Statute overview

About this statute

This article ratifies the Rwanda–Morocco extradition agreement and says the contracting parties must extradite requested persons, subject to the agreement and their national laws. The Prime Minister, the Minister of Justice and Attorney General, and the Minister of Foreign Affairs and International Cooperation are responsible for implementing the Order. The text also sets extradition conditions, including a minimum two-year penalty threshold for prosecution extradition and a six-month minimum remaining sentence for sentence-execution extradition. This Order starts to apply on the day it is published in the Official Gazette of Rwanda. The Requested Party may refuse extradition on several optional grounds, including extraterritoriality, local jurisdiction, prior trial in a third state, and some in absentia convictions. If an extradition offence is punishable by death in the requesting party, the death penalty is replaced by the punishments provided for the same offence in the requested party’s law.
