About this statute

The Contracting Parties must provide reciprocal legal assistance for extradition cases involving accused and convicted persons, according to the Convention. Extradition covers offenses and attempted offenses punishable by at least 6 months’ deprivation of liberty, even if the tribunal imposed a different sentence. Political refugees prosecuted or convicted only for political offences by nature are not extraditable. Extradition for an accused person is allowed only if the offense is established in a way that would justify arrest and imprisonment under the laws of the country where the fugitive is found; for a convicted person, it is allowed only on evidence that sufficiently proves the conviction under those laws. Contracting parties are not required to hand over their own nationals, but the requested party must, on request, submit the matter to the competent authorities and send related files, information, and objects free of charge.
