All competent authorities, each within its jurisdiction, shall implement the present Law, which shall take effect one year from the date of its publication in the Official Gazette In applying the provisions of this Law, each of the following words and expressions shall have the meanings assigned thereto, unless the context requires otherwise: “Council” means the Supreme Judicial Council (SJC). “Judges” means the President, Vice-President, and Judges of the Court of Cassation; the Presidents, Vice-Presidents, and Judges of the Court of Appeals; and the Presidents and Judges of the Court of First Instance. “Year” means the calendar year. Judges are independent and shall not be subject to removal from office except in accordance with the provisions of this Law. The independence of the judiciary shall be guaranteed and no inappropriate or unwarranted interference with the judicial process shall be permitted. The courts budget shall be part of the State General Budget. The Courts shall comprise: the Court of Cassation the Court of Appeal the Court of First Instance Each shall have jurisdiction to deal with and make pronouncements on legal matters brought before it and to administer justice within its defined area of responsibility in accordance with the law. The courts shall be based principally in Doha. By a resolution of the Council: Departments of Courts of First Instance may be created in other cities; and Hearings may take place at locations away from the home courts. The Court of Cassation shall be composed of a President and a sufficient number of Vice-Presidents and Judges, and it shall be composed of Circuits to hear appeals on the interpretation of the provisions and measures enacted by law. Each Circuit shall comprise a President or Vice-President or Senior Judge of the Court. Circuits may be established, and terms of reference defined, by resolution of the Council. The President of the Court shall, based on a proposal of the General Assembly, appoint the members to the Circuits by resolution. Judgments shall be issued by five members. The senior Vice-President of the Court shall replace the President during his absence. Where a Circuit of the Court of Cassation considers reversal of a legal principle established by a prior ruling of its own or of another Circuit, or is confronted by a conflict of jurisdiction, it shall refer the case to the Full Court for adjudication. The Court of Cassation shall have a technical or professional office, composed of a president and a sufficient number of judges. The establishment of the circuits' jurisdictions, and definitions of terms of reference thereof, shall be made by resolution of the Council. The allocation of the members between the different Circuits shall be made by resolution of the President of the Court based on the proposal by the General Assembly. Judgments shall be issued by three members. The most senior of the presidents shall take the place of the President of the Court in his absence. The Council shall, based on the proposal of the President of the Court of First Instance, establish one or more circuits. The judgments of such circuits shall be issued by an individual judge in cases which the law shall specify. Arabic shall be the language of the Courts. It shall be permitted for the Court, mutatis mutandis , to hear the statements of parties or witnesses who are unable to speak Arabic by way of an interpreter, who shall swear under oath to interpret honestly and truthfully. If the interpreter is an employee of the Courts, it shall be sufficient for him to swear the oath once at the start of his appointment. Each Court shall have a General Assembly. Each Assembly shall convene at the invitation of the President of the Court, or anyone acting on his behalf, whether ex mero motu or in accordance with a request by at least one third of the members, to consider the following issues: The formation of circuits. The allocation of cases to the different circuits. Specifying the number of hearings and the dates thereof. Organizing the work during the judicial vacation, and defining the issues to be considered. Other issues relating to the internal affairs of the Court. Any other issue which the law ascribes to it or which the Council assigns to it. The General Assembly shall be permitted to delegate certain of its competences to the President of the Court. The General Assembly of the Court shall consist of all of the members thereof, and the President of the Court shall preside over the Assembly. The Assembly shall not be deemed valid unless more than half of the members are present. If this quorum is not attained, the Assembly may validly convene after the lapse of one hour from the time appointed if at least one third of the members are present. Where this quorum is not attained, the General Assembly may validly reconvene within one week regardless of the number of members present. Resolutions of the General Assembly shall be issued by majority vote of the members present. In the event of a tie the President shall cast the deciding vote. The minutes of the General Assembly shall be certified in the record and shall be signed by the President and the Secretary. The Council shall strive to ensure the independence of the judiciary and, in addition to the other powers specified in this Law, shall be responsible for the following: Expressing its opinion on issues relating to the judiciary, and studying and proposing legislation for the development of the judicial system. Expressing its opinion on the appointment, promotion, transfer and assignment, secondment and retirement of judges in accordance with the provisions of this