In the implementation of the provisions of the present Law, the following terms and expressions shall have the following meaning assigned to each, unless the context otherwise requires: The Council: Higher Board of Education The Minister: The Minister of Education and Higher Education Legal Guardian: The child's parent or any legal guardian appointed in lieu of the child's parent. Education shall be mandatory and free for all children from the beginning of the Primary stage of education to the end of the Secondary stage of education or when the child receiving such education becomes 18 years of age whichever is the sooner, and the Council shall provide for all educational requirements. The Legal Guardian of a child who turns six years of age at any time between the beginning of any school year or the last day of December of such year shall be obliged to enrol the child in mandatory education and ensure the child remains in mandatory education until he or she completes the Secondary stage of education or when he or she becomes 18 years of age whichever is the sooner The Higher Council of Health on or before the last day of January of each year shall issue lists of the names of children registered in census records one year before they become of legal age for mandatory education provided that these lists include the following data: 1. the child's name; 2. the name of the child's father and grandfather; 3. the last name if present; 4. Address and residential area. The lists for the first year to which this Law applies should include the names of children from the age of five to the age of eighteen. During the period of mandatory education the Legal Guardian of any child is obliged to notify the Council of any change of address of such child. The Council shall enrol the children whose names appear on the lists referred to in Article 4 of this Law in the school nearest to their place of residence, and at least one month before the commencement of a child's mandatory education the Legal Guardian of such child shall provide to ……………. written information relating to the child giving notification of the name of the school that the child will attend, the date of the child's registration with such school, any required documents, and the date of the beginning of the mandatory period of education. The administrative body of any school shall give written notice to the Legal Guardian of any child due to receive or receiving mandatory education in any of the following circumstances: a in the event that a child whose name appears on the list of children due to be enrolled in mandatory education has not been registered with the school allocated to such child within two weeks of the due date for registration; b in the event that a child whohas been registered with the school allocated to such child has not attended regularly and no acceptable reason has been provided to explain such absence; c in the event that a child whohas received the educational material relating to his or her forthcoming education and has not been registered with the school allocated to such child within one week of receipt of such educational material. 2. Within one weekof observing that any child the subject of mandatory education continues to be absent from school without providing any acceptable reason for such continued absencesuch child shall be considered in violation of this Law the administrative body of any school shall notify the Council accordingly. Any child who develops an illness or disability that prevents him or her from attending public or private schools is excused from mandatory education for the period of such illness or disability in accordance with a decision from the Minister based on a certificate of a Competent Medical Authority at the Higher Council of Health. This exemption also applies to any child suspended from school due to temporary circumstances. Exemption from mandatory school attendance shall cease when such illness, disability or temporary circumstance no longer affects the child. At his own expense, the Legal Guardian of a child may enrol the child in a school or institution at the same educational level of schools providing mandatory education provided that the Council is notified of the name of the school or institution at least one week before the beginning of