a- A litigant may appeal in cassation any final judgment order issued by any court of appeal where: the contested previous judgment was based on a violation of the law or procedures, or there was an error in the application or interpretation thereof, which has or may have resulted in an incorrect court decision. The notice of appeal shall be filed with the Registry of the Court of Cassation and must be signed by a lawyer registered with the court. The notice shall include the names of the litigants, their capacities and addresses, a statement of the appealed judgment and its date of issuance, and the grounds upon which the appeal is based. The court shall, ex officio dismiss the appeal if such procedures are not followed. Save as otherwise mentioned in the statement of appeal, the court may not accept any other grounds of appeal. Where the reason for failure to follow the procedure relates to the public order, in which case the court may, ex officio accept the appeal. If an appellant's grounds for appeal in cassation relate to a previous judgment order before the issuance of the appealed judgment order in the same case, the appeal request shall include the previous judgment unless expressly approved. a. The appellant shall deposit as a security in cassation an amount of twenty thousand (20000) Riyals at the treasury of the Court if the appeal court issued the appealed judgment order, and five thousand (5000) Riyals if the judgment order was issued by the court of first instance. The Registry of the court shall not accept a notice of appeal unless accompanied by proof of payment of the security. In the case of multiple appellants in the same appeal, a payment by one appellant shall be acceptable even if the grounds upon which the appeal is based are different. Persons exempted from judicial fees shall also be exempted from the security. The appellant shall provide the Registry of the Appeal Court with the following: Copies of the notice of appeal for each appellee. A copy for the Registry's office. Appeal in cassation shall not cause the stay of execution of the appealed judgment. Nevertheless, the Court of Cassation may order a temporary stay of execution if the appellant so requests in the notice, and where such execution could reasonably cause unavoidable grave harm. The Head of the Court shall, upon the appellant petition, examine this request in a hearing, and the opposing party shall be notified thereof by the appellant. The Court, when deciding the stay of execution, may require the submission of a security or order any procedure it deems necessary to protect the rights of the appellee. The order of stay of execution shall also apply to the procedures of execution adopted by the aggrieved party acting upon the appealed judgment from the date of the request of stay of execution. Where the Court orders a stay of execution, it shall set a date for hearing the appeal not later than three months from the date of the stay. The Court shall decide the appeal within a period not exceeding fourteen months from the date of the stay, failing which; it shall order a dismissal of the appeal. The Court of Cassation shall impose a fine