Law. Considering grievances relating to judicial affairs. The Council's resolutions on these matters shall be final. Other functions prescribed by any other law, and issues which the President of the Council shall deem fit for consideration. The Council shall convene an ordinary meeting at least once every month and an extraordinary meeting whenever the situation requires. The Council shall establish rules for governing its meetings and exercising its powers. Any person considered for judicial office shall: be either a Qatari citizen or a citizen of another Arab State; be fully competent; hold a degree from a recognised university either in law, or in Shari'ah and law, or Shari'ah or its equivalent; not have been convicted of an offence or misdemeanour involving moral turpitude or dishonesty, even if he has been rehabilitated; not have been dismissed from service by a disciplinary determination; be of good standing and reputation; and notbe younger than twenty-five years if appointed to the Court of First Instance, and not younger than thirty-eight years if appointed to the Court of Appeal. Taking into account the provisions of the preceding Article, the following conditions shall apply to the appointment of judicial officers: A person appointed as Judge of First Instance must have spent at least three years in the role of judicial assistant and successfully passed the training schedule in accordance with the provisions of Law No. 8 of 2001. A person appointed as President of the Court of First Instance must have spent at least five years as Judge of First Instance. A person appointed as Judge of the Court of Appeal must have spent at least six years as President of the Court of First Instance A person appointed as Vice-president of the Court of Appeal must have spent at least six years as Judge of the Court of Appeal. A person appointed as President of the Court of Appeal must have spent at least five years as Vice-president of the Court of Appeal. A person appointed as Judge of the Court of Cassation must have spent at least five years as President of the Court of Appeal. A person appointed as Vice-president of the Court of Cassation must have spent at least five years as Judge of the Court of Appeal. It shall be permitted, if deemed necessary, to reduce by as much as half the time required for appointment to the offices of Judge and Vice-president of the Court of Cassation during the first five years after the coming into force of this law. The promotion of judges shall be on the basis of seniority. In the case of promotion to a higher office, an additional assessment of competence of at least “above average” shall be made of the candidate. Competence shall be defined according to the judicial inspection reports on judicial activities, in accordance with the provisions of this Law and the resolutions implementing it. Promotions shall not be permitted until after the expiry of the periods prescribed in the preceding Article. The appointment of the President of the Court of Cassation shall be made by order of the Emir. The appointed President shall have the rank of minister. The appointment of the rest of the judiciary shall be made by decree, upon the proposal by the Council. Seniority of judges shall be defined according to the date of the decree appointing them, unless this decree specifies another date. Where more than one judge is appointed in one decree, the seniority of one against the other shall be according to the order in which they are named in the decree. Appointment to judicial office of the following categories of persons from outside the judiciary shall be permitted: Former judges of the Courts. Members of the public prosecutor's office. People engaged in legal work comparable to judicial work in the Ministries and other government services and theological and public institutions. The Council shall issue a resolution defining comparable work. Lawyers. Members of organisations teaching law, and Shari'ah and law, in the recognised universities. Such appointment, and the specification of their degrees and seniority, shall be in accordance with the requirements issued by resolution of the Council. The salaries and allowances of judges shall be determined by resolution of the Emir, but no resolution may permita salary of a personal nature or exceptionaltreatment of any kind. No appointment of a judge outside the Courts shall be permitted except for undertaking judicial or legal work. The appointment shall be by resolution of the Council, renewable for a period of one year if the appointment is temporary and for a maximum of four years if the appointment is permanent. No judge shall be permitted, without the consent of the Council, to act as an arbitrator, whether paid or unpaid, in a dispute submitted or not submitted to Court. Appointment of a judge to act as arbitrator in a dispute involving any governmental or public authority or institution shall be permitted with the prior consent of the Council. Secondment of a judge to a foreign government or international organization shall be permitted by decree with the consent of the Council. The period of the secondment shall not exceed four consecutive years unless the Emir deems an extension of this period to be in the public interest. Judicial vacations shall begin on the first day of the month of July and end on the last of day of the month of September in each year. The General Assembly shall organise leave schedules for judges and arrange coverage for work required to be done during judicial vacations. The leave period shall not exceed sixty days for judges and forty-nine days for judicial assistants. A judge may be