Offence of presenting a false vaccination certificate or false information ....................................7 c SL 57 of 2021 Page 3 Prevention, Control and Suppression of Covid-19 (CayMAS Parade) Regulations, 2021 Regulation 1 CAYMAN ISLANDS Public Health Act (2021 Revision) PREVENTION, CONTROL AND SUPPRESSION OF COVID-19 (CAYMAS PARADE) REGULATIONS, 2021 (SL 57 of 2021) In exercise of the powers conferred by section 34 of the Public Health Act (2021 Revision), the Cabinet makes the following Regulations — 1. Citation 1. These Regulations may be cited as the Prevention, Control and Suppression of Covid- 19 (CayMAS Parade) Regulations, 2021. 2. Definitions 2. (1) In these Regulations — “approved vaccine course” means a vaccination programme which is — (a) approved by the Chief Medical Officer for use against the virus; and (b) administered by the Health Services Authority; “contact” means — (a) the state or condition of physical touching; or (b) being closer than six feet to a person for more than five minutes; “parade” means the CayMAS parade; and c SL 57 of 2021 Page 5 Prevention, Control and Suppression of Covid-19 (CayMAS Parade) Regulation 3 Regulations, 2021 “participant” means a person who is permitted to participate in the parade pursuant to the verification process referred to in regulation 5(1). (2) For the purposes of the definition of the word “participant”, the word “person” includes a person who is employed or who volunteers to provide the activity being engaged in. 3. Permission to hold parade 3. In accordance with regulation 4 of the Prevention, Control and Suppression of Covid- 19 (No.2) Regulations, 2021, the Cabinet permits the holding of the parade on 7th August, 2021. 4. Restrictions on the number of participants in the parade 4. (1) The organiser of the parade shall ensure that there are no more than one thousand participants in the parade. (2) An organiser who contravenes paragraph (1) commits an offence and is liable on summary conviction to a fine of ten thousand dollars and to imprisonment for two years. 5. Restrictions on participating in parade 5. (1) The organiser of the parade shall only permit a person to participate in the parade where the person is verified by — (a) the Medical Officer of Health; or (b) a person designated by the Medical Officer of Health, as having completed an approved vaccine course at least fourteen days prior to the date of the parade under regulation 3. (2) No person other than a participant shall — (a) participate in the parade; (b) come into contact with a participant; or (c) handle an item which has been handled by a participant. (3) A person shall not cause or permit a person other than a participant to — (a) participate in the parade; (b) come into contact with a participant; or (c) handle an item which has been handled by a participant. (4) An organiser who contravenes paragraph (1) or a person who contravenes paragraph (2) or (3) commits an offence and is liable on summary conviction to a fine of ten thousand dollars and to imprisonment for two years. (5) It is a defence for a person charged with an offence under paragraph (2)(c) or (3)(c) to prove that the person did not know, or could not reasonably have known, that the item had been handled by a participant. Page 6 SL 57 of 2021 c Prevention, Control and Suppression of Covid-19 (CayMAS Parade) Regulations, 2021 Regulation 6 (6) This regulation does not apply to — (a) a police officer; (b) the Medical Officer of Health or persons designated by the Medical Officer of Health; and (c) a person who is required to enter the parade to prevent or mitigate risk of injury to persons or property or risk of death. 6. Offence of presenting a false vaccination certificate or false information 6. (1) A person who wishes to be a participant in the parade shall provide to the organiser, for verification by — (a) the Medical Officer of Health; or (b) a person designated by the Medical Officer of Health, proof of having completed an approved vaccine course at least fourteen days prior to the date of the parade under regulation 3. (2) A person who, in purported compliance with paragraph (1), presents a false or forged vaccination certificate or otherwise provides false information, commits an offence and is liable on summary conviction to a fine of ten thousand dollars and to imprisonment for two years.
