Issuing decisions on Ministry staff affairs according to Civil Service legislation; 5. Supervising the preparation of the annual draft budget of the Ministry; 6. Proposing legislation relating to the Ministry’s activities. The Ministers shall receive monthly allowances, benefits and bonuses determined by an Emiri Resolution. The duration and conditions of Ministers’ vacation time shall be determined by a resolution of the Council of Ministers. Ministers’ travel for official missions abroad on behalf of the State shall be in accordance with a resolution of the Council of Ministers and, in the event of urgent cases, Ministers’ travel shall be in accordance with a resolution by the Prime Minister. A delegated Minister on an official mission abroadon behalf ofthe State shall receive financial allocations and arepresentative’s allowance as determined by the Emiri Resolution referred to in Article 5 of this Law. The Emir may entrust a Minister to undertake the work of Ministers who are absent on vacation,on an official mission abroad or when such a post is vacant. In addition to duties stated in the Constitution and Law, the Minister shall: 1. Perform the functions of his post with honesty and honour; 2. Implement the instructions and guidance issued by the Emir or the Prime Minister within the limits of legislation; 3. Act in the public interest and forgo self-interest. In addition to the prohibitions stated in legislation, the Minister is prohibited from: 1. Violation of the provisions of the Constitution and Law; 2. Exploitation of power for self-interest or advantage for himself or for others; 3. Disclosure of secrets towhicha Minister has access due to his position even once his service is terminated; 4. Interfering in the affairs of justice, whether directly or indirectly; 5. Interfering in electoral processes or procedures in any way in order to influence the result; 6. The Ministers MUST be held accountable, in accordance with the procedures stated in this Law, if they committed while in postany of the following offences: 1. Offences relating to internal or external state security; 2. Offences relating to public offices; 3. Offences relating to an election. Penalties prescribed by Law shall be handed down on them. The referral of the Minister to impeachment or trial shall be in accordance witha decision of the Emir at the request of the Prime Minister, and the consequence of the referral is the liftingof the immunity prescribed thereto if he is a member of the Shura Council. The Minister shall beon leave with full pay from the date of notification of the decision for areferral to investigation or impeachment. Suchleave ends onlywhen the investigation or the ruling in alawsuit either becomes categorical, or onitsbeing dismissedfor any reason before thepronouncing of the verdict. The Attorney-General shall conduct the investigation with the Minister, with the assistance of members of the Public Prosecution. Where it transpires on completion of the investigation that there is sufficient prima facie evidence to substantiatethe committing of anoffence or offences as stated in Article 12 of this Law, and wherethe evidence is sufficient, the Attorney General shall prepare an indictmentand a list of proofs of evidence for the Minister and any other accomplicesor participants, and order that the case be referred to the Court as stipulatedin Article 18 of this Law. Where it transpires that no offence was committed, or that the facts alleged against the Minister are not true, or that there is not sufficient prima facie evidence to warrant referral for a formal investigation, the case shall be dismissed by reasoned decision. The Attorney-General shall serve the Minister with a copy of the indictment and a list of proofs of evidence at least ten days prior to the start of the trial, and notify the prosecution witnesses of the session timing, or announce him mutatis mutandis of the dismissal notice. The Prime Minister shall also be notified of the dismissalorder or the indictment decision and a list of proofs of evidence within forty-eight hours from the day of issue. Legal proceedings shall be initiated against the Minister by an ad hoc court. Such court shall comprise five Judges from the Appeal Court selected by the General Assembly of the Court for two years, and two further Judges shall be selected as reserve members to complete the Court in the event of the absence of one of the principal members or that one has been