Each Ministry shall have one or more Undersecretaries, depending on the requirements of the public interest. The Undersecretary shall report directly to the Minister. Subject to the public authority of the Undersecretary according to the provisions of the aforesaid law No. 5 of 1970 , and without prejudice to the special provisions stipulated in the laws and bylaws, the Undersecretary of the Ministry, under the supervision of the Minister, shall be responsible for the following: A) General supervision and direction of departments and other agencies of the Ministry in accordance with the public policies of the State in general, and the general policies of the Ministry in particular; B) Issuing internal decisions in the form of releases, periodicals or instructions for the organization and coordination of the departments’ functions of the Ministry. C) Monitoring the work progress and performance of Ministry employees; D) Perusal and executing technical projects of the Ministry; E) Investigating complaints and grievances made to the Minister; F) Chairing important ministerial committees; G) Acting on behalf of the Ministry in contracts, transactions and other legal dispositions which the Minister authorises the Undersecretary to conclude; H) Monitoring the execution of laws, bylaws and decisions of the Ministry; I) Proposing the appointment, promotion, transferring, delegation, disciplining, providing allowances and salary increases and other career-related issues of employees according to the rules established by the laws and bylaws; J) Studying the suggestions of the Shura Council related to the competency of the Ministry and preparing reports concerning its recommendations; K) Supervising the preparation of the Ministry’s budget for the new fiscal year and the final account of the ended fiscal year, and monitoring the execution of the budget in accordance with the established appropriations of the Ministry; L) Preparing reports during the first two months of each new fiscal year concerning the business of the Ministry during the previous year; M) Other issues stipulated by the laws and bylaws as within the competency of each Undersecretary of the Ministry, and any other work which the Minister or the Council of Ministers entrusts to him upon the recommendation of the Minister. The Undersecretary of the Ministry may, in the absence of the Minister and upon authorisation from the Prime Minister, attend the sessions of the Council of Ministers in which issues relating to the Ministry are discussed. In such instance, the Undersecretary of the Ministry shall have no vote on the deliberations or resolutions. The Undersecretary of the Ministry is considered the administrative president of all the employees at the Ministry. Directors shall not contact the Minister directly on work-related issues before first presenting them to the Secretary. The Minister may entrust some specialties under his authority to the Undersecretary according to the laws and bylaws. The appointed Undersecretary of the Ministry shall: 1. Be a Qatari citizen according to the law. 2. Hold high qualifications or possess sufficient expertise in the Ministry’s field of competency. 3. Be at least 30 thirty years old when appointed. 4. Be a senior employee in the Ministry, or appointed from outside the Ministry if in the public interest. 1. Except where an Emiri Resolution is issued for his removal for reasons related to the public interest, the Undersecretary of the Ministry may not be removed from office unless by a decision from a special disciplinary council. 2. The aforesaid disciplinary council shall be presided by one of the Ministers and the membership of two judges of the Court of Appeal, or senior attorneys in the State. Except for reprimand and removal from office, no other punishment shall be imposed. 