of not less than two hundred (200) Riyals and not more than five hundred (500) Riyals on any Registry's office or concerned authority staff who fails to comply with any of the procedures prescribed in Articles 7 and 9 herein. a. If the appellee wishes to present a defence he shall, within ten days from the date of filing the notice of appeal, submit to the Registry's Office of the Cassation Court an affidavit stating the facts upon which he relies in support of his defence. The affidavit shall be accompanied by supporting documents and a power of attorney signed by his lawyer. In the case of multiple appellees, each may, mutanis mutandis , file a defence in the same manner and within the same time limits prescribed in paragraph (a) above. The appellant may file a reply and supporting documents at the Registry's Office within ten days after the appellee has filed his defence. Where an appellant files a reply, the appellee may file a response within ten days of the appellant's reply. a. Before the expiration of the period stipulated in Article 11 (a) the appellee may join any additional appelleewho was not included in the appeal. The new appellee shall be notified of the appeal and shall, within ten days of being notified, file with the Registry of the Court of Cassation an affidavit of defence accompanied by supporting documents. In such a case, the time limits prescribed in Article 11 (b), (c) and (d) shall not apply until the ten-day period has elapsed. a. Any party to the case under appeal who received no notification of the appeal may intervene and request a dismissal. Such intervention shall be made by filing an affidavit of defence, accompanied by supporting documents, at the Registry's office before the time limit prescribed in Article 11 (a) has elapsed. The originals and copies of all affidavits and supporting documents shall be filed in the names of the litigants and shall match their number, and all shall be signed by a lawyer qualified to appear before the Court of Cassation. No affidavits or supporting documents may be accepted by the Registry of the Court after the expiration of the prescribed time limits. Nevertheless, the Registry shall record the date, name of applicant, capacity and reasons for refusing such acceptance. a. The Court of Appeal shall consider the notice of appeal in chambers after the Head of Court has assigned the Judge-Rapporteur to hear the appeal. Upon a determination that a prima facie case exists, either because it is likely to prevail or because it may establish a new legal principle, it shall set a hearing date. Where the Court considers prima facie that the appeal has no merit, it shall dismiss it and provide reasons based on its deliberations in chambers. a. The Registry of the Court shall notify the litigants' legal representative by registered letter of the date of the scheduled hearing at least ten days in advance. The appeal shall be enclosed in the agenda of the hearing. The agenda shall be posted at the Registry's Office at least five days prior to the hearing and shall remain posted there for the duration of the hearing. After the Judge-Rapporteur has summarised the grounds