the school year. The names of the private schools and institutions that are considered equivalent to the established study standards of mandatory education shall be determined by a decision from the Minister. In the event that a child reaches the legal age for the cessation of the mandatory stages of education without having successfully completed such stages of education, the child shall be granted a certificate stating the educational level attained and the Council shall enrol him or her in an appropriate educational establishment at the appropriate level. The Legal Guardian of any child who refrains from enrolling such child in mandatory education or in any other school or institution providing at least the same level of education as that of schools providing mandatory education without an acceptable excuse shall be liable to a fine of a minimum of Five Thousand Riyals (QAR 5,000) and a maximum of Ten Thousand Riyals (QAR 10,000). In the event of repeat violations of this legal obligation the fine applicable shall be a minimum of Ten Thousand Riyals (QAR 10,000) and a maximum of Twenty Thousand Riyals (QAR 20,000). The Minister shall make such decisions as are required to fulfil the provisions of this Law. All competent authorities, each within their respective areas of competence shall be liable to enforce this Law. This Law shall enter into force as from the date of its publication in the Official Gazette --- في تطبيق أحكام هذا القانون، تكون للكلمات والعبارات التالية، المعاني الموضحة قرين كل منها، ما لم يقتض السياق معنى آخر: الوزارة: وزارة التعليم والتعليم العالي. الوزير: وزير التعليم والتعليم العالي. المسؤول عن الطفل: والد الطفل أو الشخص المنوط به قانوناً رعايته. يكون التعليم إلزامياً ومجانياً لجميع الأطفال من بداية المرحلة الابتدائية وحتى نهاية المرحلة الإعدادية أو بلوغ سن الثامنة عشر أيهما أسبق، وتوفر الوزارة المتطلبات اللازمة لذلك. يلتزم المسؤول عن الطفل الذي يبلغ ست سنوات عند بداية أي سنة دراسية أو حتى نهاية شهر ديسمبر من السنة ذاتها بإلحاقه بالتعليم الإلزامي، ويظل التزامه قائماً طوال مدة الإلزام المشار إليها. توافي وزارة الصحة العامة الوزارة في موعد لا يتجاوز نهاية شهر يناير من كل سنة بقوائم بأسماء الأطفال المقيدين في سجلات قيد المواليد، وذلك قبل بلوغهم السن القانونية للإلزام بعام واحد، على أن تتضمن القوائم البيانات التالية: 1- اسم الطفل. 2- اسم الأب والجد. 3- اسم العائلة إن وجد. 4- العنوان ومنطقة السكن. وتكون قوائم السنة الأولى لتنفيذ هذا القانون، متضمنة الأسماء من سن الخامسة وحتى سن الثامنة عشر. يلتزم المسؤول عن الطفل خلال مدة الإلزام بأن يخطر الوزارة بأي تغيير يطرأ على محل إقامته أو عنوانه. تتولى الوزارة إلحاق الأطفال الذين وردت أسماؤهم في القوائم المشار إليها، بالمدارس الأقرب إلى محل إقامتهم، ويخطر المسؤول عن الطفل بكتاب مسجل بعلم الوصول باسم المدرسة وتاريخ التسجيل والمستندات المطلوبة، وموعد بدء الدراسة، وذلك قبل بداية العام الدراسي بشهر على الأقل. تخطر إدارة المدرسة المعنية، بكتاب مسجل بعلم الوصول، المسؤول عن الطفل المدرج اسمه بالقوائم إذا لم يتم تسجيله في المدرسة خلال أسبوعين من الموعد المحدد، أو لم يواظب على الحضور بعد تسجيله دون عذر مقبول، فإذا لم يتم التسجيل خلال أسبوع من تسلم الكتاب، أو عاود الطفل الغياب دون عذر مقبول، أعتبر المسؤول عن الطفل مخالفاً لأحكام هذا القانون، وعلى إدارة المدرسة إخطار الوزارة بذلك خلال أسبوع على الأكثر. يعفى من التعليم الإلزامي من يصاب بمرض أو عاهة تمنعه من الدراسة في مدارس التعليم العام أو مدارس التربية الخاصة، ويصدر بالإعفاء قرار من الوزير بناء على شهادة من الجهة الطبية المختصة بوزارة الصحة العامة، ويسري ذات الحكم على من يفصل من الدراسة لأسباب موضوعية، ويزول الإعفاء بزوال السبب. يجوز للمسؤول عن الطفل أن يلحقه على نفقته بمدرسة أو بمعهد خاص في ذات المستوى الدراسي لمدارس التعليم الإلزامي، على أن يخطر الوزارة باسم المدرسة أو المعهد قبل بداية العام الدراسي بأسبوع على الأقل. وتحدد بقرار من الوزير المدارس والمعاهد الخاصة التي تعد الدراسة فيها معادلة للدراسة المقررة في التعليم الإلزامي. إذا تجاوز الملزم السن القانونية لمرحلة التعليم الإلزامي دون إكمالها بنجاح، يمنح شهادة تبين المستوى الدراسي الذي بلغه، وتعمل الوزارة على إلحاقه بمدارس تعليم الكبار في المستوى المناسب. يُعاقب المسؤول عن الطفل، الذي يمتنع عن إلحاق الطفل دون عذر مقبول بمرحلة التعليم الإلزامي، بغرامة لا تقل عن خمسة آلاف ريال ولا تزيد على عشرة آلاف ريال. وفي حالة تكرار المخالفة تضاعف العقوبة في حديها الأدنى والأعلى. يصدر الوزير القرارات اللازمة لتنفيذ أحكام هذا القانون. على جميع الجهات المختصة، كل فيما يخصه، تنفيذ هذا القانون. وينشر في الجريدة الرسمية.
