An African Court of Human and Peoples’ Rights is established within the Organization of African Unity, and it is called “the Court.” The Court must, while taking the Protocol into account, complement the protective mandate of the African Commission on Human and Peoples’ Rights. The Court’s jurisdiction covers cases and disputes about interpreting and applying the Charter, this Protocol, and other relevant human rights instruments ratified by the States concerned. The Court may give advisory opinions on legal questions about the Charter or related human rights instruments, if the matter is not being examined by the Commission.
