The Convention applies to all branches of economic activity, with possible special rules for the armed forces, police, and public service under national laws, regulations, or practice. This article defines “collective bargaining” as negotiations between employers (or employers’ organisations) and workers’ organisations about working conditions, employment terms, and related relations. National law or practice may define how far “collective bargaining” also covers negotiations with workers’ representatives, and may need to take measures to protect workers’ organisations from being undermined. This provision says the Convention’s rules should be implemented by national laws or regulations if they are not already made effective through collective agreements, arbitration awards, or another method consistent with national practice. This provision says the Convention does not stop industrial relations systems from using collective bargaining within conciliation and/or arbitration arrangements.
