About this statute

This is the preamble to the law creating a société de gestion de patrimoine familial (SPF) in Luxembourg. This article defines when a company is treated as a family wealth management company (SPF) under the law. “Actifs financiers” includes specified financial instruments and cash or account-held assets. A SPF may hold a participation in a company only if it does not interfere in that company’s management. An eligible investor must declare that status in writing to the domiciliary, or otherwise to the SPF’s managers. Securities issued by an SPF may not be publicly offered or listed on a stock exchange. The SPF is exempt from income tax, municipal business tax, and net wealth tax, but this exemption is excluded for the current year if the SPF received at least 5% of total dividends from certain non-resident, non-listed companies.