of the appeal, the respective pleadings filed by the parties, and the significance of the points of law advanced in argument, the Court shall rule on the appeal. a. Where the court deems it necessary, it may request oral argument from the lawyer for the litigants. Litigants who have not filed affidavits in their names shall have no right to assign a lawyer to attend the hearing on their behalf. Without prejudice to the provisions of Article 4 (d) therein, no reasons other than those advanced by litigants in their affidavits may be presented orally at the hearing. In exceptional cases, the court may allow a litigant's lawyer to file a supplementary brief if it deems necessary to allow all issues to be addressed fully. The court shall remand the appeal to a later date and impose an appropriate deadline for the filing of the supplementary brief. Where the Court of Cassation decides to quash the appeal, the appellant shall bear the costs of the appeal and shall forfeit, either in whole or in part, the security of cassation to the State. Where the court deems that the appeal is motivated by malice or bad faith, it may order compensation be paid to the appellee. The quashing of a judgment shall return the parties to the same position in which they were before it was appealed. Where only part of the judgment is quashed, the operative parts shall remain of full force and effect unless they are dependent on that part which was quashed. Cassation judgment orders may not be appealed in any manner. This law does not apply to any provisions which were issued before it was promulgated. محكمة الاستئناف في الأحوال الآتية: 1- إذا كان الحكم المطعون فيه مبنياً على مخالفة القانون، أو خطأ في تطبيقه، أو في تأويله. 2- إذا وقع بطلان في الحكم أو في الإجراءات أثر في الحكم. وللخصوم أن يطعنوا بالتمييز في أي حُكم نهائي، أياً كانت المحكمة التي أصدرته، فصل في نزاع خلافاً لحُكم آخر سبق أن صدر بين الخصوم أنفسهم وحاز قوة الأمر المقضي. للنائب العام، في أي وقت، أن يطعن بالتمييز لمصلحة القانون في الأحكام النهائية، أياً كانت المحكمة التي أصدرتها، إذا كان الحُكم مبنياً على مخالفة القانون، أو خطأ في تطبيقه، أو في تأويله، وذلك في الأحوال الآتية: 1- الأحكام التي لا يجيز القانون للخصوم الطعن فيها. 2- الأحكام التي فوت الخصوم ميعاد الطعن فيها أو نزلوا فيها عن الطعن. ويرفع هذا الطعن بصحيفة يوقعها النائب العام، وتنظر المحكمة الطعن في غرفة المشورة بغير دعوة الخصوم. ولا يفيد الخصوم ولا يضارون من هذا الطعن. ميعاد الطعن بالتمييز ستون يوماً. ويرفع الطعن بصحفية تودع قلم كتاب محكمة التمييز، ويجب أن يوقعها محام مقبول للمرافعة أمام هذه المحكمة. وتشتمل الصحيفة بالإضافة إلى البيانات المتعلقة بأسماء الخصوم وصفاتهم وموطن كل منهم على بيان الحُكم المطعون فيه وتاريخه والأسباب التي بني عليها الطعن وطلبات الطاعن، فإذا لم يحصل الطعن على هذا الوجه وجب على المحكمة أن تقضي من تلقاء نفسها ببطلانه. ولا يجوز التمسك بسبب من أسباب الطعن غير التي ذكرت في الصحيفة، ومع ذلك فالأسباب المبنية على النظام العام يمكن التمسك بها في أي وقت وتأخذ المحكمة بها من تلقاء نفسها. وإذا أبدى الطاعن سبباً للطعن بالتمييز يتعلق بحكم سابق على صدور الحُكم المطعون فيه في ذات القضية، اعتبر الطعن شاملاً للحُكم السابق ما لم يكن قبُل صراحة. يجب على الطاعن أن يودع خزانة المحكمة، عند تقديم صحيفة الطعن، على سبيل الكفالة مبلغ عشرين