In the application of the provisions of this Law, the following words and expressions shall have the meanings assigned to each, unless the context requires otherwise: “Captain” means the person responsible for commanding a ship. “Officer” means any member of the crew, besides the Captain, appointed in this capacity. “Navigation Officer” means any qualified officer in the navigation section. “Senior Navigation Officer” means a navigation officer that follows the Captain in rank and upon whose shoulders the burden of commanding the ship falls when the Captain is unable to do so. “Engineering Officer” means any qualified officer in the mechanical section. “Senior Engineering Officer” means the engineering officer responsible for the machinery that propels the ship. “Second Engineering Officer” means the engineering officer that follows the Senior Engineering Officer in rank and upon whose shoulders the responsibility for the machinery that propels the ship falls when the Senior Engineering Officer is unable to do so. “Propulsion Power” means the power defined in kilowatts on the certificate of registration of the ship or in any other official document. “Kilowatt” means the unit used to measure the ability of the machinery propelling the ship compared to mechanical horsepower. Each unit of mechanical horsepower is equivalent to 0.746 kilowatts. “High Seas” means the space of water of oceans and open seas, which is located outside the delimited areas. “Delimited Areas” means all the areas defined by the Minister by specific longitudes and latitudes, or by length of the voyage and travel distance from the shore. “Coastal areas” means the areas adjacent to the shore of the State the width of which is not more than 20 miles from the shore and which do not go beyond the political boundaries of the State. “Minister” means the Minister of Communications and Transport. The provisions of this Law shall apply to all ships that operate in maritime navigation and which are registered in the ports of the State or leased, equipped or not equipped, to natural or legal persons that enjoy its nationality, with the exception of: (a) Warships and government ships that are not allocated for commercial purposes. (b) Ships used by a public authority for non-commercial purposes. (c) Units operating within the ports. (d) Commercial ships and fishing vessels of less than two hundred tons of cargo in respect of the requirements for captains and navigation officers. (e) Commercial ships and fishing vessels with a propulsion power of less than 350 kilowatts in respect of the requirements for marine engineers. (f) Sailing ships, even if equipped with a backup engine. The Minister may determine by a resolution the rules governing maritime certificates that must be found on the ships provided for in paragraphs (d, e, and f) of this Article. Marine Certificates of Competence shall be divided into the following types: (a) Certificates of Competence for Captains and Navigation Officers: 1- High Seas Captain Certificate. 2- First Class Navigation Officer Certificate. 3- Second Class Navigation Officer Certificate. 4- Third Class Navigation Officer Certificate. 5- Fourth Class Navigation Officer Certificate. (b) Certificates of Competence for Engineering Officers: 1- First Class Engineering Officer Certificate. 2- Second Class Engineering Officer Certificate. 3- Third Class Engineering Officer Certificate. 