Pendaftaran Kelahiran dan Kematian (Pindaan) 3 UNDANG-UNDANG MALAYSIA Akta A1524 AKTA PENDAFTARAN KELAHIRAN DAN KEMATIAN (PINDAAN) 2017 Suatu Akta untuk meminda Akta Pendaftaran Kelahiran dan Kematian 1957. [ ] DIPERBUAT oleh Parlimen Malaysia seperti yang berikut: Tajuk ringkas dan permulaan kuat kuasa 1. (1) Akta ini bolehlah dinamakan Akta Pendaftaran Kelahiran dan Kematian (Pindaan) 2017. (2) Akta ini mula berkuat kuasa pada tarikh yang ditetapkan oleh Menteri melalui pemberitahuan dalam Warta. Pindaan seksyen 2 2. Akta Pendaftaran Kelahiran dan Kematian 1957 [Akta 299], yang disebut “Akta ibu” dalam Akta ini, dipinda dalam seksyen 2 dengan memasukkan selepas takrif “Certificate of Death” takrif yang berikut: ‘ “Certificate of Presumed Death” means a certificate issued pursuant to section 24b or subsection 32(1);’. 4 Undang-Undang Malaysia AktA A1524 Pindaan seksyen 4 3. Seksyen 4 Akta ibu dipinda— (a) dengan menggantikan subseksyen (1) dengan subseksyen yang berikut: “(1) The Registrar-General shall keep and maintain a sufficient number of registers in a form to be determined by the Registrar-General for the recording of births, deaths and presumed deaths.”; dan (b) dengan memotong subseksyen (2) dan (3). Pindaan seksyen 4a 4. Seksyen 4a Akta ibu dipinda dengan memasukkan selepas perkataan “birth” di mana-mana jua terdapat perkataan “or death”. Pindaan seksyen 6 5. Seksyen 6 Akta ibu dipinda— (a) dengan menggantikan nota bahu dengan nota bahu yang berikut: “Inspection of registers, etc.”; (b) dengan menomborkan semula seksyen yang sedia ada sebagai subseksyen (1); dan (c) dengan memasukkan selepas subseksyen (1) yang dinomborkan semula subseksyen yang berikut: “(2) A public officer may, in the performance of his duties and with the authorization of the Registrar-General, inspect the registers and indices.”. Pendaftaran Kelahiran dan Kematian (Pindaan) 5 Pindaan seksyen 7 6. Seksyen 7 Akta ibu dipinda— (a) dalam subseksyen (1)— (i) dengan menggantikan perkataan “for the registration area in which the child was born” dengan perkataan “in any registration area”; dan (ii) dengan memotong perkataan “in duplicate in manner prescribed”; dan (b) dengan memotong subseksyen (3). Pindaan seksyen 8 7. Seksyen 8 Akta ibu dipinda— (a) dalam nota bahu, dengan menggantikan perkataan “fourteen” dengan perkataan “sixty”; dan (b) dengan menggantikan perkataan “fourteen” dengan perkataan “sixty”. Seksyen baharu 10a 8. Akta ibu dipinda dengan memasukkan selepas seksyen 10 seksyen yang berikut: “Special provision as to registration of birth 10a. Notwithstanding the provisions of this Part, the Registrar-General may, if he is satisfied from evidence adduced before him that a birth had occurred, cause such birth to be registered by entering in a register such particulars concerning the birth.”. Pemotongan seksyen 11 9. Akta ibu dipinda dengan memotong seksyen 11. 6 Undang-Undang Malaysia AktA A1524 Pindaan seksyen 12 10. Seksyen 12 Akta ibu dipinda— (a) dalam subseksyen (1)— (i) dengan menggantikan perkataan “forty-two days from the date of the birth or any child or” dengan perkataan “sixty days from the date of the birth of any child or fourteen days”; dan (ii) dengan menggantikan perkataan “subject to such conditions” dengan perkataan “subject to such fees and conditions”; dan (b) dengan memasukkan selepas subseksyen (1) subseksyen yang berikut: “(1a) The Registrar-General may waive, in whole or in part, the fees prescribed for late registration referred to in subsection (1) subject to such criteria and conditions as the Minister may determine.”. Pindaan seksyen 18 11. Seksyen 18 Akta ibu dipinda— (a) dengan menggantikan perkataan “for the registration area in which the death occurred” dengan perkataan “in any registration area”; dan (b) dengan memotong perkataan “in duplicate in manner prescribed”. Pindaan seksyen 19 12. Subseksyen 19(2) Akta ibu dipinda dengan menggantikan perkataan “twelve hours (exclusive of the time necessary for the journey and of any intervening hours of darkness)” dengan perkataan “seven days”. Pendaftaran Kelahiran dan Kematian (Pindaan) 7 Seksyen baharu 19a 13. Akta ibu dipinda dengan memasukkan selepas seksyen 19 seksyen yang berikut: “Special provision as to registration of death 19a. Notwithstanding the provisions of this Part, the Registrar-General may, if he is satisfied from evidence adduced before him that a death had occurred, cause such death to be registered by entering in a register such particulars concerning the death.”