In implementing the provisions of this Resolution, the following words and words must have the meaning assigned thereto, unless the context requires otherwise: “Ministry” means the Ministry of Municipality and Urban Planning; “Company” means Qatar Railways Company (Rail); “Project” means the project for establishing the Qatar railways network (Rail); “Protection Zones” means zones that are determined for the protection of the path of tunnels in order to prevent the performance of any construction work that may affect the safety of such tunnels. 1. With the exception of the provisions of Article 6 (1) of Law No. 13 of 1988 referred to above, the Company may request the Ministry to expropriate or appropriate temporarily any property necessary for the implementation of the project. 2. The provisions of the abovementioned law shall be applied. Subject to the provisions of Article 839 of the Civil Law referred to above, the Ministry shall, at the request of the Company, determine beneficial enjoyment of property referred to in the previous article. Subject to the provisions of the preceding article, the Company shall have the right to dig tunnels for the project and to run them under State and private property. The protection zones specified for the project shall be determined by a decision of the Minister of Municipality and Urban Planning in coordination with the Company. All competent authorities, each within their respective jurisdiction, shall enforce this law from the date of its publication in the Official Gazette. --- في تطبيق أحكام هذا القانون، تكون للكلمات والعبارة التالية، المعاني الموضحة قرين كل منها، ما لم يقتض السياق معنى آخر: الوزارة: وزارة البلدية والتخطيط العمراني. الشركة: شركة سكك الحديد القطرية (الريل). المشروع: مشروع إنشاء شبكات السكك الحديدية (الريل). مناطق الحماية: المناطق التي تحدد لحماية مسار الأنفاق وذلك لتفادي قيام أي جهة باية أعمال انشائية قد تؤثر على سلامة الأنفاق. استثناءً من حكم المادة ( 6/ فقرة أولى ) من القانون رقم (13) لسنة 1988 المشار إليه، يجوز للشركة أن تطلب من الوزارة اتخاذ إجراءات نزع ملكية العقارات اللازمة لتنفيذ المشروع أو الاستيلاء عليها مؤقتاً. وتُطبق في هذا الشأن أحكام القانون المذكور. مع مراعاة أحكام المادة ( 839 ) من القانون المدني المشار إليه، تتولى الوزارة تحديد الحد المفيد في التمتع المألوف علواً وعمقاً، بشأن العقارات المشار إليها في المادة السابقة، بناءً على طلب من الشركة. مع مراعاة حكم المادة السابقة، يحق للشركة حفر الأنفاق اللازمة للمشروع وتشغيلها تحت أملاك الدولة والأملاك الخاصة. يصدر بتحديد مناطق الحماية المقررة للمشروع قرار من وزير البلدية والتخطيط العمراني بالتنسيق مع الشركة. على جميع الجهات المختصة، كل فيما يخصه، تنفيذ هذا القانون. ويعمل به من تاريخ صدوره. وينشر في الجريدة الرسمية.