granted sick leave for a period not exceeding one year at full salary, a second year at half salary, and a third year at quarter salary. A judge may use up his allowance of annual leave in addition to his entitlement to sick pay. A judge cannot resume work after the period of leave established in this article. Where a competent medical committee rules that he is unable for health reasons to carry out his duties, he shall be transferred into retirement by decree based on the request of the Council. Before taking office, a judge shall swear the following solemn oath: “I swear by Almighty God that I shall judge between people according to justice, and respect the provisions of the Islamic Shari'ah and the laws of the homeland.” The swearing of the oath by the President of the Court of Cassation shall be before the Emir, and by the rest of the judiciary before the Council. Judges shall maintain standards of decency and honour, both within their work and outside of it, and shall be committed to protecting their reputations and their careers and to preventing anything which might affect their honesty or call into question their integrity. Judges may not engage in business or in any action, whether paid or unpaid, that is inconsistent with the independence and honour of the judiciary. The Council may decide to prevent judges from engaging in any act which conflicts with the nature and duties of the office and the good performance thereof. Judges shall be prohibited from expressing their political views or engaging in political activities. Judges may not stand for election to legislative or municipal councils while they are in office. Except where contained in a written or oral judgment, judges may not express an opinion on the dispute before them or divulge any part of their deliberations. No judge related to another by blood or marriage up to the fourth degree may serve in the same Chamber. No judge related to any party to a dispute, or their representative, by blood or marriage up to the fourth degree may hear the dispute. Judges may not hear any case in which they have a direct or indirect personal interest or a relationship with either party which is in conflict with their judicial duties. Judges may not accept, nor may they authorise a family member to accept, a gift from litigants or their agents or their families. A department for judicial oversight, attached to the Council, shall be established with one Vice-president of the Court of Cassation as its head and a sufficient number of judges of the Court of Cassation as well as presidents, vice-presidents and judges of the Court of Appeal as its members. It shall have authority to inspect the work of the vice-presidents and judges of the Court of Appeal, and the Presidents and judges of the Court of First Instance, and to check and investigate complaints brought against judges relating to the execution of their duties or to their behaviour. The Council shall issue a resolution appointing the President and members of the department for a period of one year, which shall be renewable; and the Council shall also issue by resolution the rules and procedures for judicial investigations. The inspections referred to in the preceding Article shall be conducted at least once every two years, and an assessment of competence shall be made according to a grade of (a) adequate; or (b) above average; or (c) average; or (d) less than average. The department shall inform the judge of the contents of his service file and shall provide him with a copy of the inspection report. A judge may appeal against the findings of the report to the Council within fifteen days of receipt thereof. The Council shall decide the appeal after reading the papers and hearing statements from the appellant, and its resolution regarding the judge's competence shall be final. Where a judge is rated in consecutive assessments at the grade of “below average”, the Council shall resolve, on the proposal of the Judicial Inspection Department, to transfer him either into retirement or to another non-judicial office and the judge's authority shall cease from the date specified in the Council's decree. In the case of transfer to non-judicial office, the transferred judge shall retain his salary in a personal capacity, even if this exceeds the limit for the salary level of the office to which he was transferred. Judges may be held accountable for disciplinary reasons in the following circumstances: If they have breached the duties of their office or its requirements. If they have fallen below the standard specified for the honour and prestige of the judiciary. If they have brought on themselves suspicion and mistrust. The Disciplinary Council, comprised of the President of the Council as its president and the two most senior members as its other members, shall be responsible for the disciplining of judges. Where the office of one of the members is vacant, or he is absent, or his presence is prevented, the next person of seniority shall replace him. No person who supervised or participated in the investigation of a judge's conduct shall be permitted to adjudicate in the disciplinary proceedings. No disciplinary action may be instituted without the permission of the President of the Council. Disciplinary action shall be carried out by a member of the Court of Cassation or investigatory department, whom the President of the Council shall appoint. A disciplined judge may appeal against the disciplinary action. The appeal shall be presented by the President of the Judicial Inspection Department, or someone appointed by him, and heard by the Disciplinary Council. The disciplinary