Recovery of debt .......................................................................................................................6 c SL 14 of 2008 Page 3 Airports Authority (Charges) Regulations, 2008 Regulation 1 CAYMAN ISLANDS Airports Authority Law (2005 Revision) AIRPORTS AUTHORITY (CHARGES) REGULATIONS, 2008 (SL 14 of 2008) In exercise of the powers conferred by section 41 of the Airports Authority Law (2005 Revision), the Cayman Islands Airports Authority, with the approval of the Governor in Cabinet, makes the following regulations — 1. Citation and commencement 1. (1) These regulations may be cited as the Airports Authority (Charges) Regulations, 2008. (2) These regulations shall come into force on 1 January, 2009. 2. Definitions 2. In these regulations — “carrier” means a person having a proprietorial interest in an aircraft; “outward bound aircraft” means an aircraft about to journey from the Islands to a jurisdiction thereout; and “traveller” means any person not under the age of two years, other than a member of the crew of an aircraft carried thereon for the exclusive purpose of taking part in the management of its service. c SL 14 of 2008 Page 5 Regulation 3 Airports Authority (Charges) Regulations, 2008 3. Passenger facilities charge 3. (1) Each carrier shall, within ten days after the last day of the month in respect of which such passenger facilities charge falls due, pay to the Authority the sum of thirteen dollars in respect of a passenger facilities charge for each traveller in an outward bound aircraft. (2) The journey of a traveller whose agreement for carriage is evidenced by a ticket ends for the purposes of this regulation at his final place of destination. 4. Penalty 4. A carrier who is in contravention of regulation 3 is liable to pay to the Authority a sum equal to five times the passenger facilities charge not collected, which amount shall be assessed by the Authority whose decision shall be final. 5. Offence 5. A carrier who fails to pay the Authority any amount assessed under regulation 4 commits an offence and is liable on summary conviction to a fine of five thousand dollars and to imprisonment for six months, and also the court so convicting shall order payment of the amount assessed as part of the said penalty imposable. 6. Recovery of debt 6. Any passenger facilities charge due under regulation 5 is recoverable by the Authority as a civil debt. Made the 4th day of July, 2008.