ألف ريال، إذا كان الحكم المطعون فيه صادراً من محكمة الاستئناف، وخمسة آلاف ريال إذا كان صادراً من المحكمة الابتدائية. ولا يقبل قلم الكتاب صحيفة الطعن إذا لم تصحب بما يثبت إيداع الكفالة، ويكفي إيداع كفالة واحدة في حالة تعدد الطاعنين إذا أقاموا طعنهم بصحيفة واحدة ولو اختلفت أسباب الطعن. ويعفى من أداء الكفالة من يعفى من أداء الرسوم القضائية. يجب على الطاعن أن يودع قلم كتاب المحكمة عند تقديم صحيفة الطعن صوراً منها بقدر عدد المطعون ضدهم، وصورة لقلم الكتاب، وسند توكيل المحامي الموكل في الطعن، ومذكرة شارحة لأسباب طعنه، وأن يرفق بها المستندات التي تؤيد الطعن ما لم تكن مودعة ملف القضية الصادر فيها الحُكم المطعون فيه، فإن كانت مقدمة في طعن آخر فيكفي أن يقدم الطاعن ما يدل على ذلك، وللمحكمة أن تتخذ ما تراه في سبيل الاطلاع على هذه المستندات. يقيد قلم كتاب محكمة التمييز، الطعن في يوم تقديم الصحيفة في السجل الخاص بذلك. وعليه في اليوم التالي على الأكثر أن يسلم أصل الصحيفة وصورها إلى الجهة المنوط بها الإعلان لإعلانها ورد الأصل إلى قلم الكتاب، وعلى هذه الجهة أن تقوم بإعلان صحيفة الطعن خلال أسبوعين على الأكثر من تاريخ تسليمها إليها. ولا يترتب على عدم مراعاة هذا الميعاد بطلان إعلان صحيفة الطعن. لا يترتب على الطعن بالتمييز وقف تنفيذ الحُكم المطعون فيه، ومع ذلك يجوز لمحكمة التمييز أن تأمر بوقف تنفيذ الحُكم مؤقتاً إذا طُلب ذلك في صحيفة الطعن، وكان يخشى من التنفيذ وقوع ضرر جسيم يتعذر تداركه. ويعين رئيس المحكمة بناءً على عريضة مقدمة من الطاعن جلسة لنظر هذا الطلب، يعلن الطاعن خصمه بها وبصحيفة الطعن. وللمحكمة عندما تأمر بوقف التنفيذ أن توجب تقديم كفالة أو تأمر بما تراه كفيلاً بصيانة حق المطعون ضده، وينسحب الأمر الصادر بوقف تنفيذ الحُكم على إجراءات التنفيذ التي اتخذها المحكوم له بناءً على الحُكم المطعون فيه من تاريخ طلب وقف التنفيذ. وإذا رفض الطلب ألزم الطاعن بمصروفاته. وعلى المحكمة إذا أمرت بوقف التنفيذ أن تحدد جلسة لنظر الطعن أمامها في ميعاد لا يجاوز ثلاثة أشهر، وأن تفصل في الطعن في ميعاد لا يجاوز أربعة عشر شهراً من تاريخ وقف التنفيذ، وإلا وجب عليها أن تأمر بإلغائه. على قلم كتاب محكمة التمييز طلب ملف القضية المطعون في الحكم الصادر فيها خلال ثلاثة أيام من تاريخ إيداع صحيفة الطعن، وعلى قلم كتاب المحكمة التي أصدرت الحُكم أن يرسل الملف خلال ستة أيام على الأكثر من تاريخ ورود طلب الملف. تحكم محكمة التمييز بغرامة لا تقل عن مائتي ريال ولا تجاوز خمسمائة ريال على من يتخلف من موظفي قلم الكتاب أو الجهة المنوط بها الإعلان عن القيام بأي إجراء من الإجراءات المقررة في المادتين ( 7 )، ( 9 ) من هذا القانون في المواعيد المحددة لها. إذا بدا للمطعون ضده أن يقدم دفاعاً فعليه أن يودع قلم كتاب محكمة التمييز في ميعاد عشرة أيام من تاريخ إعلانه بصحيفة الطعن مذكرة بدفاعه مشفوعة بسند توكيل المحامي الموكل عنه وبالمستندات التي يرى تقديمها. وفي هذه الحالة يكون للطاعن في ميعاد عشرة أيام من انقضاء الميعاد المشار إليه في الفقرة السابقة أن يودع قلم الكتاب مذكرة بالرد مشفوعة بالمستندات. وفي حالة تعدد المطعون ضدهم يكون لكل منهم عند الاقتضاء أن يودع في ميعاد العشرة أيام الأخيرة مذكرة بالرد على المذكرة المقدمة من المطعون ضدهم الآخرين، مشفوعة بسند توكيل المحامي الموكل عنه. فإذا استعمل الطاعن حقه في الرد كان للمطعون ضدهم أن يودعوا في ميعاد عشرة أيام أخرى مذكرة بالتعقيب على الرد. يجوز للمطعون ضدهم قبل انقضاء الميعاد المنصوص عليه في الفقرة الأولى من المادة السابقة أن يدخلوا في الطعن أي خصم في القضية التي صدر فيها الحُكم المطعون فيه لم يوجه إليه الطعن، ويكون إدخاله بإعلانه بالطعن. ولمن أدخل في