procedure shall commence with a written charge and supporting evidence served on the judge, who shall be summoned on fifteen days' notice to appear before the Disciplinary Council for trial. Once the trial proceedings are under way, the Council may decide after hearing the judge's statement to suspend all of the work of his office or to put him on compulsory leave until the end of the trial, and it may at any time reconsider its order of suspension or leave. The order of suspension or leave shall not entail the deprivation of salary, allowances or other financial consequences, either in whole or in part. The disciplinary process shall terminate on the voluntary resignation of the judge, but the resignation shall not exonerate the judge from any criminal or civil liability that may arise due to the disciplinary action. The Disciplinary Council may take such measures as it deems necessary in its investigations and delegates one of its members to undertake the same. The Council and the appointed member shall have the authority of the ordinary courts in relation to the hearing of testimony from any witnesses. Disciplinary hearings shall be conducted in private. Judgment shall be delivered after the prosecution and defence have been heard. The judge may act in his own defence or be represented by a member of the judiciary. Where either the judge or his representative is absent, judgment may be delivered in their absence after the truthfulness of the allegations has been fully and properly determined. T he judgment shall give the reasons on which it is based, and it shall be final and not subject to appeal. The Council shall be furnished with a copy of the judgment immediately after it is issued. Disciplinary sanctions which can be imposed on judges are: Warning. Censure. Dismissal. The Council shall send to the judge a registered letter enclosing the disciplinary judgment against him. The sanction imposed under Article 57 shall be recorded in the service file of the judge. The authority of a judge sanctioned with a dismissal shall cease from the date of judgment, unless the judgment specifies a date or he has been put on compulsory leave. A n order shall be issued implementing the sanction of dismissal, and both the judgment and the order shall be recorded in the service file of the judge. A judgment ordering the dismissal of a judge shall have no effect on his salary or right to a pensionor reward. Save where a judge is caught inflagrante delicto in the commission of an offence, he may not be arrested, nor may any investigatory measures be taken against him, without the prior permission of the Council. In all cases, the Council shall be authorized to consider the precautionary incarceration of the judge or renewal thereof. The Council may, either ex mero motu or on a request by the President of the Court of Cassation or on a resolution of the General Assembly of the Court, order the suspension of the judge from duty during the investigation into the alleged offence. Such suspension from duty shall not suspend the judge's salary or allowances, or stop payment of the same, entirely or in part, for the duration of the period of his suspension. The following shall terminate the authority of judges: Death. Resignation. Reaching retirement age. Dismissal by virtue of disciplinary action. Dismissal by resolution of the Emir in the public interest. Being placed into retirement, or transferred to other non-judicial duties. The resignation of a judge shall be valid from the date of its submission, if made unconditionally and without restrictions. Resignation shall not result in the deprivation of the judge's pension or bonus. The retirement age for judges shall be seventy years. After reaching the age of sixty, a judge may request transfer into retirement. The request shall be deemed acceptable on the date of submission. The service of judges may be extended beyond retirement age, by decree and on the proposal of the Supreme Judicial Council, for a period or periods not exceeding five years on aggregate, with each period not being less than one judicial year. In every case, if the judge reaches retirement age during the period from the first day of October to the last day of June in the following year, his authority shall continue until the end of the period. The Court of First Instance shall employ a sufficient number of judicial assistants, and judges shall supervise their training and assignment of work as set out in this Law. Persons appointed as judicial assistants shall be Qatari nationals, shall fulfil the requirements specified in Article 27 of this Law, and shall not be younger than 21 years of age. A judicial assistant shall be appointed by resolution of the President of the Council of Ministers, based on the proposal of the Council. The first year of employment as a judicial assistant shall be probationary, renewable for a similar period. Where the judicial assistant qualifies for appointment as a judge, the appointment shall take precedence over the appointment of all others. The judicial assistant shall, before assuming office as a judge, swear the oath prescribed by Article 40 of this Law before the Head of the Council. Judicial assistants shall have authority for the following: Case processing and coordination of judicial activities. Preparing applications for orders on execution of property before they are presented to the competent judge in the case. The judicial assistant may, in performing this role, complete documents and provide informationrelating to property under execution, verify the defendant's title or ownership therein, and determine the possibility of attachment of