Juruukur Tanah Berlesen (Pindaan) 3 UNDANG-UNDANG MALAYSIA Akta A1730 AKTA JURUUKUR TANAH BERLESEN (PINDAAN) 2024 Suatu Akta untuk meminda Akta Juruukur Tanah Berlesen 1958. [ ] DIPERBUAT oleh Parlimen Malaysia seperti yang berikut: Tajuk ringkas 1. Akta ini bolehlah dinamakan Akta Juruukur Tanah Berlesen (Pindaan) 2024. Seksyen baharu 1a 2. Akta Juruukur Tanah Berlesen 1958 [Akta 458], yang disebut “Akta ibu” dalam Akta ini, dipinda dengan memasukkan selepas seksyen 1 seksyen yang berikut: “Application 1a. This Act shall apply to Peninsular Malaysia and the Federal Territory of Labuan.”. 4 Undang-Undang Malaysia AktA A1730 Pindaan seksyen 2 3. Seksyen 2 Akta ibu dipinda— (a) dengan memasukkan selepas takrif “boundary mark” takrif yang berikut: ‘ “Director General of Survey and Mapping” means the officer performing the duties of the head of the Survey and Mapping Department Malaysia; “Director of Survey and Mapping” means the officer performing the duties of the head of the Survey and Mapping Department Malaysia at a state; “geomatics survey” means any survey undertaken for the purposes of production of or in connection with, maps, geomatics survey plans or information using survey-accurate techniques; “geomatics survey plan” means a plan signed by a licensed land surveyor recording and depicting the work carried out by him on a geomatics survey, or a plan signed by an officer authorized by the Director General of Survey and Mapping to do so recording the work of a Government surveyor on a geomatics survey;’; (b) dengan memotong takrif “Director General of Survey”; (c) dengan menggantikan takrif “Government surveyor” dengan takrif yang berikut: ‘ “Government surveyor” means any public officer of Malaysia who is authorized by the Director General of Survey and Mapping to undertake any title survey or geomatics survey, and for the purposes of sections 8, 9 and 10 and paragraph 19(a), includes the Director General of Survey and Mapping;’; (d) dalam takrif “Minister”, dengan menggantikan perkataan “lands” dengan perkataan “survey and mapping”; Juruukur Tanah Berlesen (Pindaan) 5 (e) dalam takrif “reciprocating territory”, dengan memotong perkataan “within the Commonwealth”; (f) dalam takrif “Register”, dengan memasukkan selepas perkataan “kept” perkataan “and maintained”; (g) dalam takrif “survey plan”, dengan menggantikan perkataan “an officer authorized by the Director General of Survey to do so and recording the work of a Government Surveyor” dengan perkataan “the Director General of Survey and Mapping, the Director of Survey and Mapping or the Deputy Director of Survey and Mapping recording the work of a Government surveyor on a title survey”; dan (h) dalam takrif “title survey”— (i) dengan menomborkan semula perenggan (a) sebagai perenggan (aa); dan (ii) dengan memasukkan sebelum perenggan (aa) yang dinomborkan semula perenggan yang berikut: “(a) the preparation of a pre-computation plan;”. Pindaan seksyen 4 4. Seksyen 4 Akta ibu dipinda dengan menggantikan subseksyen (1) dengan subseksyen yang berikut: “(1) The Board shall consist of the following persons who are registered under section 9: (a) the Director General of Survey and Mapping; (b) the Deputy Director General of Survey and Mapping; (c) a Director of Survey and Mapping, appointed by the Minister; and (d) three licensed land surveyors who are resident and practising in the States of Peninsular Malaysia or the Federal Territory of Labuan, appointed by the Minister.”. 6 Undang-Undang Malaysia AktA A1730 Pindaan seksyen 5 5. Subseksyen 5(1) Akta ibu dipinda— (a) dengan menggantikan perkataan “Director General of Survey” dengan perkataan “Director General of Survey and Mapping”; dan (b) dengan menggantikan perkataan “Deputy Director General of Survey” dengan perkataan “Deputy Director General of Survey and Mapping”. Pindaan seksyen 9 6. Seksyen 9 Akta ibu dipinda— (a) dalam subperenggan (1)(b)(ii), dengan menggantikan perkataan “the Republic of Singapore” dengan perkataan “the Federal Territory of Labuan”; dan (b) dengan memasukkan selepas subseksyen (2) subseksyen yang berikut: “(3) Any person who is registered under this section shall be entitled to use the abbreviation “LSr” before his name or in any way in association with his name.”