Reporting an arrangement of convenience ................................................................................6 SCHEDULE 7 c SL 17 of 2026 Page 3 Caymanian Protection (Arrangements of Convenience) Regulations, 2026 Regulation 1 CAYMAN ISLANDS Caymanian Protection Act (2022 Revision) CAYMANIAN PROTECTION (ARRANGEMENTS OF CONVENIENCE) REGULATIONS, 2026 (SL 17 of 2026) In exercise of the powers conferred by sections 70 and 72 of the Caymanian Protection Act (2022 Revision), the Cabinet makes the following Regulations — 1. Citation and commencement 1. (1) These Regulations may be cited as the Caymanian Protection (Arrangements of Convenience) Regulations, 2026. (2) These Regulations come into force immediately after the commencement of the Immigration (Transition) (Amendment and Validation) Act, 2025. 2. Definitions 2. In these Regulations — “arrangement of convenience” means a marriage of convenience or a civil partnership of convenience; and “Official” means — (a) in the case of a marriage, a Marriage Officer; and (b) in the case of a civil partnership, the Registrar, a Civil Registrar or a civil partnership officer. c SL 17 of 2026 Page 5 Caymanian Protection (Arrangements of Convenience) Regulations, Regulation 3 2026 3. Duty of Officials 3. For the purpose of determining, under section 70 of the Act, whether to make a report of suspicion that a marriage or civil partnership will be, or is, a marriage of convenience or a civil partnership of convenience, an Official shall, before, during or immediately after solemnisation of the marriage or formalisation of the civil partnership, ask the parties to the marriage or civil partnership to provide the following information — (a) their full names; (b) any previous names by which they were known; (c) their respective dates of birth; (d) details of their previous marriages or civil partnerships (if any); (e) their residential addresses; (f) the nationality of each party; (g) the occupation of each party; (h) the immigration status of each party; (i) the time, date and place of their intended marriage or civil partnership or of their solemnised marriage or formalised civil partnership; and (j) the contact details provided by each party (e.g. telephone numbers, email addresses). 4. Reporting an arrangement of convenience 4. For the purposes of section 70 of the Act, reports of suspicion relating to an arrangement of convenience — (a) shall be made once the suspicion is formed by the Official; (b) shall be made in the form set out in the Schedule; (c) shall contain all of the information required in the form set out in the Schedule, to the extent that it has been provided to the Official; and (d) shall be made by the most expedient method of written communication available to the Official, which may include a method of electronic communication. If the parties to the intended marriage or civil partnership or the solemnised marriage or formalised civil partnership, as the case may be, have declined to provide the information, or appear to have unreasonably failed to provide supporting documentary evidence on request, this should be made clear in the form.