the property. Attending court hearings, but without participating as a member of the court or in the issuing of judgments. Contributing to the work of the technical office of the Court of Cassation. Any other functions assigned to them by the Council or the President of the Court of Cassation in accordance with this Law. The allocation of work between judicial assistants shall be effected by resolution of the President of the Court of Cassation. Subject to the provisions set out in this Part, the provisions of Chapters 8, 9 and 11 of this Law shall apply to judicial assistants. Resolutions terminating the services of judicial assistants or transferring them to other offices in accordance with the provisions of this Law shall be issued by the President of the Council of Ministers, based on a proposal of the Supreme Council of the Judiciary. Judges' aides are experts, translators and clerks. Taking into account the provisions of the Law on Criminal Procedure and the Law on Civil and Commercial Procedure, this law shall regulate the use of experts and translators before the courts, and shall define their rights and duties and their disciplinary code. A sufficient number of technical and administrative officials and clerks shall be appointed to each court, and they shall, before taking up their employment, swear an oath before the competent President of the Court that they will perform their jobs truthfully and faithfully. The Presidents of the Courts, after consultation with the Presidents of the Circuits, shall have the power to allocate administrative and clerical work among the employees of each court, as well as to transfer and delegate them between or outside the Circuits of the Court. Transfer or delegation between or outside the courts shall be by resolution of the Council, based on the proposal by the President of the relevant Court. The provisions of the regulations governing personnel issued by resolution of the Council of Ministers, based on the recommendation of the Council, shall apply to judges' aides and other court personnel. Save as otherwise stipulated in this law, the provisions of the Civil and Commercial Procedure Law and the Law on Criminal Procedure shall apply to criminal and civil matters brought before the courts. All court proceedings before Shari'ah or courts at the date of the entry into force of this law shall be transferred to the competent Circuit, as set out in this Law and the resolutions implementing it. The Emir shall issue a resolution settling the positions of judges of the existing Shari'ah and lawful courts serving on the date of the coming into force of this law, by transferring them to offices commensurate with their current offices and according to their respective seniority. Save as otherwise stipulated in this law, the provisions of the aforesaid Civil Service Law shall apply to judges. والرؤساء ونواب الرئيس والقضاة بمحكمة الإستئناف، والرؤساء والقضاة بالمحكمة الإبتدائية. 3- السنة: السنة الميلادية. القضاة مستقلون، وغير قابلين للعزل إلا وفقاً لأحكام هذا القانون، ولا يجوز المساس باستقلال القضاء، أو التدخل في شئون العدالة. يكون للمحاكم موازنة تلحق بالموازنة العامة للدولة. تتكون المحاكم من: 1- محكمة التمييز. 2- محكمة الاستئناف. 3- المحكمة الإبتدائية. وتختص كل منها بالفصل في المسائل التي ترفع إليها طبقاً للقانون. تكون مدينة الدوحة مقراً للمحاكم. ويجوز بقرار من المجلس: 1- إنشاء دوائر للمحكمة الابتدائية في المدن الأخرى. 2- عقد جلسات المحاكم خارج مقارها الأصلية. تؤلف محكمة التمييز من رئيس وعدد كاف من نواب الرئيس والقضاة بمحكمة التمييز، ويكون بها دوائر لنظر الطعون بالتمييز في الأحكام وبالإجراءات التي يحددها القانون، ويرأس كل دائرة رئيس المحكمة أو أحد نواب الرئيس أو أقدم قضاة المحكمة، ويصدر بإنشاء الدوائر وتحديد اختصاصاتها قرار من المجلس. ويصدر بتوزيع الأعضاء على الدوائر قرار من رئيس المحكمة بناءً على اقتراح الجمعية العامة، وتصدر الأحكام من خمسة أعضاء، ويحل أقدم نواب الرئيس بالمحكمة محل الرئيس عند غيابه. إذا رأت إحدى دوائر محكمة التمييز العدول عن مبدأ قانوني قررته أحكام سابقة صادرة منها أو من الدوائر الأخرى، أو عرضت مسألة تتعلق بتنازع الاختصاص سلباً أو إيجاباً، أحالت الطعن إلى دوائر المحكمة مجتمعة للفصل فيه. وإذا صدر حكمان يتضمنان مبدأين متعارضين، يدعو رئيس محكمة التمييز، بناءً على عرض المكتب الفني، دوائر المحكمة مجتمعة، في غير خصومة، لتوحيد المبدأ القانوني الواجب الاتباع في الطعون التالية. يكون لمحكمة التمييز مكتب فني يؤلف من رئيس وعدد كاف من القضاة، يصدر بندبهم قرار من المجلس بناءً على ترشيح رئيس محكمة التمييز. ويلحق بالمكتب عدد كاف من الموظفين. يختص المكتب الفني بالآتي: 1- استخلاص المبادئ القانونية التي تقررها المحكمة فيما تصدره من أحكام وتبويبها ومتابعة نشرها بعد عرضها على رئيس الدائرة التي أصدرتها. 2- إصدار مجموعات الأحكام. 3- إعداد البحوث الفنية. 4- الإشراف على أعمال المكتبة. 5- الإشراف على جداول المحكمة وعرض الطعون المتماثلة أو المرتبطة أو التي يحتاج الفصل فيها إلى تقرير مبدأ قانوني واحد، على رئيس المحكمة. 