Notification to be conclusive evidence of appointment 4 Laws of Malaysia ACT 529 Director General of Social Welfare (Incorporation) 5 LAWS OF MALAYSIA Act 529 DIRECTOR GENERAL OF SOCIAL WELFARE (INCORPORATION) ACT 1948 An Act to incorporate the Director General of Social Welfare, Malaysia. [19 August 1948] Short title 1. This Act may be cited as the Director General of Social Welfare (Incorporation) Act 1948. Incorporation of Director General of Social Welfare and powers of the corporation 2. (1) The officer for the time being discharging the duties of Director General of Social Welfare, Malaysia, and his successors in office shall be a body corporate under the name of “Director General of Social Welfare Malaysia” (hereinafter called “the corporation”). (2) The corporation may enter into contracts and sue and be sued in its said name and shall have perpetual succession and a corporate seal, and the said seal may from time to time be broken, changed, altered and made anew as the corporation deems fit, and until a seal is provided under this section a stamp bearing the inscription “Director General of Social Welfare Malaysia” may be used as the corporate seal. (3) The corporation may acquire, purchase, take, hold and enjoy movable and immovable property of every description, and sell, convey, assign, surrender and yield up, mortgage, charge, demise, re-assign, transfer or otherwise dispose of any movable and immovable property vested in the corporation upon such terms as the corporation deems fit. 6 Laws of Malaysia ACT 529 Execution of documents 3. All deeds, documents and other instruments requiring the seal of the corporation shall be sealed with the seal of the corporation in the presence of the officer for the time being discharging the duties of the office of Director General of Social Welfare, Malaysia, who shall sign every such deed, document or other instrument to which the corporate seal is affixed, and such signing shall be sufficient evidence that the said seal was duly and properly affixed and that the same is the lawful seal of the corporation. Notification to be conclusive evidence of appointment 4. A notification in the Gazette of the appointment of any person to hold or act in the office of Director General of Social Welfare, Malaysia, shall be conclusive evidence that such person was duly so appointed.
