Kastam (Pindaan) 3 UNDANG-UNDANG MALAYSIA Akta A1669 AKTA KASTAM (PINDAAN) 2022 Suatu Akta untuk meminda Akta Kastam 1967. [ ] DIPERBUAT oleh Parlimen Malaysia seperti yang berikut: Tajuk ringkas dan permulaan kuat kuasa 1. (1) Akta ini bolehlah dinamakan Akta Kastam (Pindaan) 2022. (2) Akta ini mula berkuat kuasa pada tarikh yang ditetapkan oleh Menteri melalui pemberitahuan dalam Warta. Pindaan am 2. Akta Kastam 1967 [Akta 235], yang disebut “Akta ibu” dalam Akta ini, dipinda— (a) dengan menggantikan perkataan “in the prescribed form”, di mana-mana jua terdapat dalam seksyen 57, 59 dan 94, dan subseksyen 16(1), 37(1), 38(2), 52(1), 54(1), 56(1), 58(1) dan 143(2), dan perenggan 93(1)(e), 128(3a)(b) dan 133(1)(g), dengan perkataan “in the form and manner as determined by the Director General”; 4 Undang-Undang Malaysia AktA A1669 (b) dengan menggantikan perkataan “substantially in the prescribed form, giving particulars of the goods imported”, di mana-mana jua terdapat dalam seksyen 83 dan subseksyen 81(1), dengan perkataan “in the form and manner as determined by the Director General”; (c) dengan menggantikan perkataan “substantially in the prescribed form, giving particulars of the goods to be exported”, di mana-mana jua terdapat dalam seksyen 86 dan subseksyen 84(1), dengan perkataan “in the form and manner as determined by the Director General”; dan (d) dengan menggantikan perkataan “substantially in the prescribed form giving particulars of the goods transported in such vehicle, vessel or aircraft”, di mana-mana jua terdapat dalam seksyen 163d, 163m dan 163t, dengan perkataan “in the form and manner as determined by the Director General”. Pindaan seksyen 3 3. Subseksyen 3(3) Akta ibu dipinda dengan menggantikan perkataan “sections 10f, 13b, 22 and 145” dengan perkataan “sections 10f, 13b and 22”. Pindaan seksyen 10a 4. Subseksyen 10a(1) Akta ibu dipinda dengan menggantikan perkataan “Any person may apply, in the prescribed form together with the prescribed fee, to the Director General” dengan perkataan “Any person may apply to the Director General, in the form and manner as determined by the Director General together with the prescribed fee,”. Pindaan seksyen 19 5. Seksyen 19 Akta ibu dipinda dengan memotong subseksyen (2). Kastam (Pindaan) 5 Pindaan seksyen 65a 6. Perenggan 65a(3)(b) Akta ibu dipinda dengan menggantikan perkataan “Subject to subsection (4), if” dengan perkataan “If”. Pindaan seksyen 78 7. Subseksyen 78(1) Akta ibu dipinda dengan menggantikan perkataan “in such form as may be prescribed to the proper officer of customs” dengan perkataan “in the form and manner as determined by the Director General”. Pindaan seksyen 78b 8. Subseksyen 78b(2) Akta ibu dipinda dengan menggantikan perkataan “the date of the declaration being approved by the proper officer of customs” dengan perkataan “the date of arrival of such goods”. Pindaan seksyen 80 9. Perenggan 80(1)(a) Akta ibu dipinda dengan menggantikan perkataan “in the prescribed form and to the officer of customs specified in subsection (2)” dengan perkataan “in the form and manner as determined by the Director General”. Pindaan seksyen 82 10. Seksyen 82 Akta ibu dipinda dengan menggantikan perkataan “substantially in the prescribed form giving particulars of the goods imported” dengan perkataan “in the form and manner as determined by the Director General”. Pindaan seksyen 85 11. Seksyen 85 Akta ibu dipinda dengan menggantikan perkataan “substantially in the prescribed form giving particulars of the goods to be exported” dengan perkataan “in the form and manner as determined by the Director General”. 6 Undang-Undang Malaysia AktA A1669 Pindaan seksyen 99 12. Perenggan 99(1)(d) Akta ibu dipinda— (a) dengan memotong selepas perkataan “given on the” perkataan “prescribed”; dan (b) dengan menggantikan perkataan “in the prescribed form” dengan perkataan “in the form and manner as determined by the Director General”. Pindaan seksyen 142 13. Seksyen 142 Akta ibu dipinda dengan memotong subseksyen (12) dan (35e). Pemotongan seksyen 145 14. Akta ibu dipinda dengan memotong seksyen 145. Seksyen baharu 145c dan 145d 15. Akta ibu dipinda dengan memasukkan selepas seksyen 145b seksyen yang berikut: “Power to extend period 145c. Where, by this Act, a period is specified within which an act or thing is to be done by a person, and the Minister is satisfied that the act or thing could not be completed in that period due to the occurrence of public emergency or public health crisis, the Minister may, upon such terms and conditions as the Minister thinks fit, extend the period for the completion of the act or thing before the expiration of the period. Power to modify terms and conditions 145d. (1) Where terms and conditions are imposed pursuant to this Act, the Minister may, on the advice of the Director General, from time to time modify the terms and conditions for the purpose of carrying out the objects of this Act. Kastam (Pindaan) 7 (2) Before modifying the terms and conditions, notice must be given to the person bound by the terms and conditions stating— (a) the terms and conditions as modified; and (b) the date the terms and conditions as modified take effect. (3) The modified terms and conditions shall not take effect in less than fourteen days from the date the notice is issued under subsection (2). (4) Where the terms and conditions were initially imposed by the Director General pursuant to this Act, the terms and conditions as modified by the Minister shall be deemed to have been imposed by the Director General. (5) For the purposes of this section, “modify” means add to, delete or vary.”. Pindaan seksyen 157 16. Seksyen 157 Akta ibu dipinda— (a) dengan memasukkan selepas perkataan “any” perkataan “vehicle,”; dan (b) dengan menggantikan perkataan “substantially in the prescribed form giving particulars of the goods transported in such vessel or aircraft” dengan perkataan “in the form and manner as determined by the Director General”.