. Pemotongan seksyen 20 14. Akta ibu dipinda dengan memotong seksyen 20. Pindaan seksyen 21 15. Seksyen 21 Akta ibu dipinda— (a) dengan menomborkan semula seksyen yang sedia ada sebagai subseksyen (1); (b) dalam subseksyen (1) yang dinomborkan semula— (i) dengan menggantikan perkataan “three” dengan perkataan “seven”; (ii) dengan memotong perkataan “or the period specified in section 20 whichever be the longer”; dan (iii) dengan menggantikan perkataan “subject to such conditions” dengan perkataan “subject to such fees and conditions”; dan (c) dengan memasukkan selepas subseksyen (1) yang dinomborkan semula subseksyen yang berikut: “(2) The Registrar-General may waive, in whole or in part, the fees prescribed for late registration referred to in subsection (1) subject to such criteria and conditions as the Minister may determine.”. 8 Undang-Undang Malaysia AktA A1524 Pindaan seksyen 22 16. Subseksyen 22(1) Akta ibu dipinda dengan menggantikan perkataan “twelve hours” dengan perkataan “seven days”. Pindaan seksyen 23 17. Seksyen 23 Akta ibu dipinda dengan menggantikan perkataan “twenty-four hours” dengan perkataan “seven days”. Pindaan seksyen 24 18. Seksyen 24 Akta ibu dipinda— (a) dengan menggantikan perkataan “twenty-four hours” dengan perkataan “seven days”; dan (b) dengan memotong perkataan “for the registration area within which the death took place or the body of such person was found”. Seksyen baharu 24a dan 24b 19. Akta ibu dipinda dengan memasukkan selepas seksyen 24 seksyen yang berikut: “Registration of presumed death 24a. (1) When an order from a Court has been granted pertaining to a missing person’s presumed death under any written law, the person who has been granted the order may forward the order to the Registrar for the purpose of registering the particulars of the missing person’s presumed death. (2) On receipt of the order under subsection (1), the Registrar shall make an entry in a register containing the name of the missing person and such other information as may be necessary in relation to the missing person’s presumed death. Pendaftaran Kelahiran dan Kematian (Pindaan) 9 Certificate of Presumed Death 24b. The Registrar, upon registering a missing person’s presumed death, shall issue a Certificate of Presumed Death to the person forwarding the Court order under section 24a.”. Pindaan seksyen 26 20. Seksyen 26 Akta ibu dipinda— (a) dalam nota bahu, dengan memotong perkataan “Superintendent-Registrar and”; (b) dalam subseksyen (1)— (i) dengan memasukkan selepas perkataan “as may be appointed” perkataan “, and in such manner as may be determined,”; dan (ii) dengan menggantikan perkataan “Superintendent-Registrar” dengan perkataan “Registrar-General”; (c) dengan memotong subseksyen (2); dan (d) dengan menomborkan semula subseksyen (1) yang sedia ada sebagai seksyen 26. Pindaan seksyen 27 21. Seksyen 27 Akta ibu dipinda— (a) dalam subseksyen (3), dengan memotong perkataan “by entry (without any alteration of the original entry)”; (b) dengan memasukkan selepas subseksyen (3) subseksyen yang berikut: “(3a) Where the Registrar-General, the Superintendent-Registrar or the Registrar is satisfied that from an inquiry held under section 37b an error of fact or substance in any register exists, the error of fact or substance may be corrected by the Registrar-General.”; 10 Undang-Undang Malaysia AktA A1524 (c) dalam subseksyen (4)— (i) dengan memotong perkataan “(without any alteration of the original entry)”; dan (ii) dengan memotong perkataan “, who shall place his initials opposite the entry in which such error occurs and shall add thereto the day and the month and the year when such correction is made”; dan (d) dengan memotong subseksyen (5) dan (6). Pindaan seksyen 30 22. Subseksyen 30(1) Akta ibu dipinda— (a) dengan memotong perkataan “in duplicate”; dan (b) dengan memotong perkataan “One copy of the indices shall be kept by the Registrar-General and the other copy shall be kept by the appropriate Superintendent-Registrar”. Pindaan seksyen 32 23. Seksyen 32 Akta ibu dipinda— (a) dalam nota bahu, dengan