Resolution No 7 of 2012 by the Chairperson of the Cultural Village Foundation Katara Amending Certain Provisions of the Regulation of Tenders and Bids for the Foundation التشريعات | قرار رئيس المؤسسة العامة للحي الثقافي رقم (7) لسنة 2012م بتعديل بعض أحكام لائحة المناقصات والمزايدات للمؤسسة

An Article numbered (28 bis) shall be added to the regulation of tenders and bids referred to above and shall read as follows: “Article 28 (bis): The Foundation may contract by direct agreement beyond the limits and conditions set forth in previous Articles in the following two cases: Where business or purchases or contracts or services are available only from one source due to monopolistic practices, or technical or licensing reasons. Where the subject of the contract is a cultural, artistic or intellectual work or other creative activity such as singing, music, writing, fine art, visual art and photography. In these two cases, a reasoned joint report shall be submitted by the competent unit, the requesting unit and the Department of Legal Affairs to the Committee, along with a copy of all relevant documents approved by the General Manager. The Committee shall examine the report and submit its recommendations in this regard to the Chairperson for approval.” All competent authorities, each within its own jurisdiction, shall execute this resolution, which shall come into force from the date of its publication in the Official Gazette . --- تُضاف مادة برقم (28 مكرراً) إلى لائحة المناقصات والمزايدات المشار إليها، يكون نصها التالي: مادة (28 مكرراً): «يجوز للمؤسسة التعاقد بطريق الاتفاق المباشر فيما يجاوز الحدود والشروط المنصوص عليها في المواد السابقة، وذلك في الحالتين التاليتين: 1) إذا كانت الأعمال أو المشتريات أو المقاولات أو الخدمات متوفرة لدى مصدر واحد فقط لأسباب ترجع إلى الإحتكار أو التقنية أو الترخيص. 2) إذا كان موضوع التعاقد يتعلق بعمل ثقافي أو فني أو فكري، أو غير ذلك من الأنشطة الإبداعية، كالغناء والموسيقى وأعمال التأليف والفن التشكيلي والفنون البصرية والضوئية. ويتعين في هاتين الحالتين، رفع تقرير مشترك ومسبب، من الوحدة المختصة والوحدة الطالبة وإدارة الشؤون القانونية إلى اللجنة، مشفوعاً بنسخة من جميع الوثائق والمستندات ذات الصلة، ومؤيداً من المدير العام. وتتولى اللجنة دراسة وفحص الموضوع، ورفع توصيتها في هذا الشأن للرئيس للإعتماد.». على جميع الوحدات المختصة، كل فيما يخصه، تنفيذ هذا القرار. ويُعمل به من تاريخ صدوره. ويُنشر في الجريدة الرسمية.