4- Fourth Class Engineering Officer Certificate. The marine certificates of competence referred to in the preceding article shall entitle the bearer to occupy the positions stated below: a- High Seas Captain Certificate: Occupy the position of Captain on ships of whatever cargo or voyage. b- First Class Navigation Officer Certificate: 1- Occupy the position of Senior Navigation Officer on ships of whatever cargo or voyage. 2- Work as a Captain on ships that operate in delimited navigation areas and whose total registered cargo is less than (5000) five thousand tons. 3- Work as a Captain on ships that operate in coastal navigation areas and whose total registered cargo is less than (10,000) ten thousand tons. c- Second Class Navigation Officer Certificate: 1- Occupy the position of Second Navigation Officer on ships of whatever cargo or voyage. 2- Carry out the work as a Senior Navigation Officer on ships that operate in delimited areas and whose total registered cargo is less than (5000) five thousand tons. 3- Carry out the work as a Senior Navigation Officer on ships that operate in coastal areas and whose total registered cargo is less than (10,000) ten thousand tons. 4- Carry out the work as a Captain on ships that operate in delimited areas and whose total registered cargo is less than (1600) one thousand six hundred tons and on ships that operate in coastal areas and whose total registered cargo is less than (5,000) five thousand tons. d- Third Class Navigation Officer Certificate: 1- Occupy the position of Third Navigation Officer on ships of whatever cargo or voyage. 2- Carry out the duties of a Second Navigation Officer on ships that operate in delimited areas and whose total registered cargo is less than (5000) five thousand tons. 3- Carry out the duties of a Second Navigation Officer on ships that operate in coastal areas and whose total registered cargo is less than (10,000) ten thousand tons. 4- Carry out the duties of a Senior Navigation Officer on ships that operate in delimited areas and whose total registered cargo is less than (1600) one thousand six hundred tons and on ships that operate in coastal areas and whose total registered cargo is less than (5,000) five thousand tons. e- Fourth Class Navigation Officer Certificate: 1- Occupy the position of Fourth Navigation Officer on ships of whatever cargo or voyage. 2- Work as a Second Navigation Officer on ships that operate in delimited areas and whose total registered cargo is less than (1600) one thousand six hundred tons. 3- Work as a Second Navigation Officer on ships that operate in coastal areas and whose total registered cargo is less than (5000) five thousand tons. 4- Carry out the work of a Senior Navigation Officer on ships that operate in coastal areas and whose total registered cargo is less than (1600) one thousand six hundred tons. f- First Class Engineering Officer Certificate: Occupy the position of Senior Engineering Officer on ships of whatever propulsion power or voyage. g- Second Class Engineering Officer Certificate: 1- Occupy the position of Second Engineering Officer on ships of whatever propulsion power or voyage. 2- Carry out the work of Senior Engineering Officer on: - Ships that operate in high seas and whose propulsion power does not exceed (1000) one thousand kilowatts. - Ships that operate in delimited areas and whose propulsion power does not exceed (3000) three thousand kilowatts. - Ships that operate in coastal areas and whose propulsion power does not exceed (6000) six thousand kilowatts. h- Third Class Engineering Officer Certificate: 1- Occupy the position of Third Engineering Officer on ships of whatever propulsion power or voyage. 