Law No. 14 of 2012 Concerning the Qatari Flag التشريعات | قانون رقم (14) لسنة 2012 بشأن العلم القطري

The national flag of the State of Qatar shall be, in terms of shape, design, colours, size, materials, configuration and performance requirements, according to the specifications set forth in Annex No. 1 attached hereto. The flag of the Emir shall be according to the specifications set forth in Annex No. 1 attached hereto. The form and specifications of the flags of the branches of the main units of the Armed Forces, the terms and conditions of use and the due respect and reverence towards them, shall be determined by a decision of the Supreme Commander of the Armed Forces. The Qatari flag shall be respected and treated with dignity as a symbol of the State, and must not be subjected to mistreatment in any way. where a Qatari flag is damaged, torn, worn-out, or its colours become faded, or where it appears in any way inappropriate, it shall not be flown, or displayed, or circulated. The use of the Qatari flag for purposes contrary to the original purpose of its use, or the addition of any words or pictures or designs thereto, or its use for commercial purposes, or as a brand or a part thereof, or for the purpose of advertising shall be prohibited. The protocol for the use of the Qatari flag, including the conditions and rules for flying the flag at the finial and at half-mast, shall be in accordance with the rules, conditions and procedures set forth in Annex No. 2 attached hereto. The Qatari flag shall be saluted by the military when it is flown at the finial and at half-mast, and during military parades. Without prejudice to any more severe penalty provided for by law, any person who deliberately insults the Qatari flag by damaging it, or removing it from where it is raised, or by any act or omission expresses contempt or hatred or lack of due respect for the flag shall be punished by imprisonment for a term not exceeding three (3) years and a fine not exceeding Two Hundred Thousand (200,000) Riyals, or either of them. Without prejudice to any more severe penalty provided for by legislation, any person who commits any of the acts listed in this Article shall be punished by imprisonment for a term not exceeding six months, and a fine not exceeding One Hundred Thousand (100,000) Riyals, or either of them: 1. Violation of any of the provisions of Articles 3 and 4 of this Law; 2. Sale, offering for sale, or trading in the Qatari flag in violation of the specifications set forth in this Law or in violation of any decisions issued in the implementation thereof; 3. Raising or flying at half-mast, or using the Qatari flag in violation of the provisions of this Law and its executive decisions. The Chairman of the Emiri Diwan shall determine the competent administrative unit in all matters relating to the application and implementation of the provisions of this Law and ensure compliance with its provisions. The concerned government agencies, each in its respective areas, in coordination with the competent administrative unit referred to in Article 10 shall issue licences for the manufacture, importing and sale of the Qatari flag in accordance with the specifications set forth in this Law. By a decision of the Emir , Annexes 1 and 2 attached hereto may be amended. The President of the Emiri Diwan shall issue the decisions necessary for the implementation of the provisions of this Law. All competent authorities, each in their respective jurisdiction, shall enforce this Resolution from the date of its publication in the Official Gazette . --- يكون العلم الوطني لدولة قطر، من حيث الشكل والتصميم والألوان والمقاسات والخامات والتكوين ومتطلبات الأداء، وفقاً للمواصفات المنصوص عليها في الملحق رقم (1) المرفق بهذا القانون. ويكون العلم الخاص بالأمير وفقاً للمواصفات المنصوص عليها في الملحق رقم (1) المشار إليه. يُحدد بقرار من القائد الأعلى للقوات المسلحة شكل ومواصفات أعلام الأفرع والوحدات الرئيسية للقوات المسلحة، وشروط وضوابط استعمالها، وما يجب أداؤه لها من الاحترام والتوقير. يجب احترام العلم القطري بوصفه رمزاً للدولة، والتعامل معه بكرامة، وعدم تعريضه للمهانة بأي طريقة كانت. يُحظر رفع أو عرض أو تداول العلم القطري، إذا كان تالفاً أو مستهلكاً أو باهت الألوان أو بأي طريقة غير لائقة. يحظر استخدام العلم القطري لأغراض تخالف الغرض الأصلي لاستخدامه، أو إضافة أية عبارات أو صور أو تصاميم عليه، أو استخدامه لأغراض تجارية، أو كعلامة تجارية أو جزء منها، أو بغرض الدعاية والإعلان. يكون بروتوكول استخدام العلم القطري، بما في ذلك أحوال وقواعد رفع وتنكيس العلم، وفقاً للضوابط والأوضاع والإجراءات المنصوص عليها في الملحق رقم (2) المرفق بهذا القانون. تؤدى التحية العسكرية للعلم القطري، من قبل العسكريين، أثناء رفع العلم على الساري أو إنزاله، وأثناء الاستعراضات العسكرية. مع عدم الإخلال بأية عقوبة أشد ينص عليها قانون آخر، يعاقب بالحبس مدة لا تجاوز ثلاث سنوات، وبالغرامة التي لا تزيد على مائتي ألف ريال، أو بإحدى هاتين العقوبتين، كل من أهان بإحدى طرق العلانية العلم القطري، بتمزيقه، أو إنزاله من مكان رفعه، أو بإتيان فعل أو الامتناع عن فعل يعبر عن الازدراء أو الكراهية أو عدم الاحترام الواجب للعلم. مع عدم الإخلال بأية عقوبة أشد ينص عليها قانون آخر، يعاقب بالحبس مدة لا تجاوز ستة أشهر، وبالغرامة التي لا تزيد على مائة ألف ريال، أو بإحدى هاتين العقوبتين، كل من ارتكب فعلاً من الأفعال التالية: 1- خالف أياً من أحكام المادتين ( 3 ) و( 4 ) من هذا القانون. 2- باع أو عرض للبيع أو تداول العلم القطري، بالمخالفة للمواصفات المنصوص عليها في هذا القانون والقرارات المنفذة له. 3- رفع أو نكس أو استخدم العلم القطري، بالمخالفة لأحكام هذا القانون والقرارات المنفذة له. يحدد رئيس الديوان الأميري الوحدة الإدارية المختصة بجميع الشؤون المتعلقة بتطبيق وتنفيذ أحكام هذا القانون والتأكد من الالتزام بأحكامه. تتولى الجهات الحكومية المعنية، كل فيما يخصه، بالتنسيق مع الوحدة الإدارية المختصة المشار اليها في المادة السابقة، إصدار تراخيص صناعة العلم القطري واستيراده وبيعه، وفقاً للمواصفات المنصوص عليها في هذا القانون. يجوز بقرار من الأمير تعديل الملحقين رقمي ( 1 )، ( 2 ) المرفقين بهذا القانون. يُصدر رئيس الديوان الأميري القرارات اللازمة لتنفيذ أحكام هذا القانون. على جميع الجهات المختصة، كل فيما يخصه، تنفيذ هذا القانون. ويُعمل به من تاريخ صدوره. ويُنشر في الجريدة الرسمية.
