About this statute

The Convention’s objects are to secure the prompt return of wrongfully removed or retained children and to ensure custody and access rights are respected across Contracting States. Contracting States must take appropriate measures and use available expeditious procedures to implement the Convention’s objectives within their territories. A child’s removal or retention is wrongful if it breaches custody rights under the child’s habitual-residence law and those rights were being exercised, or would have been exercised, at the time. This article says the Convention applies to a child habitually resident in a Contracting State immediately before a custody or access-rights breach, and stops applying when the child turns 16. This article defines “rights of custody” and “rights of access” for the Convention.