2- Carry out the work of a Second Engineering Officer on ships that operate in coastal areas and whose propulsion power does not exceed (6000) six thousand kilowatts. 2- Carry out the work of a Senior Engineering Officer on ships that operate in coastal areas and whose propulsion power does not exceed (3000) three thousand kilowatts. i- Fourth Class Engineering Officer Certificate: 1- Occupy the position of Fourth Engineering Officer on ships of whatever propulsion power or voyage. 2- Work as a Third Engineering Officer on ships that operate in delimited areas and whose propulsion power does not exceed (3000) three thousand kilowatts. 2- Work as a Second Engineering Officer on ships that operate in coastal areas and whose propulsion power does not exceed (3000) three thousand kilowatts. . In all instances in which a navigation officer is authorized to carry out the duties of a captain, or in which a marine engineer is authorized to carry out the duties of a Senior Engineer, the Minister shall regulate by means of a resolution the conditions and manner of obtaining such authorization. No person may carry out the duties of the positions contained in Articles 4 and 5 of this Law without bearing the certificate of competence prescribed for the same, unless due to force majeure or upon the prior authorization of the Minister and in the circumstances determined by him. It is a requirement for the validity of the authorization referred to in the preceding paragraph, that a person only be authorized to carry out duties of a position directly higher than the position he may occupy under the certificate of competence held by him, and that this be for a single voyage. The captain of every ship must compensate at the earliest opportunity for the shortage that occurs during the voyage in respect of the number of navigation officers or marine engineers required by this Law to be present on every ship, even if this shortage was as a result of death, accident or any other reason. The marine certificates stipulated in Article 3 of this Law shall be granted by the Minister. The Minister shall determine by a resolution: a- The rules and conditions for obtaining such certificates including the minimum academic level necessary for gaining the same and the length of maritime service. b- The maritime institutes approved by the State, passing the exams of which is a prerequisite to obtain such certificates. c- Certificates equivalent to marine certificates of competence issued by a foreign country. The Minister shall determine by a resolution the rules and conditions for granting the certificates of competence stipulated in Article 3 Paragraph “b” to graduates of the appropriate divisions of recognized engineering colleges and higher institutes. The Minister shall determine by a resolution the rules and conditions for granting the certificates of competence stipulated in Article 3 of this Law to naval officers and navigation officers and engineers who have served in government vessels and ships of public authorities used for non-commercial purposes. The Department of Ports shall monitor the fulfillment of certificates of competence by ships found in the ports of the State, according to the following: 1- In respect of ships registered in the ports of the State or leased, equipped or not equipped, to natural or legal persons that enjoy its nationality: The numbers and types of certificates of competence contained in Schedules (a) and (b) attached to this Law must be found. 