blocked. The purview of this Court shall be to prosecute the Minister, any other accomplices who do not hold ministerial posts. The court shall also be concerned with hearing indivisible offences associated to the offences therebefore. The Attorney-General and his assistantsfrom members of the Public Prosecution shall initiate the task of the prosecution before the court; theregister of the Court of Appeal shall undertake the post of registering this Court. The judgements of the Court formed according to the provisions of Article 18may not be appealedbut may be overturned by cassation.However, if the judgement was sentenced in absentia,it is permissible to appeal the sentence before the sameCourt followingthe usual procedures stated in the Code of Criminal Procedure. In all cases, the proceeds of the crime shall be confiscated from the convicted person by the Court. The forfeiture of a criminal prosecution for any offences committed by the Minister shall be calculated from the date of the Minister leaving his post. In the event of multiple defendants, the calculation of such duration shall start only from the date other defendants leave their posts. The provisions of the Criminal Procedure Code must be applicablein circumstances that are not provided for inthe provisionsofthis Chapter. The service of a Minister shall end for anyof the following reasons: 1. The reshuffling of the Council of Ministers in whole or in part; 2. Death; 3. Accepting the resignation of the Minister; 4. Removal from office. At the end of his service, the Minister shall receive a gratuity bonus for the entire duration of his ministerial service at the rate of twelve months’ salary for each year, provided that his term of office has been no fewer than two years, and this requirement may be waived at the Emir’s discretion. The basic salary of the Minister shall be the basis for calculating the gratuity benefit. In the eventof service terminating due to removal from office in accordance with Item 4 of Article 22, the bonus may be withheld, in whole or in part, in accordance with a decision of the Emir. At the end of his service the Minister shall receive a monthly pension equal to hisbasic salary, taking into account the following: 1. In the eventof death, the pension shall be paid to his beneficiaries; 2. In the eventof resignation, for entitlement to a pension the Minister must have spent at least two full years in office; 3. In the event of removal from office the pension may be withheld, in whole or in part, in accordance witha decision of the Emir. Where the service of the Minister was terminated and the conditions for entitlement to pension were not available according to the provisions of this Law, and he has had accrued previous service gratuity in anotherbody subject to the provisions of the Retirement and Pension Law, the Minister shall deserve a pension for that period, provided that he shall be committed to repay all due contributions, in accordance with the provisions of that Law. The Minister whose service has ended may not be nominated for membership of the Shura Council within five years of leaving office or work according to the provisions of the permanent Constitution, whichever is longer, except with a special dispensation from the Emir. The provisions stated in Chapters Threeand Sixof this Law shall be applied to those who areappointed to therank of Minister. The Council of Ministers shall issue the resolutions necessary for the implementation of the provisions of this Law. Any provision violating the provisions of this Law shall be rescinded. والمالية وذلك في حدود موازنة الوزارة. 4- إصدار قرارات تحديد رسوم الخدمات التي تؤديها الوزارة أو ما يتبع الوزير من الأجهزة الحكومية أو الهيئات والمؤسسات العامة، أو تعديل الرسوم أو إلغائها أو الإعفاء منها، بعد اعتمادها من مجلس الوزراء. 5- إصدار القرارات المتعلقة بشؤون موظفي الوزارة وفقاً لقانون إدارة الموارد البشرية المشار إليه. 6- الإشراف على إعداد مشروع الموازنة السنوية للوزارة. 7- اقتراح التشريعات المتعلقة بنشاط الوزارة. يستحق الوزراء المخصصات الشهرية والمزايا والمكافآت التي يصدر بتحديدها قرار أميري. تحدد إجازات الوزراء ومددها وشروطها بقرار من مجلس الوزراء. يكون سفر الوزراء في المهام الرسمية خارج الدولة بقرار من مجلس الوزراء، ويكون السفر في حالات الاستعجال بقرار من رئيس مجلس الوزراء. يستحق الوزير الموفد في مهمة رسمية خارج الدولة المخصصات المالية وبدل التمثيل على النحو الذي يحدده القرار الأميري المشار إليه في المادة ( 5 ) من هذا القانون. للأمير أن يعهد إلى أحد الوزراء بالقيام بعمل من يتغيب من الوزراء في إجازة أو مهمة رسمية بالخارج أو عند خلو منصبه. بالإضافة إلى الواجبات المنصوص عليها في الدستور والقانون، يجب على الوزير: 1- أداء مهام منصبه بالأمانة والشرف. 