. Pindaan seksyen 13 7. Seksyen 13 Akta ibu dipinda— (a) dalam subseksyen (1), dengan memasukkan selepas perkataan “title surveys” perkataan “and geomatics surveys”; (b) dalam subseksyen (2)— (i) dengan menggantikan perkataan “Director General of Survey” dengan perkataan “Director General of Survey and Mapping”; dan (ii) dengan memasukkan selepas perkataan “title survey” perkataan “and geomatics survey”; Juruukur Tanah Berlesen (Pindaan) 7 (c) dalam subseksyen (3), dengan memasukkan selepas perkataan “title surveys” perkataan “and geomatics surveys”; (d) dalam subseksyen (4), dengan memasukkan selepas perkataan “title survey” perkataan “or geomatics survey”; dan (e) dengan menggantikan subseksyen (5) dengan subseksyen yang berikut: “(5) For the purpose of obtaining data for a title survey or geomatics survey, a licensed land surveyor may, at all reasonable times be permitted to inspect relevant maps, plans and records of the Survey and Mapping Department Malaysia and to make copies of such information therefrom as he may require without payment of search fees, but he shall not remove any such maps, plans and records from the custody of the Survey and Mapping Department Malaysia and he will be held pecuniarily liable for any damage which he may cause to them while they are under his control.”. Pindaan seksyen 14 8. Seksyen 14 Akta ibu dipinda— (a) dengan menomborkan semula seksyen sedia ada sebagai subseksyen (1); (b) dalam subseksyen (1) yang dinomborkan semula— (i) dengan menggantikan perkataan “Government Survey Department” dengan perkataan “Survey and Mapping Department Malaysia”; (ii) dengan menggantikan perkataan “field books, calculation sheets and survey data with the Survey Department and all such documents shall” dengan perkataan “survey records and data with the Survey and Mapping Department Malaysia and such survey plan, survey records and data shall”; dan 8 Undang-Undang Malaysia AktA A1730 (iii) dengan menggantikan perkataan “the Director General of Survey or other officer appointed by him to approve the same on his behalf” dengan perkataan “the Director General of Survey and Mapping, the Director of Survey and Mapping or the Deputy Director of Survey and Mapping”; dan (c) dengan memasukkan selepas subseksyen (1) yang dinomborkan semula subseksyen yang berikut: “(2) On completion of a geomatics survey as may be specified by the Director General of Survey and Mapping, the geomatics survey plan of which is to be lodged with the Survey and Mapping Department Malaysia, the licensed land surveyor who signs the geomatics survey plan thereof shall deposit such plan together with the relevant survey records and data with the Survey and Mapping Department Malaysia and such geomatics survey plan, survey records and data shall become the property of the Government and shall be filed as permanent survey records.”. Pindaan seksyen 15 9. Seksyen 15 Akta ibu dipinda dengan menggantikan perkataan “the Director General of Survey or other officer appointed by him to approve survey plans on his behalf” dengan perkataan “the Director General of Survey and Mapping, the Director of Survey and Mapping or the Deputy Director of Survey and Mapping”. Pindaan seksyen 16 10. Seksyen 16 Akta ibu dipinda— (a) dalam subseksyen (1)— (i) dengan menggantikan perkataan “Director General of Survey” dengan perkataan “Director General of Survey and Mapping”; dan (ii) dengan memasukkan selepas perkataan “title survey” perkataan “or geomatics survey”; Juruukur Tanah Berlesen (Pindaan) 9 (b) dalam subseksyen (2)— (i) dengan menggantikan perkataan “The Director General of Survey or other person authorized by him to approve survey plans” dengan perkataan “The Director General of Survey and Mapping or any Government surveyor so authorized by him”; (ii) dengan memasukkan selepas perkataan “any error made by him” perkataan “on a title survey or geomatics survey”; dan (iii) dalam proviso— (A) dengan memasukkan selepas perkataan “relevant survey plan” perkataan “or geomatics survey plan, as the case may be,”; dan (B) dengan menggantikan perkataan “Survey Department” dengan perkataan “Survey and Mapping Department Malaysia”; (c) dalam subseksyen (3)— (i) dengan memasukkan selepas perkataan “within the time specified” perkataan “in the notice referred to in subsection (2)”; (ii) dengan memasukkan selepas perkataan “to correct such error” perkataan “to the title survey,”; dan (iii) dengan menggantikan perkataan “Director General of Survey” dengan perkataan “Director General of Survey and Mapping, the Director of Survey and Mapping or the Deputy Director of Survey and Mapping”; (d) dalam subseksyen (4), dengan menggantikan perkataan “the Director General of Survey” dengan perkataan “the Director General of Survey and Mapping or any Government surveyor so authorized by him”; dan 10 Undang-Undang Malaysia AktA A1730 (e) dengan memasukkan selepas subseksyen (4) subseksyen yang berikut: “(5) In the event of such licensed land surveyor refusing or neglecting within the time specified in the notice referred to in subsection (2) to correct such error to the geomatics survey, the Director General of Survey and Mapping or any Government surveyor so authorized by him shall report the facts to the Board for disciplinary action.”