6- أية أمور أخرى يكلفه بها رئيس المحكمة. تؤلف محكمة الاستئناف من رئيس وعدد كاف من الرؤساء ونواب الرئيس والقضاة بمحكمة الاستئناف، ويكون بها دوائر لنظر الطعون الاستئنافية في قضايا الحدود والقصاص، والمواد الجنائية، والمواد المدنية والتجارية، ومسائل الأسرة والتركات، والمنازعات الإدارية، وغيرها، ويصدر بإنشاء الدوائر وتحديد اختصاصاتها قرار من المجلس. ويرأس المحكمة أقدم الرؤساء بها، وللمجلس ندب من يراه من قضاة محكمة التمييز أو الاستئناف لرئاسة المحكمة، لمدة سنة قابلة للتجديد، ويحل محله عند غيابه أو خلو منصبه من يندبه المجلس لذلك، ويرأس كل دائرة أقدم أعضائها، وللمجلس ندب من يراه من قضاة التمييز لرئاسة إحدى الدوائر بالمحكمة، ويكون الندب لمدة سنة قابلة للتجديد لمدة أو مُدد أخرى مماثلة. ويصدر بتوزيع الأعضاء على الدوائر قرار من رئيس المحكمة، بناءً على اقتراح الجمعية العامة، وتصدر الأحكام من ثلاثة أعضاء. تؤلف المحكمة الابتدائية من رئيس وعدد كاف من الرؤساء والقضاة بالمحكمة الابتدائية، ويكون بها دوائر لنظر قضايا الحدود والقصاص، والمواد الجنائية، والمواد المدنية والتجارية، ومسائل الأسرة والتركات، والمنازعات الإدارية، وغيرها، ويصدر بإنشاء الدوائر وتحديد اختصاصاتها قرار من المجلس. ويرأس المحكمة أقدم الرؤساء بها، وللمجلس ندب من يراه من قضاة محكمة التمييز أو الاستئناف لرئاسة المحكمة، لمدة سنة قابلة للتجديد، ويحل محله عند غيابه أو خلو منصبه من يندبه المجلس لذلك، ويرأس كل دائرة أقدم أعضائها، وللمجلس ندب من يراه من قضاة الاستئناف لرئاسة إحدى الدوائر بالمحكمة، ويكون الندب لمدة سنة قابلة للتجديد لمدة أو مُدد أخرى مماثلة. ويصدر بتوزيع الأعضاء على الدوائر قرار من رئيس المحكمة، بناءً على اقتراح الجمعية العامة، وتصدر الأحكام من ثلاثة أعضاء. ينشئ المجلس بناءً على اقتراح رئيس المحكمة الابتدائية دائرة أو أكثر، تصدر أحكامها من قاض فرد للفصل في القضايا التي يحددها القانون. ليس للمحاكم أن تنظر بطريقة مباشرة أو غير مباشرة في أعمال السيادة ومسائل الجنسية. تصدر الأحكام وتنفذ باسم الأمير. جلسات المحاكم علنية إلا إذا نص القانون أو رأت المحكمة من تلقاء نفسها أو بناءً على طلب أحد الخصوم جعلها سرية محافظة على النظام العام أو مراعاة للآداب أو لحرمة الأسرة. وفي جميع الأحوال يكون النطق بالأحكام في جلسة علنية. ويتولى رئيس الجلسة إدارتها وضبط نظامها. اللغة العربية هي لغة المحاكم. ويجوز للمحكمة عند الاقتضاء أن تسمع أقوال الخصوم أو الشهود الذين يجهلون اللغة العربية بواسطة مترجم بعد تحليفه اليمين القانونية بأن يقوم بالترجمة بالأمانة والصدق، وإذا كان المترجم موظفاً بالمحاكم فيكتفى بتحليفه اليمين مرة واحدة عند بدء تعيينه. يكون لكل محكمة جمعية عامة. وتجتمع كل جمعية بدعوة من رئيس المحكمة أو من يقوم مقامه سواءً من تلقاء نفسه أو بناءً على طلب ثلث عدد أعضائها على الأقل، للنظر في الأمور الآتية: 1- تشكيل الدوائر. 2- توزيع القضايا على الدوائر المختلفة. 3- تحديد عدد الجلسات ومواعيد انعقادها، بما في ذلك الجلسات المسائية. 4- تنظيم العمل خلال الإجازات السنوية. 5- المسائل الأخرى التي تتعلق بالأمور الداخلية للمحكمة. 6- أية مسائل أخرى ينص عليها القانون أو تسند إليها بقرار من المجلس. ويجوز للجمعية العامة أن تفوض رئيس المحكمة في بعض اختصاصاتها. تتألف الجمعية العامة للمحكمة من جميع أعضائها، ويرأس الجمعية رئيس المحكمة ولا يكون انعقادها صحيحاً إلا بحضور أكثر من نصف عدد أعضائها. فإذا لم يتوافر هذا النصاب جاز انعقاد الجمعية بعد ساعة من الميعاد المحدد إذا حضره ثلث عدد أعضائها على الأقل. وفي حالة عدم توافر هذا النصاب يعاد دعوة الجمعية العامة خلال اسبوع، ويكون انعقادها صحيحاً أياً كان عدد الحاضرين. تصدر قرارات الجمعية العامة بأغلبية أصوات الأعضاء الحاضرين، وعند تساوي الأصوات يرجح الجانب الذي منه الرئيس. وتثبت محاضر الجمعية العامة في سجل يعد لذلك ويوقعه رئيس المحكمة وأمين السر. تشكل الجمعية العامة في كل محكمة لجنة تسمى "لجنة الشئون الوقتية" برئاسة رئيس المحكمة أو من يقوم مقامه، وعضوية أقدم اثنين من أعضائها. وتتولى اللجنة اختصاصات الجمعية العامة في المسائل المستعجلة عند تعذر دعوتها للانعقاد. تبلغ قرارات الجمعية العامة ولجنة الشئون الوقتية إلى المجلس. وللمجلس أن يعيد إلى الجمعية العامة أو اللجنة القرارات التي يرى عدم الموافقة عليها لإعادة النظر فيها. فإذا أصرت أي منهما على قرارها، كان للمجلس اتخاذ ما يراه مناسباً بشأنه. ويكون قرار المجلس نهائياً. ينشأ مجلس يسمى «المجلس الأعلى للقضاء»، يشكل على الوجه الآتي: 1- رئيس محكمة التمييز رئيساً 2- أقدم نواب الرئيس بمحكمة التمييز نائباً للرئيس 3- أقدم القضاه بمحكمة التمييز عضواً 4- رئيس محكمة الاستئناف عضواً 5- أقدم نواب الرئيس بمحكمة الاستئناف عضواً 6- أقدم القضاة بمحكمة الاستئناف عضواً 7- رئيس المحكمة الإبتدائية عضواً ويحل نائب الرئيس محل الرئيس عند غيابه أو خلو منصبه. يعمل المجلس على تحقيق استقلال القضاء، ويتولى فضلاً عن الاختصاصات الأخرى المنصوص عليها في هذا القانون، الاختصاصات التالية: 1- إبداء الرأي في المسائل المتعلقة بالقضاء، ودراسة واقتراح التشريعات الخاصة بتطوير النظام القضائي. 2- إبداء الرأي في تعيين القضاة وترقيتهم ونقلهم وندبهم وإعارتهم وإحالتهم إلى التقاعد وفقاً لأحكام هذا القانون. 3- النظر في التظلمات المتعلقة بشئون القضاة، ويكون قرار المجلس بشأنها نهائياً. 4- الاختصاصات الأخرى التي يُعهد إليه بها أي قانون آخر، والموضوعات التي يرى رئيس المجلس عرضها عليه. يعقد المجلس اجتماعاً عادياً مرة على الأقل كل شهر، ويجوز عقد اجتماعات غير عادية كلما دعت الحاجة. ويجتمع المجلس بدعوة من رئيسه أو بطلب من ثلاثة من أعضائه على الأقل، ويجب ان تكون الدعوة الموجهة للأعضاء مصحوبة بجدول الأعمال. ولا يكون انعقاد المجلس صحيحاً إلا بحضور أغلبية أعضائه بمن فيهم الرئيس وتكون جميع مداولاته سرية، وتصدر القرارات بأغلبية أصوات الحاضرين، وعند تساوي الأصوات يرجح الجانب الذي منه الرئيس. يجوز للمجلس أن يشكل من بين أعضائه لجنة أو أكثر وأن يفوضها في بعض اختصاصاته، عدا ما يتعلق منها بالتعيين والترقية والنقل والإحالة إلى التقاعد. يضع المجلس القواعد المنظمة لاجتماعاته ومباشرة اختصاصاته. يشترط فيمن يتولى القضاء ما يلي: 1- أن يكون قطرياً، فإن لم يوجد فمن مواطني إحدى الدول العربية. 2- أن يكون كامل الأهلية. 3- أن يكون حاصلاً على إجازة الحقوق أو الشريعة والقانون أو الشريعة أو ما يعادلها من إحدى الجامعات المعترف بها. 4- ألا يكون قد أدين بحكم نهائي في جناية أو جنحة مخلة بالشرف أو الأمانة، ولو كان قد رد إليه اعتباره. 5- ألا يكون قد فصل من الخدمة بقرار تأديبي. 6- أن يكون محمود السيرة حسن السمعة. 