Citation 1. These regulations may be cited as the Public Health (Quarantine) Regulations (1997 Revision). 2. Definitions 2. In these regulations — “Governor” means the Governor in Council; “infected place” means any port or place where an epidemic disease of a contagious or infectious character prevails or any port or place prescribed as such by the Governor; “jurisdiction” means the jurisdiction of the Islands and includes the territorial waters and the airspace thereover; “master” means the person having control or command of a vessel; “officer” means a quarantine officer as defined in regulation 3; “port” includes an airport and a seaport; “pratique” means licence to a vessel to communicate with the shore; c Revised as at 9th day of December , 1997 Page 5 Regulation 3 Public Health (Quarantine) Regulations “quarantine” means a state of isolation imposed upon any vessel or person under the Law for prevention of the spread of any contagious or infectious disease; and “vessel” means any description of sea or air craft including a hovercraft coming into the jurisdiction directly or indirectly from any port or place outside the jurisdiction or from another island of the Islands. 3. Quarantine officers 3. The following are quarantine officers — (a) the Director of Civil Aviation; (b) government medical officers; (c) government veterinary officers; (d) customs officers; and (e)* persons appointed by the Governor to hold office during his pleasure.[*See Note 1 on page 11] 4. Infected places 4.* The Governor may, at any time, declare any port or place to be an infected place. [*See Note 2 on page 11] 5. Liability to quarantine 5. Vessels arriving at the Islands together with all persons and cargo thereon coming from an infected place or having on board any person who has come from an infected place or who is ill of any contagious or infectious disease or on board of which vessel any person has died from any such disease during the passage to the Islands is liable to quarantine as hereinafter provided. 6. Duty of masters 6. Vessels arriving in territorial waters shall, before having any physical contact with the shore, supply by radio or other means to the officer on duty at the nearest port the — (a) name of the vessel; (b) name of the master; (c) port of registry; (d) last port of call; (e) next destination; (f) jurisdictions entered since the last port of call; (g) number of persons aboard; (h) particulars of persons — Page 6 Revised as at 9th day of December , 1997 c Public Health (Quarantine) Regulations Regulation 7 (i) suffering from any disease; (ii) who have so suffered during the voyage; or (iii) who have died during the voyage; (i) particulars of persons aboard who, within fourteen days, have been located in an infected place; and (j) any further information required by the officer on duty. 7. Grant of pratique 7. The officer on duty at a port to which the information required by regulation 6 has been communicated by a vessel may grant pratique to such vessel by radio signal or otherwise and until such pratique has been so granted such vessel is and remains in quarantine from the time of her arrival in the territorial waters. 8. Health declaration 8. The master of every vessel arriving in a seaport in the Islands shall complete and produce to the officer on duty the declaration set out in the Schedule. 9. Effect of quarantine 9. In the case of a vessel in quarantine — (a) the officer on duty may go aboard, inspect the ship’s log and ship’s papers and make such investigation as he considers necessary; (b) no person shall leave or board the vessel without the permission of the officer on duty; (c) the master shall hoist by day and by night whichever of the Quarantine Signals is appropriate as set out in the British Edition of the 1931 International Code Visual Signalling; and (d) the master shall anchor the vessel at the direction of the officer on duty. 10. Delivery of mails 10. Nothing in these Regulations prevents the delivery of mail from a vessel in quarantine. 11. Governor’s power of suspension 11. The Governor may suspend the operation of these regulations or any part thereof for such period as he may think fit. 12. Penal 12. Whoever — (a) contravenes any requirement of these regulations; c Revised as at 9th day of December , 1997 Page 7 Regulation 12 Public Health (Quarantine) Regulations (b) gives information in the truth of which he does not believe for the purpose of evading any provision of these regulations; (c) obstructs any officer in executing his duty under these regulations; or (d) personates an officer, is guilty of an offence and punishable under section 8. Give particulars in the Schedule hereto. c Revised as at 9th day of December , 1997 Page 9 SCHEDULE Public Health (Quarantine) Regulations NOTE: In the absence of a surgeon, the master should regard the following symptoms as ground for suspecting the existence of disease of an infectious nature: fever accompanied by prostration or persisting for several days, or attended with glandular swelling; or any acute skin rash or eruption with or without fever, severe diarrhoea with symptoms of collapse, jaundice accompanied by fever. 6. In exercise of the powers conferred by regulation 3(e), by notice made the 21st November, 1978 and published in Gazette No. 25 of 4th December, 1978, the Port Director was appointed a Quarantine Officer. 2. In exercise of the powers conferred by regulation 4, by Order made the 3rd November, 1981 and published in Gazette No. 23 of 16th November, 1981, Honduras was declared and prescribed to be an infected place for the purposes of the regulations.