الطعن أن يودع قلم كتاب محكمة التمييز في ميعاد عشرة أيام من تاريخ إعلانه، مذكرة بدفاعه مشفوعة بالمستندات التي يرى تقديمها، وفي هذه الحالة لا تسري المواعيد المنصوص عليها في الفقرات الثانية والثالثة والرابعة من المادة السابقة في شأنه، إلا بعد انقضاء العشرة أيام المشار إليها. يجوز لكل خصم في القضية التي صدر فيها الحُكم المطعون فيه لم يعلنه مقدم الطعن بطعنه أن يتدخل في الطعن ليطلب الحُكم برفضه، ويكون تدخله بإيداع مذكرة بدفاعه قلم الكتاب قبل انقضاء الميعاد المحدد في الفقرة الأولى من المادة ( 11 ) من هذا القانون مشفوعة بالمستندات التي تؤيده. يجب أن تكون المذكرات وحوافظ المستندات التي تودع باسم الخصم من أصل وصور بقدر عدد خصومه، وأن تكون موقعة من محاميه المقبول للمرافعة أمام محكمة التمييز. لا يجوز لقلم الكتاب لأي سبب أن يقبل مذكرات أو أوراقاً بعد انقضاء المواعيد المحددة لإيداعها، ويجب عليه أن يحرر محضراً يثبت فيه تاريخ تقديم المذكرة أو الورقة واسم من قدمها وصفته وسبب عدم قبولها. تنظر محكمة الطعن في غرفة المشورة بعد أن يعين رئيس المحكمة القاضي المقرر، وإذا رأت أن الطعن جدير بالنظر، إما لأنه مرجح القبول أو لأن الفصل فيه يقتضي تقرير مبدأ قانوني لم يسبق للمحكمة تقريره، حددت جلسة لنظره. أما إذا رأت أنه غير مقبول شكلاً أو باطل أو غير جدير بالعرض على المحكمة، قررت عدم قبوله بقرار غير قابل للطعن فيه، ويكتفي في هذه الحالة بذكر القرار بمحضر الجلسة مع إشارة موجزة لأسبابه. يخطر قلم الكتاب محامي الخصوم الذين أودعوا مذكراتهم بتاريخ الجلسة المحددة قبل انعقادها بعشرة أيام على الأقل، وذلك بكتاب مسجل، ويدرج الطعن في جدول الجلسة، ويعلق الجدول في قلم الكتاب قبل الجلسة بخمسة أيام على الأقل ويبقى معلقاً طوال هذه المدة. تحكم المحكمة في الطعن بغير مرافعة بعد أن يتلو القاضي المقرر تقريراً يلخص فيه أسباب الطعن والرد عليها، ويحصر نقاط الخلاف التي تنازعها الخصوم. إذا رأت المحكمة ضرورة المرافعة الشفوية فلها سماع محامي الخصوم وفي هذه الحالة لا يؤذن للخصوم أن يحضروا بأنفسهم أمام محكمة التمييز من غير محام معهم. وليس للخصوم الذين لم تودع مذكرات بأسمائهم الحق في أن يوكلوا عنهم محامياً لحضور الجلسة. ولا يجوز إبداء أسباب شفهية في الجلسة غير تلك الأسباب التي سبق للخصوم بيانها في الأوراق، وذلك دون إخلال بحُكم الفقرة الرابعة من المادة ( 4 ) من هذا القانون. للمحكمة استثناءً أن ترخص لمحامي الخصوم في إيداع مذكرات تكميلية إذا رأت بعد اطلاعها على الطعن أنه لا غنى عن ذلك، وحينئذ تؤجل الطعن لجلسة أخرى، وتحدد المواعيد التي يجب إيداع تلك المذكرات فيها. إذا قبلت المحكمة الطعن تميز الحُكم المطعون فيه كله أو بعضه وتحكم في المصروفات. إذا كان الحُكم المطعون فيه قد ميز لمخالفة قواعد الاختصاص تقتصر المحكمة على الفصل في مسألة الاختصاص، وعند الاقتضاء تعين المحكمة المختصة التي يجب التداعي أمامها بإجراءات جديدة. فإذا كان الحُكم قد ميز لغير ذلك من الأسباب، فللمحكمة أن تفصل في الموضوع، أو أن تحيل القضية إلى المحكمة التي أصدرت الحكم المطعون فيه لتحكم فيها من جديد بهيئة مشكلة من قضاة آخرين. وتلتزم المحكمة التي أحيلت إليها القضية، بحكم محكمة التمييز في المسائل التي فصل فيها. ومع ذلك إذا حكمت المحكمة بتمييز الحكم المطعون فيه وكان الموضوع صالحاً للفصل فيه، أو كان الطعن للمرة الثانية ورأت المحكمة تمييز الحكم المطعون فيه، وجب عليها أن تحكم في الموضوع. إذا قضت محكمة التمييز بعدم قبول الطعن أو بعدم جواز نظره أو ببطلانه أو برفضه، حكمت على الطاعن بالمصروفات فضلاً عن مصادرة الكفالة كلها أو بعضها. وإذا رأت أن الطعن أريد به الكيد فلها أن تحكم بالتعويض للمطعون ضده في الطعن. يترتب على تمييز الحكم إلغاء جميع