. Pindaan seksyen 17 11. Seksyen 17 Akta ibu dipinda— (a) dengan menggantikan perkataan “the Board may—” dengan perkataan “the Board may impose any one or any combination of two or more of the following disciplinary punishments:”; (b) dalam perenggan (a), dengan menggantikan perkataan “strike off” dengan perkataan “to strike off”; (c) dalam perenggan (b), dengan menggantikan perkataan “suspend” dengan perkataan “to suspend”; (d) dalam perenggan (c)— (i) dengan menggantikan perkataan “impose” dengan perkataan “to impose”; dan (ii) dengan menggantikan perkataan “five hundred ringgit” dengan perkataan “one hundred thousand ringgit”; dan (e) dalam perenggan (e), dengan menggantikan perkataan “reprimand” dengan perkataan “to reprimand”. Juruukur Tanah Berlesen (Pindaan) 11 Penggantian seksyen 19 12. Akta ibu dipinda dengan menggantikan seksyen 19 dengan seksyen yang berikut: “Offences 19. Any person who— (a) wilfully and falsely pretends, or takes or uses any name or title or abbreviation implying, that he is a licensed land surveyor or a Government surveyor; (b) not being a licensed land surveyor or a Government surveyor— (i) undertakes any title survey or geomatics survey including professional consultancy work in connection with a title survey or geomatics survey; or (ii) certifies to the accuracy of any title survey or geomatics survey or signs, certifies or initials any survey plan or geomatics survey plan; (c) not being a person acting under the immediate personal direction or supervision of a licensed land surveyor, carries out or undertakes to carry out any work in connection with any title survey or geomatics survey; or (d) uses any pre-computation plan, schedule of parcels, or any title survey or geomatics survey related documents, plans or drawings prepared or certified by a licensed land surveyor or a Government surveyor without the authorization of the licensed land surveyor or the Director General of Survey and Mapping, the Director of Survey and Mapping or the Deputy Director of Survey and Mapping, as the case may be, commits an offence and shall, on conviction, be liable to a fine not exceeding two hundred and fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both.”. 12 Undang-Undang Malaysia AktA A1730 Seksyen baharu 19a 13. Akta ibu dipinda dengan memasukkan selepas seksyen 19 seksyen yang berikut: “Electronic submission of survey records and data and documents 19a. (1) The Director General of Survey and Mapping may, subject to any conditions or specifications as he may determine, allow any survey records and data or any documents required to be submitted or furnished under this Act or regulations made under this Act to the Director General of Survey and Mapping to be submitted or furnished by an electronic medium or by way of an electronic transmission. (2) The Board may, subject to any conditions or specifications as the Board may determine, allow any documents required to be submitted or furnished under this Act or regulations made under this Act to the Board to be submitted or furnished by an electronic medium or by way of an electronic transmission. (3) The survey records and data and documents submitted or furnished by an electronic medium or by way of an electronic submission shall be deemed to have been submitted or furnished by a person to the Director General of Survey and Mapping or the Board, as the case may be, when the acknowledgment of receipt of such survey records and data or other documents are transmitted electronically by the Director General of Survey and Mapping or the Board to the person.”. Pindaan Jadual 14. Jadual kepada Akta ibu dipinda dengan menggantikan perkataan “survey and delineate the boundaries of any lands I may be instructed to survey” dengan perkataan “undertake any title survey or geomatics survey”. Juruukur Tanah Berlesen (Pindaan) 13 Peruntukan peralihan 15. (1) Pada tarikh permulaan kuat kuasa Akta ini, mana-mana orang selain juruukur tanah berlesen atau juruukur Kerajaan yang sedang menjalankan apa-apa ukur geomatik hendaklah, dalam masa enam bulan dari tarikh permulaan kuat kuasa Akta ini— (a) memohon kepada Lembaga supaya namanya dimasukkan dalam Daftar mengikut seksyen 9 Akta ibu; dan (b) memohon kepada Lembaga bagi suatu lesen untuk menjalankan amalan sebagai seorang juruukur tanah berlesen dikeluarkan kepadanya mengikut seksyen 10 Akta ibu. (2) Sementara menunggu mana-mana permohonan yang disebut dalam subseksyen (1) ditentukan, pemohon boleh terus menjalankan ukur geomatiknya dan Lembaga boleh mengenakan apa-apa syarat sebagaimana yang Lembaga fikirkan patut berhubung dengan penjalanan ukur geomatik itu. (3) Jika mana-mana permohonan di bawah subseksyen (1) ditolak, pemohon hendaklah berhenti menjalankan ukur geomatik itu dari tarikh pemohon itu diberitahu mengenai penolakan itu dan Lembaga boleh memberikan apa-apa arahan kepada pemohon sebagaimana yang Lembaga fikirkan patut berhubung dengan pemberhentian ukur geomatik oleh pemohon.
