About this statute

These instructions set out how mortgaged immovable property may be managed, leased, auctioned, or taken over if the mortgagor defaults. The Registrar General appoints a receiver by notice, and may appoint a replacement or a non-professional bailiff in the stated conditions. A receiver is generally not personally liable for lawful, reasonable acts done while carrying out the receivership, but is personally liable for illegal acts, negligent omissions, and acts outside their powers or authority. A mortgagee applies in writing to the Registrar General for a certificate of mortgage management. If the application complies with mortgage law, the Registrar General issues a mortgage management certificate, and the receiver must give copies to the mortgagor and, if different, the property owner.