menggantikan perkataan “Certificates of Birth and Certificates of Death” dengan perkataan “Certificates of Birth, Certificates of Death and Certificates of Presumed Death”; (b) dalam subseksyen (1), dengan menggantikan perkataan “a Certificate of Birth or a Certificate of Death” dengan perkataan “a Certificate of Birth, Certificate of Death or Certificate of Presumed Death”; (c) dalam subseksyen (2), dengan menggantikan perkataan “Certificate of Birth or Certificate of Death” dengan perkataan “Certificate of Birth, Certificate of Death or Certificate of Presumed Death”; Pendaftaran Kelahiran dan Kematian (Pindaan) 11 (d) dalam subseksyen (4)— (i) dengan menggantikan perkataan “Certificate of Birth or a Certificate of Death” dengan perkataan “Certificate of Birth, Certificate of Death or Certificate of Presumed Death”; dan (ii) dalam perenggan (b), dengan menggantikan perkataan “birth or death” dengan perkataan “birth, death or presumed death”; dan (e) dalam subseksyen (5), dengan menggantikan perkataan “Certificate of Birth or the Certificate of Death” dengan perkataan “Certificate of Birth, Certificate of Death or Certificate of Presumed Death”. Pindaan seksyen 33 24. Seksyen 33 Akta ibu dipinda— (a) dalam nota bahu, dengan menggantikan perkataan “or death” dengan perkataan “, death or presumed death”; (b) dalam subseksyen (1)— (i) dengan menggantikan perkataan “a Certificate of Birth or a Certificate of Death” dengan perkataan “a Certificate of Birth, Certificate of Death or Certificate of Presumed Death”; dan (ii) dengan menggantikan perkataan “such birth or death” dengan perkataan “such birth, death or presumed death”; (c) dalam subseksyen (2)— (i) dengan menggantikan perkataan “a Certificate of Birth or a Certificate of Death” dengan perkataan “a Certificate of Birth, Certificate of Death or Certificate of Presumed Death”; dan 12 Undang-Undang Malaysia AktA A1524 (ii) dengan memasukkan selepas perenggan (c) perenggan yang berikut: “(ca) the entry is an entry of presumed death which has been made upon receiving an order from a Court; or”; dan (d) dalam subseksyen (3), dengan menggantikan perkataan “a Certificate of Birth or a Certificate of Death” dengan perkataan “a Certificate of Birth, Certificate of Death or Certificate of Presumed Death”. Pindaan seksyen 34 25. Seksyen 34 Akta ibu dipinda— (a) dalam perenggan (a)— (i) dengan memasukkan selepas perkataan “death” perkataan “or presumed death”; dan (ii) dengan menggantikan perkataan “qualified informant” dengan perkataan “qualified person under section 7 or 19 or a person under section 24a”; dan (b) dengan menggantikan perkataan “of five hundred ringgit” dengan perkataan “not exceeding twenty thousand ringgit or to imprisonment for a term not exceeding three years or to both”. Pindaan seksyen 35 26. Seksyen 35 Akta ibu dipinda dengan menggantikan perkataan “of two hundred and fifty ringgit for each offence” dengan perkataan “not exceeding twenty thousand ringgit or to imprisonment for a term not exceeding three years or to both”. Pindaan seksyen 36 27. Seksyen 36 Akta ibu dipinda— (a) dengan menomborkan semula seksyen yang sedia ada sebagai subseksyen (1); Pendaftaran Kelahiran dan Kematian (Pindaan) 13 (b) dalam perenggan (j), dengan menggantikan perkataan “a Certificate of Birth or a Certificate of Death” dengan perkataan “a Certificate of Birth, Certificate of Death or Certificate of Presumed Death”; (c) dalam perenggan (k), dengan menggantikan perkataan “Certificate of Birth or Certificate of Death” dengan perkataan “Certificate of Birth, Certificate of Death or Certificate of Presumed Death”; (d) dalam perenggan (l), dengan memotong perkataan “or” di hujung perenggan itu; (e) dalam perenggan (m), dengan menggantikan koma di hujung perenggan itu dengan perkataan “; or”; (f) dengan memasukkan selepas perenggan (m) perenggan yang berikut: “(n) knowingly possesses or makes use of a fake Certificate of Birth, Certificate of Death or Certificate of Presumed Death,”; (g) dengan menggantikan perkataan “of two thousand ringgit or to imprisonment for twelve months or to both such fine and imprisonment” dengan perkataan “not exceeding twenty thousand ringgit or to imprisonment for a term not exceeding three years or to both”; dan (h) dengan memasukkan selepas subseksyen (1) yang dinomborkan semula subseksyen yang berikut: “(2) Every offence under paragraph (1)(a), (b), (c), (h), (i), (j), (k), (m) or (n) shall be a seizable offence for the purpose of the law relating to criminal procedure.”