About this statute
This preamble identifies a 27 June 1953 Luxembourg law on the fiscal conditions for domestic companies increasing capital by incorporating reserves or profits in 1953. Certain domestic companies that increase capital in 1953 by incorporating reserves or profits must bear a withholding tax, and the tax rate is 4% or 8% depending on the source of the incorporation. A capital increase covered by Article 1 is treated as not being a distribution of income for the associates, and the related withholding tax is not to be deducted from the associates’ assessed income tax during the capital increase. If a company repays capital contributions after the capital increase and before liquidation, the repayment is treated like a dividend up to the amount covered by the capital increase subject to withholding tax. The law does not apply in several listed cases, including certain holding companies and some capital increases or capital repayments.
