This article defines key terms used in the Agreement, including partner states, sentencing state, administering state, conviction, intermediary, sentence, prisoner/offender, and prison authority. Partner States should cooperate as widely as possible on the framework of this Agreement. Prisoner transfer is allowed only if the legal conditions in this article are met, including a final sentence, dual punishability, state agreement, and at least 1 year left to serve. Transfer requests may be made by the sentencing state, the administering state, or the prisoner/offender, and consent must be informed, voluntary, and in writing. A transfer request should be decided without undue delay, with a response within 6 months. If refused, the relevant State must explain its reasons. A transferred prisoner or offender may not be tried again in the administering State for the same offence.