. Pemotongan seksyen 37a 28. Akta ibu dipinda dengan memotong seksyen 37a. 14 Undang-Undang Malaysia AktA A1524 Pindaan seksyen 37b 29. Seksyen 37b Akta ibu dipinda— (a) dalam subseksyen (1)— (i) dengan menggantikan perkataan “Superintendent- Registrar or any other officer duly authorized in writing” dengan perkataan “the Superintendent-Registrar or the Registrar”; dan (ii) dengan menggantikan perkataan “sections 12, 15, 21, 27, subsections 32(3) and (4)” dengan perkataan “this Act”; (b) dalam subseksyen (2)— (i) dengan menggantikan perkataan “Superintendent- Registrar or such authorized officer” dengan perkataan “the Superintendent-Registrar or the Registrar”; (ii) dalam perenggan (b), dengan menggantikan noktah di hujung perenggan itu dengan perkataan “; or”; dan (iii) dengan memasukkan selepas perenggan (b) perenggan yang berikut: “(c) require any document to be produced which he may consider reasonably necessary.”; (c) dalam subseksyen (3)— (i) dengan menggantikan perkataan “The Superintendent-Registrar” dengan perkataan “The Registrar-General, the Superintendent- Registrar or the Registrar”; dan (ii) dengan memasukkan selepas perkataan “by him” perkataan “under paragraph (2)(c)”; dan Pendaftaran Kelahiran dan Kematian (Pindaan) 15 (d) dengan memasukkan selepas subseksyen (3) subseksyen yang berikut: “(4) Any person who fails or refuses— (a) to attend any inquiry; (b) to produce any document; or (c) to answer any question, when required to do so under this section shall be liable to a fine not exceeding one thousand ringgit.”. Seksyen baharu 37c 30. Akta ibu dipinda dengan memasukkan selepas seksyen 37b seksyen yang berikut: “Power to investigate 37c. (1) The Registrar-General, the Superintendent-Registrar and the Registrar may investigate the commission of any offence under this Act. (2) For the avoidance of doubt, it is declared that for the purposes of this Act, the Registrar-General, the Superintendent-Registrar and the Registrar shall have all or any of the special powers of a police officer of whatever rank in relation to police investigations in seizable cases as provided for under the Criminal Procedure Code [Act 593], and such powers shall be in addition to the powers provided for under this Act and not in derogation thereof.”. Pindaan seksyen 38 31. Akta ibu dipinda dengan menggantikan seksyen 38 dengan seksyen yang berikut: “Power to compound offences 38. (1) The Minister may make rules prescribing— (a) any offence under this Act and any rules made under this Act that may be compounded; 16 Undang-Undang Malaysia AktA A1524 (b) criteria for compounding such offence; and (c) method and procedure for compounding such offence. (2) The Registrar-General or the Superintendent-Registrar may, with the consent in writing of the Public Prosecutor, compound any offence committed by any person under this Act or any rules made under this Act and prescribed to be a compoundable offence by making a written offer to the person suspected to have committed the offence to compound the offence upon payment to the Registrar-General or the Superintendent-Registrar of such amount of money not exceeding fifty per centum of the amount of maximum fine for that offence within such time as may be specified in his written offer. (3) An offer under subsection (2) may be made at any time after the offence has been committed but before any prosecution for it has been instituted. (4) If the amount specified in the offer is not paid within the time specified in the offer or such extended time as the Registrar-General or the Superintendent-Registrar may grant, prosecution for the offence may be instituted at any time after that against the person to whom the offer was made. (5) Where an offence has been compounded under subsection (2), no prosecution shall be instituted in respect of the offence against the person to whom the offer to compound was made, and any document or thing seized in connection with the offence may be released by the Registrar-General or the Superintendent-Registrar, subject to such terms as he thinks fit.”.