2- In respect of foreign ships: The certificates of competence in accordance with the international treaties and conventions in force in this regard must be found. Representatives of the Department of Ports shall have the right of entry in any ship to inspect it and stop it from traveling if it breaches the provisions of this Article or to inform the consul of the country the ship falls under, as the case may be. Without prejudice to any more severe sanction provided for by the Law of Sanctions or any other law, a sanction of imprisonment not exceeding one year, and a fine of not more than one thousand riyals, or either of these sanctions, shall be imposed on any owner, operator or fitter of a ship who contravenes any of the provisions of Articles 4 , 7 and 11/1 of this Law. Without prejudice to any more severe sanction provided for by the Law of Sanctions or any other law, a sanction of imprisonment not exceeding two years, and a fine of not more than 2000 riyals, or either of these sanctions, shall be imposed on any person who fraudulently or by using forged papers occupies one of the positions provided for in Article 4 in a ship subject to the provisions of this Law. Any provisions not regulated by this Law shall be regulated by a decree to achieve its objectives. The Minister shall issue the resolutions and bylaws necessary to give effect thereto. Any provision that contradicts the provisions of this law shall be repealed. All relevant authorities, each within its own jurisdiction, shall implement this law which shall be effective from the date of its publication in the Official Gazette. --- في تطبيق أحكام هذا القانون، يكون للمصطلحات الآتية المعاني الموضحة قرين كل منها، وذلك ما لم يقتض السياق معنى آخر: الربان: الشخص الذي يتولى قيادة السفينة. ضابط: أي فرد من أفراد الطاقم، غير الربان، يعين بهذه الصفة. ضابط ملاحة: كل ضابط مؤهل في قسم الملاحة. كبير ضباط الملاحة: ضابط الملاحة الذي يلي الربان في الرتبة ويقع على عاتقه عبء قيادة السفينة عند عدم قدرة الربان على القيادة. ضابط مهندس: كل ضابط مؤهل في قسم الماكينات. كبير الضباط المهندسين: الضابط المهندس المسئول عن الآلات الدافعة للسفينة. ضابط مهندس ثان: الضابط المهندس الذي يلي كبير الضباط المهندسين في الرتبة، وتقع على عاتقه مسئولية الآلات الدافعة للسفينة في حالة عدم قدرة كبير الضباط المهندسين. القوة الدافعة: القوة المقدرة بالكيلووات في شهادة تسجيل السفينة أو في أي وثيقة رسمية أخرى. الكيلووات: الوحدة المستخدمة لقياس قدرة الآلات الدافعة للسفينة مقارنة بالحصان الميكانيكي، ويعادل كل حصان ميكانيكي 0,746 كيلووات. أعالي البحار: الحيز المائي من المحيطات والبحار المفتوحة الذي يقع خارج إطار المناطق المحدودة. المناطق المحدودة: جميع المناطق التي يحددها الوزير بخطوط طول وعرض معينة أو بطول الرحلة ومدى بعد خط السير عن الساحل. المناطق الساحلية: المناطق المجاورة لساحل الدولة ولا يزيد عرضها عن 20 ميلاً من الساحل ولا يتجاوز الحدود السياسية للدولة. الوزير: وزير المواصلات والنقل. تسري أحكام هذا القانون على جميع السفن التي تعمل في الملاحة البحرية وتكون مسجلة في مواني الدولة أو مؤجرة، مجهزة أو غير مجهزة، لأشخاص طبيعيين أو معنويين يتمتعون بجنسيتها، ويستثنى من ذلك: (أ) السفن الحربية والسفن الحكومية غير المخصصة لأغراض تجارية. (ب) السفن التي تستخدمها إحدى السلطات العامة لأغراض غير تجارية. (جـ) الوحدات العاملة بداخل المواني . (د) السفن التجارية وسفن الصيد التي تقل حمولتها عن مائتي طن وذلك بالنسبة للاشتراطات الخاصة بالربابنة وضباط الملاحة. (هـ) السفن التجارية وسفن الصيد التي تقل قدرة آلاتها المسيرة عن 350 كيلووات، وذلك بالنسبة للاشتراطات الخاصة بالمهندسين البحريين. (و) السفن الشراعية حتى لو كانت مجهزة بمحرك آلي مساعد. وللوزير أن يحدد بقرار منه القواعد المنظمة للشهادات البحرية الواجب توافرها على السفن المنصوص عنها في الفقرات (د، هـ، و) من هذه المادة. تنقسم شهادات الأهلية البحرية إلى الأنواع التالية: (أ) شهادات الأهلية للربابنة وضباط الملاحة: 1- شهادة ربان أعالي البحار. 