2- تنفيذ التعليمات والتوجيهات التي تصدر إليه من الأمير أو رئيس مجلس الوزراء في حدود القانون. 3- استهداف الصالح العام وإنكار المصالح الذاتية. بالإضافة إلى المحظورات المنصوص عليها في القانون، يحظر على الوزير: 1- مخالفة أحكام الدستور والقانون. 2- استغلال النفوذ للحصول على فائدة أو ميزة ذاتية لنفسه أو لغيره. 3- إفشاء الأسرار التي يطلع عليها بحكم منصبه ولو بعد انتهاء خدمته. 4- التدخل في شؤون العدالة بطريق مباشر أو غير مباشر. 5- التدخل في العمليات الانتخابية أو إجراءاتها بأي صورة من الصور بقصد التأثير في نتيجتها. 6- ممارسة النشاط التجاري إذا كان متعارضاً مع طبيعة العمل الذي يقوم به. تتم مساءلة الوزراء، وفقاً للإجراءات المنصوص عليها في هذا القانون، إذا ارتكبوا أثناء شغلهم المنصب إحدى الجرائم الآتية: 1- الجرائم المتعلقة بأمن الدولة الداخلي أو الخارجي. 2- الجرائم المتعلقة بالوظيفة العامة. 3- الجرائم المتعلقة بالانتخاب. وتطبق في شأنهم العقوبات المقررة قانوناً. تكون إحالة الوزير إلى التحقيق أو المحاكمة بقرار من الأمير بناءً على طلب رئيس مجلس الوزراء، ويترتب على الإحالة رفع الحصانة المقررة له إذا كان من أعضاء مجلس الشورى. يعتبر الوزير في إجازة براتب كامل من تاريخ إبلاغه بقرار الإحالة إلى التحقيق أو المحاكمة. ولا تنتهي الإجازة إلا بحفظ التحقيق أو صيرورة الحكم الصادر في الدعوى باتاً أو بانقضائها لأي سبب قبل صدور الحكم فيها. يتولى النائب العام التحقيق مع الوزير بمعاونة من يرى الاستعانة بهم من أعضاء النيابة العامة. إذا تبين بعد انتهاء التحقيق أن هناك جريمة من الجرائم المبينة في المادة ( 12 ) من هذا القانون، وأن الأدلة كافية، فعلى النائب العام أن يعد قرار الإتهام وقائمة بأدلة الثبوت بالنسبة للوزير وأي فاعلين آخرين أو شركاء، وأن يأمر بإحالة الدعوى إلى المحكمة المنصوص عليها في المادة ( 18 ) من هذا القانون. أما إذا أسفر التحقيق عن عدم وجود جريمة أو أن الوقائع المنسوبة للوزير لا صحة لها أو أن الأدلة عليها غير كافية، أمر بحفظ التحقيق بقرار مسبب. على النائب العام، إعلان الوزير بصورة من قرار الإتهام وقائمة أدلة الثبوت قبل بدء المحاكمة بعشرة أيام على الأقل، وإعلان شهود الإثبات بالجلسة المحددة، أو إعلانه بأمر الحفظ بحسب الأحوال. كما يجب إخطار رئيس مجلس الوزراء بصورة من أمر الحفظ أو قرار الإتهام وقائمة أدلة الثبوت خلال ثمان وأربعين ساعة من يوم صدوره. تتولى محاكمة الوزير محكمة خاصة تشكل من خمسة من القضاة بمكمة الاستئناف تختارهم الجمعية العامة للمحكمة لمدة سنتين، كما تختار اثنين آخرين كعضوين احتياطيين لإكمال تشكيل المحكمة في حالة غياب أحد الأعضاء الأصليين أو قيام مانع لديه. وتختص هذه المحكمة بمحاكمة الوزراء وأي فاعلين آخرين أو شركاء من غير الوزراء، كما تختص بنظر الجرائم المرتبطة ارتباطاً لا يقبل التجزئة بالجرائم المعروضة عليها. ويباشر النائب العام ومن يعاونه من أعضاء النيابة العامة مهمة الإدعاء أمام المحكمة، يتولى قلم كتاب محكمة الاستئناف أعمال كتاب هذه المحكمة. تكون الأحكام الصادرة من المحكمة المشكلة طبقاً لأحكام المادة السابقة غير قابلة للطعن فيها إلا بطريق التمييز، ومع ذلك، إذا صدر الحكم غيابياً جاز المعارضة فيه أمام ذات المحكمة بالإجراءات المعتادة المنصوص عليها في قانون الإجراءات الجنائية. وفي جميع الأحوال تقضي المحكمة بإلزام المحكوم عليه برد ما أفاده من الجريمة. الوزير عند نهاية خدمته مكافأة عن كامل مدة خدمته الوزارية بمعدل راتب إثني عشر شهراً عن كل سنة، بشرط ألا تقل مدة شغله للمنصب عن سنتين، ويجوز التجاوز عن هذا الشرط لأسباب يقدرها الأمير. ويعتبر الراتب الأساسي للوزير أساساً لحساب هذه المكافأة. وفي حالة انتهاء الخدمة بسبب الإعفاء من المنصب وفقاً للبند (4) من المادة السابقة، يجوز الحرمان من المكافأة، كلها أو بعضها، بقرار من الأمير. يستحق الوزير عند انتهاء خدمته، معاشاً شهرياً يعادل راتبه الأساسي، مع مراعاة ما يلي: 1- في حالة الوفاة، يصرف المعاش للمستحقين عنه. 2- في حالة الاستقالة، يشترط لاستحقاق المعاش، أن يكون قد قضى في المنصب سنتين كاملتين على الأقل. 3- في حالة الإعفاء من المنصب، يجوز الحرمان من المعاش، كله أو بعضه، بقرار من الأمير. إذا انتهت خدمة الوزير، ولم تتوافر بشأنه شروط استحقاق المعاش وفقاً لأحكام هذا القانون، وكانت له مدة خدمة سابقة في إحدى الجهات الخاضعة لأحكام قانون التقاعد والمعاشات، استحق معاشاً عن تلك المدة، على أن يلتزم بسداد جميع الاشتراكات المستحقة عليه، وفقاً لأحكام ذلك القانون. لا يجوز لمن انتهت خدمته من الوزراء، الترشيح لعضوية مجلس الشورى خلال السنوات الخمس التالية لتركه المنصب أو العمل بأحكام الدستور الدائم، أيهما أطول، إلا بإذن خاص من الأمير. تسري على من يعين بدرجة وزير الأحكام المنصوص عليها في الفصلين الثالث والسادس من هذا القانون. يصدر مجلس الوزراء القرارات اللازمة لتنفيذ أحكام هذا القانون. يلغى كل حكم يخالف أحكام هذا القانون. على جميع الجهات المختصة، كل فيما يخصه، تنفيذ هذا القانون. ويعمل به بعد ثلاثة أشهر من تاريخ نشره في الجريدة الرسمية.