7- ألا يقل عمره عن خمس وعشرين سنة إذا كان التعيين في المحكمة الابتدائية، وعن ثمان وثلاثين سنة إذا كان التعيين في محكمة الاستئناف. مع مراعاة أحكام المادة السابقة، يشترط فيمن يعين قاضياً في المحكمة الابتدائية أن يكون قد قضى في وظيفة مساعد قاض مدة لا تقل عن ثلاث سنوات، وأن يجتاز بنجاح التدريب المقرر وفقاً لأحكام القانون رقم (8) لسنة 2001 المشار إليه. ويشترط فيمن يعين رئيساً بالمحكمة الابتدائية ان يكون قد قضى في وظيفة قاض بالمحكمة الابتدائية خمس سنوات على الأقل. ويشترط فيمن يعين قاضياً بمحكمة الإستئناف أن يكون قد قضى في وظيفة رئيس بالمحكمة الابتدائية ست سنوات على الأقل. ويشترط فيمن يعين نائب رئيس بمحكمة الإستئناف أن يكون قد قضى في وظيفة قاض بمحكمة الإستئناف ست سنوات على الأقل. ويشترط فيمن يعين رئيساً بمحكمة الإستئناف أن يكون قد قضى في وظيفة نائب رئيس بمحكمة الاستئناف خمس سنوات على الأقل. ويشترط فيمن يعين قاضياً بمحكمة التمييز أن يكون قد قضى في وظيفة رئيس بمحكمة الاستئناف خمس سنوات على الأقل. ويشترط فيمن يعين نائب رئيس بمحكمة التمييز أن يكون قد قضى في وظيفة قاض بمحكمة التمييز خمس سنوات على الأقل. ويجوز خلال الخمس سنوات الأولى من تاريخ العمل بهذا القانون، تخفيض المدة المتطلبة للتعيين في وظيفتي قاضي بمحكمة التمييز ونائب الرئيس بها، بما لا يجاوز النصف، إذا اقتضت الضرورة ذلك. تكون ترقية القضاة على أساس الأقدمية. ويشترط في الترقية إلى الوظيفة الأعلى أن يكون تقدير الكفاية الأخير للمرشح للترقية بدرجة فوق المتوسط على الأقل. وتحدد الكفاية بناءً على تقارير التفتيش القضائي على أعمال القضاة، وفقاً لأحكام هذا القانون والقرارات المنفذة له. ولا تجوز الترقية إلا بعد انقضاء المدد المقررة في المادة السابقة. يصدر بتعيين رئيس محكمة التمييز أمر أميري ويكون بدرجة وزير، ويكون تعيين باقي القضاة بمرسوم بناءً على اقتراح المجلس. تحدد أقدمية القضاة بحسب تاريخ المرسوم الصادر بتعيينهم، ما لم يحدد هذا المرسوم تاريخاً آخر. وإذا عين أكثر من قاض في مرسوم واحد كانت الأقدمية بينهم بحسب ترتيبهم في المرسوم. يجوز أن يعين من خارج السلك القضائي، في وظائف القضاة الفئات الآتية: 1- قضاة المحاكم السابقون. 2- أعضاء النيابة العامة. 3- المشتغلون بعمل قانوني نظير للعمل القضائي في الوزارات والأجهزة الحكومية الأخرى والهيئات والمؤسسات العامة، ويصدر بتحديد العمل النظير قرار من المجلس. 4- المحامون. 5- أعضاء هيئات تدريس القانون، والشريعة والقانون بالجامعات المعترف بها. ويكون تعيينهم وتحديد درجاتهم وأقدمياتهم، وفقاً للضوابط التي يصدر بها قرار من المجلس. يصدر بتحديد رواتب القضاة وبدلاتهم قرار من الأمير، ولا يجوز أن يقرر لأحدهم راتب بصفة شخصية أو أن يعامل معاملة استثنائية. لا يجوز ندب القاضي خارج المحاكم إلا للقيام بأعمال قضائية أو قانونية. ويكون الندب بقرار من المجلس لمدة سنة قابلة للتجديد إذا كان الندب لبعض الوقت، وبحد أقصى أربع سنوات متصلة إذا كان الندب لكل وقت. لا يجوز للقاضي بغير موافقة المجلس أن يكون محكماً بأجر أو بغير أجر في نزاع مطروح أو غير مطروح على القضاء، ويجوز بعد موافقة المجلس ندب القاضي ليكون محكماً عن الحكومة أو إحدى الهيئات أو المؤسسات العامة. يجوز بموافقة المجلس إعارة القاضي إلى الحكومات الأجنبية أو الهيئات الدولية، ويصدر بالإعارة مرسوم. ولا تزيد مدة الإعارة على أربع سنوات متصلة، ومع ذلك يجوز أن تزيد المدة عن هذا القدر إذا اقتضت ذلك مصلحة عامة يقدرها الأمير. يُصدر المجلس قراراً بنظام الإجازات السنوية للقضاة ومساعديهم. تكون مدة الإجازة السنوية للقضاة ستين يوماً، وخمسة وأربعين يوماً لمساعدي القضاة. يمنح القاضي إجازة مرضية لا تجاوز سنة براتب كامل، ثم سنة أخرى بنصف راتب، ثم سنة ثالثة بربع راتب. وللقاضي أن يستنفد رصيده من الإجازات الدورية بالإضافة إلى ما يستحق من الإجازات المرضية. وإذا لم يستطع القاضي مباشرة عمله بعد انقضاء الإجازات المقررة في هذه مادة، أو إذا ثبت في أي وقت عجزه عن القيام بمهام وظيفته لأسباب صحية بقرار من الجهة الطبية المختصة، أحيل إلى التقاعد بمرسوم، بناءً على طلب المجلس. يؤدي القاضي قبل مباشرة مهام منصبه يميناً بالصيغة التالية: «أقسم بالله العظيم أن أحكم بين الناس بالعدل، وأن احترم أحكام الشريعة الإسلامية وقوانين البلاد». ويكون أداء اليمين بالنسبة لرئيس محكمة التمييز أمام الأمير، وبالنسبة لباقي القضاة أمام المجلس. يحافظ القضاة داخل العمل وخارجه على صفة الوقار والكرامة، ويلتزمون بصون سمعتهم وسيرتهم، وتوقي كل ما يمس أمانتهم أو يشكك في نزاهتهم. ولا يجوز للقضاة مزاولة الأعمال التجارية أو أي عمل لا يتفق مع استقلال القضاء وكرامته سواءً كان بأجر أو بغير أجر. ويجوز للمجلس أن يقرر منع القاضي من مباشرة أي عمل يرى أن القيام به يتعارض مع طبيعة وواجبات الوظيفة وحسن أدائها. يحظر على القضاة إبداء الآراء السياسية أو الاشتغال بالعمل السياسي. ولا يجوز لهم الترشيح لانتخابات المجالس التشريعية أو البلدية خلال عملهم بالقضاء. لا يجوز للقاضي أن يبدي رأياً في المنازعات المعروضة عليه، كما لا يجوز له إفشاء أسرار المداولة. لا يجوز أن يجلس في دائرة واحدة قضاة بينهم قرابة أو مصاهرة حتى الدرجة الرابعة. كما لا يجوز أن يربط القاضي بأحد الخصوم أو ممثله أو المدافع عنه في الدعوى التي ينظرها صلة القرابة أو المصاهرة المنصوص عليها في الفقرة السابقة. لا يجوز للقاضي أن ينظر في أية قضية تكون له فيها مصلحة شخصية مباشرة أو غير مباشرة أو علاقة بأي من أطرافها تتنافى مع واجباته كقاض. لا يجوز للقاضي أن يقبل هدية من الخصوم أو وكلائهم أو ذويهم أو أن يأذن لأحد أفراد عائلته في قبولها. تنشأ إدارة للتفتيش القضائي تلحق بالمجلس وتكون برئاسة أحد نواب الرئيس بمحكمة التمييز وعضوية عدد كاف من القضاة بمحكمة التمييز والرؤساء ونواب الرئيس والقضاة بمحكمة الإستئناف، وتختص بالتفتيش على أعمال نواب الرئيس والقضاة بمحكمة الإستئناف والرؤساء والقضاة بالمحكمة الإبتدائية، وفحص وتحقيق الشكاوى التي تقدم ضد القضاة وتكون متعلقة بأعمال وظائفهم أو بسلوكهم. ويصدر المجلس قراراً بندب رئيس وأعضاء الإدارة لمدة سنة قابلة للتجديد. كما يصدر المجلس بقرار منه لائحة بنظام التفتيش القضائي. يجري التفتيش على أعمال القضاة المنصوص عليهم في المادة السابقة، مرة على الأقل كل سنتين، ويكون تقدير الكفاية بإحدى الدرجات الآتية: (كفء - فوق المتوسط - متوسط - أقل من المتوسط). وتتولى الإدارة إحاطة القاضي علماً بكل ما يودع في ملف خدمته من ملاحظات أو أوراق، كما تخطره بصورة من تقرير التفتيش. ويجوز له التظلم إلى المجلس خلال خمسة عشرة يوماً من تاريخ إخطاره. ويفصل المجلس في التظلم بعد الاطلاع على الأوراق وسماع أقوال المتظلم عند الاقتضاء. ويكون قرار المجلس في شأن تقدير الكفاية نهائياً. في حالة حصول القاضي على تقديرين متتاليين بدرجة أقل من المتوسط يقرر المجلس بناءً على اقتراح إدارة التفتيش القضائي، اما إحالته إلى التقاعد، أو نقله إلى وظيفة أخرى غير قضائية، وتزول ولاية القاضي من التاريخ الذي يحدده المرسوم الصادر بذلك. وفي حالة نقل القاضي إلى وظيفة أخرى غير قضائية، يحتفظ براتبه السابق على النقل بصفة شخصية، ولو جاوز نهاية مربوط درجة الوظيفة المنقول إليها. يجوز مساءلة القاضي تأديبياً في الحالات التالية: 1- إذا أخل بواجبات وظيفته أو خرج على مقتضياتها. 2- إذا وقع منه ما يحط من شرف القضاء أو هيبته. 