Statute overview

About this statute

Contracting States must recognise specified rights in aircraft, including property rights, purchase-with-possession rights, certain lease rights, and some registered security interests. Aircraft-related recordings must be entered in one record, and a Contracting State may bar recording rights that are not valid under its national law. The authority’s address must appear on every aircraft registration certificate, and any person is entitled to obtain certified copies or extracts of the recorded particulars. This article gives priority and recognition rules for certain aircraft-related rights arising from salvage or preservation claims, and allows them to be recorded within three months. A priority right extends to all sums secured by it, but the interest included is capped at interest accrued in the three years before execution proceedings plus interest accrued during those proceedings.