2- شهادة ضابط ملاحة من الدرجة الأولى. 3- شهادة ضابط ملاحة من الدرجة الثانية. 4- شهادة ضابط ملاحة من الدرجة الثالثة. 5- شهادة ضابط ملاحة من الدرجة الرابعة. (ب) شهادات الأهلية للضباط المهندسين: 1- شهادة ضابط مهندس من الدرجة الأولى. 2- شهادة ضابط مهندس من الدرجة الثانية. 3- شهادة ضابط مهندس من الدرجة الثالثة. 4- شهادة ضابط مهندس من الدرجة الرابعة. تخول شهادات الأهلية البحرية المشار إليها في المادة السابقة لحاملها شغل الوظائف المبينة قرين كل منها: أ- شهادة ربان أعالي البحار: شغل وظيفة ربان على السفن أياً كانت حمولتها أو الرحلة القائمة بها. ب- شهادة ضابط ملاحة من الدرجة الأولى: 1- شغل وظيفة كبير ضباط الملاحة على السفن أياً كانت حمولتها أو الرحلة القائمة بها. 2- العمل كربان على سفن تعمل في مناطق ملاحية محدودة وتقل حمولتها الكلية المسجلة عن (5000) خمسة آلاف طن. 3- العمل كربان على سفن تعمل في مناطق الملاحة الساحلية وتقل حمولتها الكلية المسجلة عن (10,000) عشرة آلاف طن. جـ- شهادة ضابط ملاحة من الدرجة الثانية: 1- شغل وظيفة ضابط ملاحة ثان على السفن أياً كانت حمولتها أو الرحلة القائمة بها. 2- القيام بأعمال كبير ضباط الملاحة على السفن التي تعمل في المناطق المحدودة، وتقل حمولتها الكلية المسجلة عن (5000) خمسة آلاف طن. 3- القيام بأعمال كبير ضباط الملاحة على السفن التي تعمل في المناطق الساحلية وتقل حمولتها الكلية المسجلة عن (10,000) عشرة آلاف طن. 4- العمل كربان على السفن التي تعمل في المناطق المحدودة وتقل حمولتها الكلية المسجلة عن (1600) ألف وستمائة طن، والسفن التي تعمل في المناطق الساحلية وتقل حمولتها الكلية المسجلة عن (5000) خمسة آلاف طن. د- شهادة ضابط ملاحة من الدرجة الثالثة: 1- شغل وظيفة ضابط ملاحة ثالث على السفن أياً كانت حمولتها أو الرحلة القائمة بها. 2- القيام بمهام ضابط ملاحة ثان في السفن التي تعمل في المناطق المحدودة وتقل حمولتها الكلية المسجلة عن (5000) خمسة آلاف طن. 3- القيام بمهام ضابط ملاحة ثان في السفن التي تعمل في المناطق الساحلية وتقل حمولتها الكلية المسجلة عن (10,000) عشرة آلاف طن. 4- القيام بمهام كبير ضباط الملاحة في السفن التي تعمل في المناطق المحدودة وتقل حمولتها الكلية المسجلة عن ألف وستمائة طن، والسفن التي تعمل في المناطق الساحلية وتقل حمولتها الكلية المسجلة عن (5000) خمسة آلاف طن. هـ- شهادة ضابط ملاحة من الدرجة الرابعة: 1- شغل وظيفة ضابط ملاحة رابع على السفن أياً كانت حمولتها أو الرحلة القائمة بها. 2- العمل كضابط ملاحة ثان على السفن التي تعمل في المناطق المحدودة، وتقل حمولتها الكلية المسجلة عن (1600) ألف وستمائة طن. 3- العمل كضابط ملاحة ثان على السفن التي تعمل في المناطق الساحلية، وتقل حمولتها الكلية المسجلة عن (5000) خمسة آلاف طن. 4- القيام بأعمال كبير ضباط الملاحة على السفن التي تعمل في المناطق الساحلية، وتقل حمولتها الكلية المسجلة عن (1600) ألف وستمائة طن. و- شهادة ضابط مهندس من الدرجة الأولى: شغل وظيفة كبير الضباط المهندسين على السفن أياً كانت قوة آلاتها الدافعة أو الرحلة القائمة بها. ز- شهادة ضابط مهندس من الدرجة الثانية: 1- شغل وظيفة ضابط مهندس ثان على السفن أياً كانت قوة آلاتها الدافعة أو الرحلة القائمة بها. 2- القيام بأعمال كبير الضباط المهندسين على: - السفن التي تعمل في أعالي البحار ولا تزيد قوة آلاتها الدافعة عن (1,000) ألف كيلووات. - السفن التي تعمل في المناطق المحدودة ولا تزيد قوة آلاتها الدافعة عن (3000) ثلاثة آلاف كيلووات. - السفن التي تعمل في المناطق الساحلية ولا تزيد قوة آلاتها الدافعة عن (6000) ستة آلاف كيلووات. ح- شهادة ضابط مهندس من الدرجة الثالثة: 1- شغل وظيفة ضابط مهندس ثالث على السفن أياً كانت قوة آلاتها الدافعة أو الرحلة القائمة بها. 2- القيام بأعمال ضابط مهندس ثان على السفن التي تعمل في المناطق الساحلية ولا تزيد قوة آلاتها الدافعة عن (6000) ستة آلاف كيلووات. 