Short title 1. This Law may be cited as the National Heroes Law (1998 Revision). 2. Definition 2. In this Law — “Governor”, except in section 5, means the Governor in Council. 3. Declaration of National Heroes 3. (1) The Governor may, by Proclamation published in the Gazette, declare a man or a woman he considers to have provided exceptional and outstanding service to the Islands and the peoples of the Islands to be a National Hero. (2) A man or woman may be proclaimed a National Hero at any time during his or her life or at any time after his or her death. 4. Tokens of recognition 4. Notwithstanding any other law, the Governor may — (a) with money made available for the purpose by the Legislative Assembly, purchase, or in the case of Crown land, reserve any land and construct on it a park, garden or place of peace or recreation dedicated as a token of recognition to a National Hero or to National Heroes and may, in c Revised as at 16th day of June , 1998 Page 5 Section 5 National Heroes Law accordance with a resolution of the Legislative Assembly, name the park, garden or place of peace or recreation accordingly; (b) provide for the subscription to, and the production and erection of, any monument, statue, plaque, memorial or other token of recognition of any National Hero; (c) specify, by order published in the Gazette, any day or other period as a day or period for the recognition of a National Hero or National Heroes; (d) name or rename any public building, structure or other Crown property, or any place, locality or physical or geographical feature, in recognition of a National Hero; and (e) take such other action as the Governor considers appropriate to recognise National Heroes and their services to the Islands and the peoples of the Islands. 5. Governor to bestow award 5. The Governor may, in person, honour a National Hero or the memory of a National Hero at a public ceremony where the Governor shall bestow upon the National Hero or a person appearing on behalf of the National Hero an award or other recognition of the National Hero’s service to the Islands and the peoples of the Islands. 6. Revocation of declaration 6. (1) The Governor may, for good reason, revoke, by Proclamation published in the Gazette, the declaration of a person as a National Hero. (2) Where a Proclamation is made under subsection (1) the Governor may take such other action as is appropriate in the circumstances to withdraw the recognition of the person as a National Hero. 7. Offences 7. (1) Whoever accepts, obtains or agrees to accept or attempts to obtain from any person, for himself or for any other person or for any purpose any gift, money or valuable consideration as an inducement or reward for procuring or assisting or endeavouring to procure the grant of an honour under this Law is guilty of an offence and liable on conviction to a fine of five thousand dollars. (2) Whoever gives, agrees or proposes to give or offers to any person any gift, money or valuable consideration as an inducement or reward for procuring or assisting or endeavouring to procure the grant of an honour under this Law to any person is guilty of an offence and liable on conviction to a fine of five thousand dollars. (3) Whoever carries on or attempts to carry on business on or from the Island and in the course of his or her activities in connection with that business takes any action or does anything that is likely to suggest, falsely, the patronage of or Page 6 Revised as at 16th day of June , 1998 c National Heroes Law Section 7 connection with a National Hero or that the business has a special status in relation to or derived from a National Hero is guilty of an offence and liable on conviction to a fine of five thousand dollars. (4) Nothing in subsections (1) and (2) prohibits the Governor from seeking nominations of people to be declared National Heroes or people from making nominations or recommendations to the Governor in respect of people to be declared National Heroes.