3- إذا وضع نفسه موضع الشبهات والريب. يكون تأديب القضاة من اختصاص مجلس تأديب يشكل برئاسة رئيس المجلس وعضوية أقدم اثنين من أعضائه. وعند خلو وظيفة أحد الأعضاء أو غيابه أو وجود مانع لديه، يحل محله من يليه في الأقدمية. ولا يجوز لمن تولى أو شارك في التحقيق أن يجلس للفصل في الدعوى التي تقام بناءً عليه. لا يجوز إقامة الدعوى التأديبية إلا بإذن من رئيس المجلس، وبعد تحقيق إداري يتولاه أحد أعضاء محكمة التمييز أو أحد أعضاء إدارة التفتيش يندبه رئيس المجلس. وفي جميع الأحوال يتولى الإدعاء أمام مجلس التأديب رئيس إدارة التفتيش القضائي أو من يندبه لذلك. تُرفع الدعوى التأديبية بصحيفة تشتمل على التهمة والأدلة المؤيدة لها، وتقدم لمجلس التأديب ليصدر قراره بإعلان القاضي بها للحضور أمامه إذا ما رأى وجهاً للسير في إجراءات المحاكمة التأديبية، على أن يكون الإعلان قبل الميعاد بخمسة عشر يوماً على الأقل. وللمجلس عند السير في إجراءات المحاكمة أن يقرر بعد سماع أقوال القاضي إيقافه عن مباشرة أعمال وظيفته، أو اعتباره في إجازة حتمية حتى تنتهي المحاكمة، وله في أي وقت أن يعيد النظر في أمر الوقف أو الإجازة المذكورة. ولا يترتب على إيقاف القاضي أو اعتباره في إجازة حتمية حرمانه من راتبه أو بدلاته أو وقف صرفه كلياً أو جزئياً. تنقضي الدعوى التأديبية باستقالة القاضي، ولا تأثير للدعوى التأديبية على الدعوى الجنائية أو المدنية الناشئة عن ذات الواقعة. لمجلس التأديب إجراء ما يراه لازماً من تحقيقات، وله أن يندب أحد أعضائه للقيام بذلك. ويكون للمجلس و للعضو المنتدب للتحقيق السلطة المخولة للمحاكم العادية فيما يختص بالشهود الذين يرى سماع شهادتهم. تكون جلسات مجلس التأديب سرية. ويحكم في الدعوى التأديبية بعد سماع طلبات الإدعاء ودفاع القاضي، الذي له أن يقدم تزول ولاية القاضي المحكوم بعزله من تاريخ الحكم ما لم يقض ذلك الحكم بزوال تلك الولاية من تاريخ وقفه عن العمل أو منحه الإجازة الحتمية. ويصدر بتنفيذ عقوبة العزل مرسوم، ويودع الحكم والمرسوم ملف الخدمة. لا يترتب على الحكم الصادر بعزل القاضي حرمانه من حقه في المعاش أو المكافأة. في غير حالة التلبس بالجريمة لا يجوز القبض على القاضي أو اتخاذ أي إجراء من إجراءات التحقيق ضده، إلا بعد الحصول على إذن بذلك من المجلس. وفي جميع الأحوال يختص المجلس بالنظر في حبس القاضي احتياطياً وتجديد حبسه. يجوز للمجلس أن يأمر بوقف القاضي عن مباشرة أعمال وظيفته أثناء إجراءات التحقيق عن الجريمة المتهم فيها، وذلك من تلقاء نفسه أو بناءً على طلب رئيس محكمة التمييز، أو بناءً على قرار من الجمعية العامة للمحكمة. ولا يترتب على الإيقاف حرمان القاضي من راتبه أو بدلاته أو وقف صرفها كلياً أو جزئياً طوال مدة الإيقاف عن العمل. تنتهي ولاية القضاة لأحد الأسباب الآتية: 1- الوفاة. 2- الإستقالة. 3- بلوغ سن التقاعد. 4- العزل بحكم تأديبي طبقاً لأحكام هذا القانون. 5- الفصل من الخدمة بقرار أميري لأسباب تتعلق بالصالح العام. 6- الإحالة إلى التقاعد، أو النقل إلى وظائف أخرى غير قضائية، وفقاً لأحكام هذا القانون. تعتبر استقالة القاضي مقبولة من تاريخ تقديمها إذا كانت غير مقترنة بقيد أو معلقة على شرط. ولا يترتب على الاستقالة حرمان القاضي من المعاش أو المكافأة. يكون سن الإحالة إلى التقاعد للقضاة سعين سنة، وللقاضي بعد بلوغ سن الستين أن يطلب إحالته إلى التقاعد، ويكون الطلب مقبولاً من تاريخ تقديمه. وللمجلس مد خدمة القاضي إلى ما بعد بلوغه سن الإحالة إلى التقاعد، لمدة لا تجاوز سنة. ويكون مد الخدمة فيما يجاوز ذلك، وبحد أقصى خمس سنوات، بمرسوم، بناءً على اقتراح المجلس. يلحق بالمحكمة الابتدائية عدد كاف من مساعدي القضاة، يتولى القضاة تدريبهم وتسند إليهم الأعمال المنصوص عليها في هذا القانون. يشترط فيمن يعين مساعد قاض أن يكون قطرياً ومستوفياً للشروط المنصوص عليها في المادة ( 27 ) من هذا القانون على ألا يقل عمره عن إحدى وعشرين سنة. يكون تعيين مساعد القاضي بقرار من رئيس مجلس الوزراء بناءً على اقتراح المجلس. وتكون السنة الأولى من عمل مساعد القاضي فترة اختبار قابلة للمد لفترة مماثلة. وفي حالة استيفاء مساعد القاضي للشروط المقررة للتعيين في وظيفة قاض يقدم على غيره في التعيين. ويؤدي مساعد القاضي قبل مباشرة أعماله اليمين بالصيغة المنصوص عليها في المادة ( 40 ) من هذا القانون، أمام رئيس المجلس. يختص مساعد القاضي بالآتي: 1- إجراء المعاينة في الدعاوي التي تندبه المحكمة لإجراء المعاينة فيها. 2- تحضير طلبات التنفيذ قبل عرضها على القاضي المختص للفصل فيها. ولمساعد القاضي في سبيل ذلك استيفاء المستندات والبيانات الخاصة بالأموال محل التنفيذ والتحقق من ملكيتها للمطلوب التنفيذ ضده وقابليتها للحجز. 3- حضور جلسات المحاكم دون أن يشارك في عضوية هيئة المحكمة أو إصدار الأحكام. 4- المساهمة في أعمال المكتب الفني لمحكمة التمييز. 5- أي اختصاصات أخرى تسند إليه من المجلس أو رئيس محكمة التمييز وفقاً لهذا القانون. ويتم توزيع الأعمال بين مساعدي القضاة بقرار من رئيس محكمة التمييز. مع مراعاة الأحكام المنصوص عليها في هذا الباب تسري على مساعدي القضاة أحكام الفصول الثامن والتاسع والحادي عشر من هذا القانون. وتصدر قرارات إنهاء خدمة مساعدي القضاة أو نقلهم لوظائف أخرى طبقاً لأحكام هذا القانون من رئيس مجلس الوزراء بناءً على اقتراح المجلس الأعلى للقضاء. أعوان القضاة هم الخبراء والمترجمون والكتبة. مع مراعاة أحكام قانون الإجراءات الجنائية و قانون المرافعات المدنية والتجارية ، ينظم القانون أعمال الخبرة والترجمة أمام القضاء، ويحدد حقوق الخبراء والمترجمين وواجباتهم وقواعد تأديبهم. يعين بكل محكمة عدد كاف من الموظفين الفنيين والإداريين والكتبة، ويحلف هؤلاء الموظفون قبل مباشرة أعمالهم أمام رئيس المحكمة المختص، يميناً بأن يؤدوا أعمالهم بالصدق والأمانة. يتولى رؤساء المحاكم بعد التشاور مع رؤساء الدوائر توزيع الأعمال الإدارية والكتابية بين موظفي كل محكمة وكذلك نقلهم وندبهم داخل دوائر المحكمة. ويكون النقل أو الندب فيما بين المحاكم أو إلى خارجها بقرار من المجلس بناءً على اقتراح رئيس المحكمة المختص. تسري على أعوان القضاة وغيرهم من موظفي المحاكم أحكام لائحة شئون الموظفين التي يصدر بها قرار من مجلس الوزراء بناءً على اقتراح المجلس. يعمل أمام المحاكم بأحكام قانون المرافعات المدنية والتجارية وقانون الإجراءات الجنائية فيما لم يرد بشأنه نص في هذا القانون. جميع الدعاوي المنظورة أمام المحاكم الشرعية أو العدلية في تاريخ العمل بهذا القانون تحال بحالتها إلى الدوائر المختصة بمقتضى هذا القانون والقرارات المنفذة له. يصدر الأمير قراراً بتسوية أوضاع قضاة المحاكم الشرعية والعدلية الموجودين في الخدمة في تاريخ العمل بهذا القانون، وذلك بنقلهم إلى الوظائف المعادلة لوظائفهم الحالية، وبترتيب أقدمياتهم فيما بينهم. فيما لم يرد بشأنه نص في هذا القانون، تسري على القضاة أحكام قانون الخدمة المدنية المشار إليه. يصدر المجلس القرارات اللازمة لتنفيذ أحكام هذا القانون.