3- القيام بأعمال كبير الضباط المهندسين على السفن التي تعمل في المناطق الساحلية ولا تزيد قوة آلاتها الدافعة عن (3000) ثلاثة آلاف كيلووات. ط- شهادة ضابط مهندس من الدرجة الرابعة: 1- شغل وظيفة ضابط مهندس رابع على السفن أياً كانت قوة آلاتها الدافعة أو الرحلة القائمة بها. 2- العمل كضابط مهندس ثالث على السفن التي تعمل في المناطق المحدودة ولا تزيد قوة آلاتها الدافعة عن (3000) ثلاثة آلاف كيلووات. 3- العمل كضابط مهندس ثان على السفن التي تعمل في المناطق الساحلية ولا تزيد قوة آلاتها الدافعة عن (3000) ثلاثة آلاف كيلووات. في جميع الحالات التي يرخص فيها لضابط ملاحة بالقيام بمهام ربان، أو التي يرخص فيها لمهندس بحري بالقيام بمهام كبير المهندسين، ينظم الوزير بقرار منه شروط وكيفية الحصول على هذا الترخيص. لا يجوز قيام أي شخص بواجبات من الوظائف المنصوص عليها في المادتين الرابعة و الخامسة من هذا القانون دون أن يحمل شهادة الأهلية المقررة لها، ما لم يكن ذلك لقوة قاهرة أو بناء على إذن سابق من الوزير ولظروف يقدرها. ويشترط لصحة الإذن المشار إليه في الفقرة السابقة، ألا يؤذن للشخص بغير القيام بمهام وظيفة أعلى مباشرة من الوظيفة التي يجوز له شغلها بموجب الشهادة الأهلية التي يحملها، وعلى أن يكون ذلك لرحلة واحدة. على ربان كل سفينة أن يعوض في أقرب فرصة النقص الذي يطرأ أثناء الرحلة بالنسبة لعدد ضباط الملاحة أو المهندسين البحريين الذين يوجب هذا القانون تواجدهم على كل سفينة، ولو كان هذا النقص نتيجة لوفاة أو لحادث تصادم أو لأي سبب آخر. تمنح الشهادات البحرية المنصوص عليها في المادة (3) من هذا القانون من الوزير، ويحدد الوزير بقرار منه: أ- قواعد وشروط الحصول على تلك الشهادات بما في ذلك الحد العلمي الأدني اللازم لنيلها ومدة الخدمة البحرية. ب- المعاهد البحرية المعتمدة من الدولة التي يعتبر النجاح في امتحاناتها شرطاً لازماً للحصول على تلك الشهادات. جـ- الشهادات المعادلة للشهادات الأهلية البحرية التي تصدر من الدولة الأجنبية. يحدد الوزير بقرار منه قواعد وشروط منح شهادات الأهلية المنصوص عليها في المادة رقم (3) فقرة "ب" لخريجي الأقسام المناسبة من الكليات والمعاهد العليا الهندسية المعترف بها. يحدد الوزير بقرار منه قواعد وشروط منح الشهادات المنصوص عليها في المادة رقم (3) من هذا القانون لضباط القوات البحرية ولضباط الملاحة والمهندسين ممن خدموا في سفن الحكومة وسفن السلطات لعامة المستخدمة لأغراض غير تجارية. تقوم إدارة الموانيء بمراقبة استيفاء السفن التي تتواجد في موانيء الدولة لشهادات الأهلية طبقاً لما يلي: 1- بالنسبة للسفن المسجلة في موانيء الدولة أو المؤجرة، مجهزة أو غير مجهزة، لأشخاص طبيعيين أو معنويين يتمتعون بجنسيتها: توافر أعداد وأنواع شهادات الأهلية الواردة في الجدولين (أ)، (ب) الملحقين بهذا القانون. 2- بالنسبة للسفن الأجنبية: توافر شهادات الأهلية طبقاً للمعاهدات والاتفاقيات الدولية المعمول بها في هذا الشأن. ولمندوبي إدارة الموانيء حق الدخول في أية سفينة للتفتيش عليها وإيقافها عن السفر عند إخلالها بما جاء بهذه المادة أو إبلاغ قنصل الدولة التي تتبعها السفينة حسب الأحوال. مع عدم الإخلال بأية عقوبة أشد ينص عليها قانون العقوبات، أو أي قانون آخر، يعاقب بالحبس مدة لا تجاوز سنة وبغرامة لا تجاوز ألف ريال أو بإحدى هاتين العقوبتين كل مالك أو مستغل أو مجهـز لسفينة يخالف أي حكم من أحكام المواد ( 4 )، ( 7 )، ( 11/1 ) من هذا القانون. مع عدم الإخلال بأية عقوبة أشد ينص عليها قانون العقوبات أو أي قانون آخر يعاقب بالحبس مدة لا تجاوز سنتين وبغرامة لا تجاوز 2000 ريال أو بإحدى هاتين العقوبتين كل شخص توصل بطريق الغش أو باستعمال أوراق مزورة إلى شغل إحدى الوظائف المنصوص عليها بالمادة رقم (4) في سفينة تخضع لأحكام هذا القانون. ينظم بمرسوم ما لم ينظمه هذا القانون من أحكام تحقيقاً لأغراضه. ويصدر الوزير القرارات واللوائح اللازمة لتنفيذه. يلغى كل حكم آخر يخالف أحكام هذا القانون. على جميع الجهات المختصة، كل فيما يخصه، تنفيذ هذا القانون. ويعمل به من تاريخ نشره في الجريدة الرسمية.