3. The Council of Ministers may, at the request of the competent minister, reprimand the undersecretary. The reprimand decision shall be justified. Where this Emiri Resolution is silent, the provisions of the Civil Service Law shall be applicable to the Undersecretary of the Ministry. Any other provision contrary to the provisions of this Emiri Resolution shall be repealed. All competent authorities, each within their own area, shall execute this Emiri Resolution and it shall come into force from the date of its publication in the Official Gazette . --- يكون لكل وزارة وكيل وزارة أو أكثر، وفقا لمقتضيات المصلحة العامة. ويكون وكيل الوزارة مسئولا مباشرة أمام الوزير. مع مراعاة ما لوكيل الوزارة من اختصاص عام وفقا لأحكام القانون رقم (5) لسنة 1970 المشار إليه، ومع عدم الإخلال بالأحكام الخاصة الواردة في القوانين واللوائح، يتولى وكيل الوزارة - تحت إشراف الوزير- الاختصاصات الآتية: أ- الإشراف العام على الإدارات والأجهزة الأخرى التابعة للوزارة، وتوجيهها وفقا للسياسة العامة للدولة بوجه عام، والسياسة العامة المرسومة للوزارة بوجه خاص. ب- إصدار القرارات الداخلية، في شكل منشورات أو كتب دورية أو تعليمات، لتحقيق التنظيم اللازم للعمل في الوزارة والتنسيق بين إداراتها. ج- الرقابة على سير العمل وأداء الموظفين لواجباتهم في الوزارة. د- متابعة إعداد المشروعات الفنية الخاصة بالوزارة وتنفيذها. ه- معاونة الوزير في نظر ما يرفع إليه من شكاوي أو تظلمات. و- تولي رئاسة اللجان الهامة المشكلة في الوزارة. ز- النيابة عن الوزارة في العقود والمعاملات وغيرها من التصرفات القانونية المتعلقة بالوزارة التي يجوز للوزير أن يفوضه فيها. ح- مراقبة تنفيذ القوانين واللوائح والقرارات الوزارية المتعلقة بالوزارة. ط- اقتراح تعيين الموظفين وترقيتهم ونقلهم وندبهم وتأديبهم ومنحهم العلاوات المختلفة، وغير ذلك من المسائل الوظيفية، وذلك وفقا للقواعد المقررة بمقتضى القوانين واللوائح. ي- دراسة الرغبات التي يبديها مجلس الشورى متعلقة باختصاص الوزارة وإعداد التقارير بتوصياتها بشأنها. ك- الإشراف على إعداد مشروع ميزانية الوزارة عن السنة المالية الجديدة، والحساب الختامي للسنة المالية المنتهية، ومراقبة تنفيذ الميزانية وفقا للاعتمادات المقررة للوزارة. ل- إعداد تقارير خلال الشهرين الأوليين من كل سنة مالية جديدة عن أعمال الوزارة خلال السنة السابقة. م- المسائل الأخرى التي تنص القوانين واللوائح على اختصاص وكيل الوزارة بها، وأي عمل آخر يعهد به إليه الوزير أو مجلس الوزراء بناء على اقتراح الوزير. يجوز، بقرار من رئيس الوزراء، أن يحضر وكيل الوزارة جلسات مجلس الوزراء عند نظر المسائل المتعلقة بوزارته، وعند غياب الوزير. ولا يكون له صوت معدود في المداولات أو القرارات. يعتبر وكيل الوزارة الرئيس الإداري لجميع الموظفين بالوزارة. ولا يجوز للمديرين أن يتصلوا من تلقاء أنفسهم بالوزير في المسائل المتعلقة بعملهم في الوزارة قبل عرضها على وكيل الوزارة. يجوز للوزير أن يعهد ببعض الاختصاصات المخولة له بمقتضى القوانين واللوائح، إلى وكيل الوزارة. يشترط فيمن يعين وكيلا للوزارة: 1- أن يكون قطري الجنسية وفقا للقانون. 2- أن يكون حاصلا على مؤهل عال، أو أن يكون من ذوي الخبرة الكافية في مجال تخصص الوزارة. 3- ألا تقل سنه عند التعيين عن ثلاثين سنة. 4- أن يكون من كبار موظفي الوزارة، ويجوز أن يعين من خارجها إذا اقتضت المصلحة العامة ذلك. لا يجوز عزل وكيل الوزارة إلا بقرار من مجلس تأديبي خاص. ويستثنى من ذلك حالة صدور قرار أميري بالعزل لأسباب تتعلق بالصالح العام. ويؤلف مجلس التأديب المشار إليه بقرار أميري برئاسة أحد الوزراء، وعضوية اثنين من قضاة محكمة الاستئناف، أو كبار رجال القانون في الدولة. ولا يوقع عليه إلا عقوبتا اللوم والعزل. ولمجلس الوزراء، بناء على طلب الوزير المختص، أن يوجه إليه اللوم إذا وقع منه ما يبرر ذلك. ويكون قرار اللوم مسببا. تسري على وكيل الوزارة أحكام قانون الوظائف العامة المدنية فيما لم يرد بشأنه نص خاص في هذا القرار الأميري. يلغى كل حكم آخر يخالف أحكام هذا القرار الأميري. على جميع الجهات المختصة، كل فيما يخصه، تنفيذ هذا القرار الأميري. ويعمل به من تاريخ صدوره، وينشر في الجريدة الرسمية.
