisional registration set out in Regulations 5, 5A and 6 of the Health Practice Regulations (2013 Revision). (3) The Council may designate an educational programme offered in the Islands that leads to a degree in nursing as an approved nursing programme and shall, immediately after such designation, publish a notice of the designation in the Gazette. 4. Application to be registered as a nurse 4. (1) A person who is enrolled as a student in an approved nursing programme or who is qualified for registration as a nurse under regulation 3 may apply to the Council in accordance with the Health Practice Regulations (2013 Revision) to have their name, address and other particulars entered in the register. (2) Subject to paragraph (3), the application shall include the documentation and information required by the Council under regulation 4 of the Health Practice Regulations (2013 Revision) and shall be accompanied by the registration fee. (3) Notwithstanding regulation 4(1)(c) of the Health Practice Regulations (2013 Revision), an application under this regulation by a student enrolled in, or a recent graduate of, an approved nursing programme need not include an original or certified letter of good standing from a current board of registration. 5. Registration 5. (1) The Registrar shall enter in the appropriate division of the register the name, address and other particulars of — (a) a person registered as a student in an approved nursing programme; and (b) a person accepted for registration as a nurse. (2) The Council may approve the use, by a person whose application for registration as a nurse is accepted, of particular letters or symbols indicating the person’s registration in one or more of the professions of nursing listed in Schedule 5 of the Law. 6. Refusal to register 6. Where the Council declines to register an applicant in the profession of nursing specified in the application, the Council shall forthwith provide the applicant with written reasons for its decision.
