About this statute

This preamble introduces a Grand-Ducal regulation on the use of nominative medical data in computer-based processing. Le règlement s’applique aux banques de données nominatives médicales automatisées détenues par des instances médicales, aux organismes de sécurité sociale, et aux administrations et services publics qui gèrent des données médicales dans le cadre de leurs attributions. Creating or operating nominative databases containing medical data is subject to articles 4 to 11 of the law of 31 March 1979. Connecting a nominative database containing medical data with any other nominative database requires prior authorization. An application for authorization to create and operate a nominative database containing medical data must include the retention period and the security/protection measures in place.
